FOS have rulings agreeing to this such as DRN0300892 DRN7191130 DRN2406526 Its legislation and law of the land it does not expressly need to be written into a contract for it to be binding, think of the Cunsumer Rights Act you are covered by it regardless. The proportionate element refers to a percentage and is covered in the Decisions above. They take the percentage of the cost of the policy and apply it to the benefit. The FOS agree with this process and can be seen in the decision
