  1. Thanks both of you for your replies..but i really cant get my head round this one? If the HB is being paid at £540 per month i will have to make the diff up at £360pm ok. 21st April i paid her £6300 (6 months rent plus i months deposit) Rent due again Oct 21st. On 16th Oct she recieved cheque from HB for £1080 this payment was for 21st Aug until 16th Oct, but this is for a period of time ive already paid to her. Her next payment from HB will be 13 Nov and this will be for the period from 17th Oct until 13th Nov, as they are paying every 4 weeks, so effectivly they are paying half of Oct and half of Nov and then on the 21st of Nov (if i was paying) she would recieve the balance of £360?. Cillibanger & Mrshed, i am really struggling to get my head round this one, im genuinly not trying to be awkward..honest, i just cant seem to grasp this. Thanks for your replies
  2. Cillitbanger: Thankyou very much for your reply, Ive just recieved this email from ,any idea's on this? "I have banked the £1080.00 which will pay for the rent of the 21st October 2006 leaving an overpayment of £180.00 which will be deducted from next month's payment. So next month I will receive £540.00 from the council, in addition to £180.00 from the overpayment, giving a total of £720.00 for the rent on 21st November 2006. This will leave a shortfall of £180.00. My solicitor and financial advisor are looking at all the details at the moment and will get back to me with their findings." I cant work out why she thinks that she is in the right? perhaps this is due to my ignorance? But im glad someone else has been able to see what im trying to explain.. Many thanks Cillitbanger
  3. Hello all Ive got a bit of a sticky situation here and was looking for some input if possible? Basicaly on 21st April 06 my family and i were forced into rented accomodation (courtesy of gmac) on that day we paid £6300 rent this was for 5 months rent in advance@ £900 pm plus 1 months deposit =£6300. So on the 21st October 06 i would then be laible to pay another months rent. However since July 05 i have been waiting for an operation which has stopped me from working. So in August 06 i applied for hosuing benefit to commence from October 06, the housing benefit i have been entitled to is £540 pm and i will make up the balance from our benefits. I received a letter the other day from the Housing benefit stating that i have been awarded this amount and in addition a payment is to be sent to the landlord (i have asked for all rent payments to go directly to the landlord) this payment is for the sum of £1080, but is from 21st August until 16th October 06, but for this period i have already paid? My landlord who has been quiet amicable up until now, but i feel things are beginging to turn? The way i see it is, she can keep the £1080 and each month ie Oct/Nov/Dec deduct the £360 from this amount to make up the shortfall on the rent from H.B? The H.B. pays every 4 weeks and in arears, ie the money that they will pay on the 13th Nov will in fact be payment from 17th Oct until 13th Nov, but she (landlord) seems to think that : A) she is losing out? B) im living in a property for a month rent free? If someone could help me understand this a bit i would really appreciate it. Thanks in Advance

Hello, SORRY ASH TO HIJACK YOUR THREAD! my wife got exactly the same letter and same cost,what should she do pay this bill minus the £23.50 or pay the full amount and then try to reclaim this £23.50.?   5. Hello lola (tracy) I suffer from epilepsy and have to give up driving. I said that in the earlier post i made you would be entitled to DLA and other forms of benefits. But: The DLA does depend on how frequent your seizures are and how they effect you, do you have partial, complex, or full blown seizures? NATWESTSTAFFMEMBER, is right in saying that some people do have a vague notion of when an epileptic is going to suffer a seizure, as this is the case with me sometimes (normally a 30 sec warning) or thereabouts. When filling in ANY of the forms regarding your seizures espicially the DLA it will ask questions like: 1)can you make a cup of tea? 2) can you cook a meal? They may seem simple questions but PLEASE TAKE NOTICE that they do not say it , but they mean..when you are at your worst, ie in your case when you are having a seizure, so the answers to all them type of questions would be NO!! It took me over a year to get DLA and two tribunals, basicaly because i filled the forms out as any normal person would when asked simple questions like the above, because nowhere on them forms does it state that the questions are to be answered when in your worst condition. Regarding your Partners Carer's Allowence: This again would depend on what type of care you need when you have a seizure and the aftercare of that. The same would apply to filling out any forms applying for C.A. Other factors that the DWP will take into consideration when you apply for any benefit is: Are the seizures controlable with medication (which in my case they are not) The amount you have per day/week/month The recovery rate per seizure (this is quiet a mixed question) because every seizure is Totaly different for every person who has them and in fact even for the same person, every seizure is different. Are the seizures day/night or both Do you have any kind of warning Is there any pattern to them They will backdate any payment for DLA if you get refused and go to tribunal and then get awarded it. As for the C.A.B. well for my own personal reasons they didnt fil the forms in correctly which led to the long hard slog to finaly get DLA awarded. So please when you fill the forms in you must remember to fill them in when answering as if you were at your worst. I cannot stress enough of this point, the forms are very difficult to understand, even for C.A.B. and this is where a lot of people including myself have fallen down. If you do need any help please ask me , i will help you , or one of the other members will, i can only help "from my own personal experience" and not offer any legal or advice like C.A.B do. I hope this is of some use to you.
  6. To the original poster: Tracey You are intitled to get DLA and if you have a partner or someone who cars for you they are entitled to recieve Carers Allowence. If you are unable to work becuase of the amount of seizures you have then also you will get Income support (not JSA) As you wont activily be seeking employment. You should then also be able to get help with Council tax/Housing depending on your condition and personal position. If at anytime you have to fill out any income/expenditure forms for any reason your DLA does NOT get taken into account, this also applies to any other monies received from DWP, the DWP do NOT take into account your DLA To Taff999: It is down to the person who has the epilepsy to disclose to the DVLA.

