    Hi again, well, today I received another standard letter (second class post again!) informing me that I will receive a reply to my LBA in the next 40 days. I have also been on the phone today and requested a breakdown of my refund but was told that the information was not available so... should I continue my claim for the full amount as their deadline is Friday? I expect I will be taking this to court as I don't suppose I will receive anything else by Friday. Thanks again
  2. Hi not sure if anyone can help me but I had a car from yes car credit through Direct Auto Finance in 2003 (seems I made a big mistake). Having gone through a divorce the car went back 2005. The finance was in joint names. Ihave had a read around on here and I might have got it wrong but am I right in thinking that after half of the total balance has been paid the car can be returned so the payments can cease? If this is the case can I claim any money back? The remaining balance at the time when the car was given back was almost £6000 out of a total of £9000 and I was told to pay £3000 and my ex wife would be chased for the other £3000. As I have paid more than half of the remaining balance can I reclaim any of that money? Thanks for taking the time to read this and I hope somebody can help.

  4. I am already two months into one claim with Abbey but I have another account which was £310 overdrawn so decided to try a phone call before starting sending the letters. I wasn't expecting much to come of the call but after being put on hold for 5 mins the lady refunded all of my charges (all of which were unpaid). She did however repeat on numerous occassions that the charges were lawful but then refunded the money anyway so think what you like of that! Has this happened to anybody else?

    Hi, thanks again for the help. I had a letter yesterday informing me of the refund (supposedly a gesture of goodwill). Another question - Abbey have noted on my credit file that the £720 which has now been refunded was unpaid for four months, as they have now cleared that outstanding balance can I have that removed from my credit report? The account did not have an overdraft facaility. Thanks again Gemma

    Hi, Thanks to everyones help from this site I have now sent off my letter before action which requires a reply by next Friday before the next stage starts. I started my claim a few months back for a total of £1292, £792 of which was charges which I had not paid and were taking me into my unauthorised overdraft. Anyway, yesterday I received a letter from Abbey informing me they had refunded £792 making my account balance £3 again. As you can see from hte figures above I am still owed £500 in fees which I actually paid so hopefully I will see that soon. I have another account with Abbey which has also incurred charges recently (last month, approx £300) and I was wondering if anybody can help me? Will I need to start the whole claim process again or can I add on these charges with the next letter I send to them? Any help will be much appreciated. Thanks Gemma
