  1. This was the first time I've ever gotten a claim form,

    the only previous one back in 2020 was lost in the post I simply never received it.

    I should've put a reminder in my phone calendar on this one to remind me of that defence date, 19 days later or whatever, I'd completely forgotten about that date tbh.

    I still have an ongoing one on here in London, E3 - let's hope I have more success with that one!

    In terms of screwing up

    I had one previous ticket that defaulted and ended up in a CCJ from Southend airport because for some reason during COVID I didn't receive their claim form just a notice of default.

    This hospital ticket was the 2nd ticket that went to CCJ due to a lack of knowledge of the process.

    Maybe it's easier just to pay them in future I'm thinking though, I don't get them very often anyway

    I've done my defence and printed it out ready to post first thing tomorrow to the court,

    see attached pdf for my generic defence copied from sticky

    obviously with my reg not left in on the defence form.

    This defence is relevant in my case since I was there 90 seconds so couldn't possibly have entered into a contract right?

    3. As held by the Upper Tax Tribunal in Vehicle Control Services Limited v HMRC [2012] UKUT 129 (TCC),
    any contract requires offer and acceptance. The Claimant was simply contracted by the landowner to provide
    car-park management services and is not capable of entering into a contract with the Defendant on its own
    account, as the car park is owned by and the terms of entry set by the landowner. Accordingly, it is denied that
    the Claimant has authority to bring this claim.
    4. In any case it is denied that the Defendant broke the terms of a contract with the Claimant.
    5. The Claimant is attempting double recovery by adding an additional sum not included in the original offer.
    6. The Particulars of Claim is denied in its entirety. It is denied that the Claimant is entitled to the relief

  4. I'll dig through their documentation see if I can find it, if needs be could I request a copy from the PPC since they seem to want to take it to court?

    Actually looking at the original post of mine in this thread it appears that I didn't retain any of their original NTK docs etc as I thought they'd dropped the charge since I hadn't heard anything on this in over a year.

     

  5. No the ICO complaint was definitely this one,

    I hadn't had any correspondence from the St Thomas's hospital one in almost a year and then out of the blue a claim form hit the doormat that was it on that one!

    I sent an SAR on this one back in December to which they completely ignored it and just sent another threatening letter in March asking for payment hence the ICO complaint

    Sorry what's this WS referring to? Also who's Alliance? The PPC is NPE.

    you said I had an ironclad case without the documents.

    I just sent an SAR that they initially ignored (before I was in contact with you guys foolishly on this one).

    After ignoring my SAR in Dec they made another request for payment in March  I threatened them with the ICO for the GDPR breach re the SAR

    I'll take the time to put all their letters & my letters in chronological order today so you can see how it's progressed.

    I'm pretty sure I've uploaded them all though although not all together in one flow, I'll do that later

  6. Ok thanks for that, well spotted and all duly noted.

    Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something.

    When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!
