  1. Hi thanks for the replies yes I'm still a director no default on the account first document was sent by email when the account was opened second document just appeared on the portal emails have been sent for some of the increases there's no actual signature on the documents just a printed name but i don't remember going online to sign an e-sign thing first document.pdf second document.pdf
  2. Thanks for you rapid response. i'm not sure what you mean when you say "I would certainly want to stop discovering how I could withdraw from the guarantee." The balance is nearly £35k Yes they have increased the limit without requests from us Thanks..T
  3. Good morning I wonder if some one could offer some advice in respect of a PG i provided as a director 5 years ago in relation to a company credit card. The initial credit limit was £2500 but has grown to nearly £35k No issues with it currently i'm just being prepared as stupidly it never occurred to me. If someone can help i'll upload the document many thanks...T
  4. I just wanted to update this thread...its been a long time! I submitted an SAR and the content I got back was unbelievable and quite shocking! Internal emails with very derogatory remarks about the account holders financial position and the passing of a relative. lots of admissions regarding coercive and intimidation behaviour by the firms agents and in particular lots of references to fees being applied to the account. I proceeded to put questions to them and ask for information in relation to the fees. To cut a long story. They have refused to provide further information but have wiped the debt which was several £k. which is , to my mind, an indication that they are in water they don't like. I am not happy to let this go as I feel they need holding to account and i want to know how much in fees they have added. Who do i complain to? The FCA? they referred me to the CSA but I doubt they'll have any teeth Thanks in advance...Tim
  5. Its actually really reliable! I love it. I don't really know any Scom riders who've had loads of issues apart from the early speedo/fork issues. I'm more miffed about the lack of support for the brand, don't see why i should shoulder the hassle. i don't need advice on the scoot i was looking to clarify the legal position. And everyone has been most helpful Rally going scooterist, several Lambretta's, Vespas and a Scomadi
  6. Thank you for the responses. My last payment of a three year agreement is next month. My thoughts are that if i cant repair in the future it its not fit for purpose. and it has no value as there's no dealer service history and no one will purchase a machine that has no available parts Thanks.
  7. The problem: The manufacture no longer have a UK importer or dealer service network. Parts are also impossible to source. So I'm thinking in the future its going to be be useless. Close Brothers are trying to treat it as if its got specific faults, which is of course irrelevant. To my mind No dealers, No parts = No use going forward Thanks
  8. I purchased a new Scomadi moter scooter in 2019 with a hire purchase agreement from Close Brothers. Due to a long court case with another manufacturer Scomadi no longer have a uk dealer network. You can also not source any parts. As i cant get it serviced by a main dealer or repaired if it breaks do i have a claim against the finance company Kindest regards
  9. Purchase price £19.5k Mercedes GLA Night Edition The closest i can find in terms of spec is a Premium Plus although the advertised touch screen would have been a very expansive optional extra Year older P Plus model without touch screen £23k
  10. Even if the contract was made at the point of collection the advert had been withdrawn so no reference was available. don't know if that's relevant. I will also rely on the 1999 act. The car purchase is nothing to do with business and I'm a building contractor thanks.
  11. Hi Mediation did not resolve the issue. Should i join Santandar as a co-defendant before it goes to a hearing or would it be a new claim? Thanks
  12. Yes thats a really good angle. I have a car dealer friend who also advised the same course of action. Thank you you've been very helpful t
  13. It was always refundable. I think the third party rights and the fact it was partly funded by a part exchange is enough If its struck out I'll go to Santander t
  14. Yes it was refunded. Although I struggled to get it off them. They didn't get me to sign a crucial document in respect of the finance agreement. They insisted I sign it retrospectively before they re-funded, I refused until they'd refunded. They eventfully refunded me and i still haven't signed it. Thanks again..your advice in respect of "rights of third parties" is really relevant and helpful T
  15. Thank you for your helpful reply. Yes I'm claiming the difference between the specification of the advertised car and the specification of the actual car. I paid a reservation fee to take it off sale They actually admit to most of the points raised in respect to the missing features. I'm quite happy purchasing vehicles long distance. I procure several vans a year for my business along with Cars and Scooters for personal use. My personal car is always new, but thanks for your concern
