  1. The status of the claim is now saying DQ sent 12 May 2022. Can someone please advise what we should be putting on this? We've not actually received this yet

All I can see under claim history is: A claim was issued against you on XXXXXX Your acknowledgment of service was submitted on XXXXXXX at 20:xxxx Your acknowledgment of service was received on 09/03/2022 at 08:XXXXXX Your defence was received on 16/03/2022 If they are going to proceed, they should inform the court? I can't see anywhere that they have done that. We have not received anything requested under CPR31.14 either

Hello All, we filed a defence and received a letter from the court dated 16th March stating the defence was received and if the dispute is not sorted informally, the claimant should inform the court within 28 days if they wish to proceed. We have today received a letter dated 13th April from DCB legal stating their client wishes to proceed but their client may be willing to settle this. They want a reply within 7 days. Can someone advise if I should still defend this please? Thank you

  5. The acknowledgment has been registered online with the court and a CPR 14 letter has been sent to the solicitors. Can I get guidance on what the defence should say please? I understand that the NTK was not POFA compliant as stated by Ericsbrother. Is there any specific wording I should use in the defence please?

  7. I apologise for the delay in posting this. It is a claim form. I understand that my daughter will have to acknowledge the service and have read the posts over the last couple of days. I have not dealt with any parking fine claims, do I defend this? I know it's been stated that the POFA was non-compliant, can they ask to amend their pleadings and re-issue? We have had absolutely no contact with this company or acknowledged any liability or advised who was driving the car. Parking Fine Claim.pdf

  9. Hello DX and Ericsbrother, DX and Ericsbrother, thank you for the latest replies to this thread. I have read the notice, it is sent to the keeper and not the driver of the vehicle and there is no requirement for the keeper to identify the driver so there is no one left to pursue? They have obtained information from the DVLA without permission to issue the notice to the keeper. Breach of DPA and GDPR? There was no notice given to the driver or anything left under the windscreen to advise them of the failure to pay the correct parking charge. I did not see a payment machine when I went there again yesterday unless it is hidden in a corner somewhere. I am still not sure about the notice at the entrance, is the large sign not enough or does the sign have to be sited in a place before you actually turn into the access road? I hope I have understood all this correctly.
  10. I am sorry, I don't know if I misunderstood, I have taken a screenshot from Google Maps that might clarify. I had to do a right turn into the ice rink from Lea Bridge Road. From Lea Bridge Road, there is a small access road that leads you to the ice rink. You can see the sign that is in my photographs on the left as you turn into the access road to the Ice Rink. Once you have turned into this access road which leads to the ice rink you cannot turn back and Lea Bridge Road is a very busy Road, so you cannot reverse out. You have to go into the car park to turn back around and out Google Maps Entrance.pdf
  11. Hello Everyone, Sorry I have not posted on here for a few days. I managed to get to the ice rink this evening and have posted photographs that might help decide if the parking notice should be paid? Thank you for replying before and in anticipation of additional help The first photograph is the exit of the car park, no automatic barrier. I presume the barrier that can be seen is never closed as one of the signs states parking charges are in force for 24 hours a day. The second photograph is the sign in the car park The third photograph is the entry to the car park Just a thought, I might get a further ticket for going there and not paying again! : ( IceRinkParkingNotices.pdf
  12. Hello DX, She is probably about 20 minutes away from there. I have asked her to go there and look at the signage and take photographs as there appears to be a sign in the middle of the car park on Google Maps but that image was taken in 2016 and that sign may have been taken down as a lot of people have stated on TripAdvisor that they got caught out and received parking charge notices as well https://www.tripadvisor.co.uk/Attraction_Review-g186338-d3229301-Reviews-Lee_Valley_Ice_Centre-London_England.html
