  2. I made contact with them (ie bank) to explain to them my reason for the default but unfortunately they had already filled a court case against me. I was able to re-negotiate a new payment plan with them for which i have been paying for the past 4 months now and this month will be the 5th month. I even paid 3 times the agreed amount in the first month to reduce the debt and also show my commitment and also asked them if they can do something about the court case and they told me as long as i fulfill my part of the obligation I should not worry but I still received a letter from the court relating to the loan a few weeks ago even though I already have an agreement with them. I checked my criminal records and everything is clean so far 1. who was the claimant/the bank you owed the money too? Mbank in Czech Republic 2. did they make you sign one of forms from the court you got? No forms was signed.

The application is confusing because the question asks "At any time have you ever had any of the following, in the UK or any other country?" and one of the bullet point was a civil court judgement, for example, non-payment of debt. So I should answer no then?

I defaulted a loan repayment and unfortunately, a court case was filed a week before I got in contact with the bank to re-negotiate for a new payment plan and amount for which I have been adhering for the past 4 months. Recently I received a letter from the court in relation to the loan. My problem is, I'm about to apply for a student visa for my wife and I want to go with her as a dependant. Will the letter from the court on my part affect the visa application? I fear if I declare it will rather raise a red flag as I see loan default as not a criminal offense but a civil one and if I don't will the UK home office find out? Your suggestions will be highly appreciated. Thanks