They (gmac) must be printing these letters off by the thousands, i got the exact same one "last paragraph" "we are not taking this as a formal complaint blah blah blah" So good luck to you on this and let us all know how you get on please. Mick-0: i sent my LBA to : Gmac-Rfc Eastern Gate Brants Bridge Bracknell Berkshire RG12 9BZ That i only sent 13-10-06, so they have yet another 14 days in which to pay, but i doubt they will, they seem to be holding out....for a change in the law hahaha!!!
  8. Hello Isiris well this is the state of play today. ive been incommunication via letter with their complience officer Mr Richard Nettlingham, since after posting the original thread. His last letter to me stated that he would get back to me by 14 10 06 but in my previous letter to him i stated that they had unitl the 05 10 06, so when the 06-10-06 came i hadnt heard anything i posted the LBA. So i am now waiting for the reply from that. But will keep you updated on the replies i get and if there is something of interets i will post it in this thread. All the best, and stick by your timelines, is the advice ive been given?
  9. hello Wonder if anyone here would be able to tell me where i stand with this ? Recently had to move into rented property, we paid 6 months in advance, which is due to run out on 21-10-06. I have put in a claim on 14-08-06 for Housing Benefit, neither i or the landlord have heard anything yet, on the form i said that i wanted the rent to be paid directly to the landlord. If my claim for housing benefit is not sorted out before 21-10-06 (i signed a yrs let) where do i stand, i personally cannot afford to pay the rent myself and do need financial help, i am recieving: Incapacity Benefit / Disability Living Allowence / and my wife recieves Carer's Allowence. Any help would greatly be appreciated. Thanks

I really dunno what to do with this one?

What im concerned about is a) the fact that i have NOT paid them anything for a few months, are they likely to just send in the debt collectors b) are they just ignoring all my correspondence for a reason? Where would i stand? If i complain, am i gonna open up a can of worms --so to speak? Well their times up today (40 days) which was sent R/D, Shall i just send the Non-Complience letter? thanks lads
  12. Yes mate, all the DPA SAR have been sent recorded delivery , plus all correspondence with credit solutions also sent R/D. But all prior letters to them explaining my situation were not (from what i can remember) thanks

Do i send them a non complience letter? in the info which they have supplied (and were quick to do) it gives the basic figures at the end but only the final settlement figure, there is no mention of and early settlement figure just the balance. Wife and I know they charged an ERC..just cant see where it is from the info given? Anyone fancy taking a look for me!!! All the best...heeeeeeelp!!!
  14. hello all This one is puzzling me if anyone has any ideas of where i stand or what to do next i would really appreciate it! Basically i owe them around £2500 after PPi failed to pay out on the "pre-existing medical condition " clause yet again! They sent the debt to credit solutions & mercers who have tried to make contact with us at our old address (had to move forced sale on our home) . Both my wife and i have b'cards my wifes debt is £650 and they have accepted 10.00pm via credit solutions. I sent of 4 (four ) DPA one of each for my wife and i to Credit solutons and b'card, credit solutions sent the SAR back with in a couple of weeks, barclay card sent my wifes SAR back within a couple of weeks.....But have not acknowledged anything i have sent them ? There time runs out tommorow (40 days) 13th Sept, but like i say they have not acknowledged anything ive sent. I have sent them numourous correspondence prior to finding this site...Nothing I sent the DPA to them ..Nothing I offered via credit solutions 10.00pm .....Nothing At the moment they are getting aboslutley nothing from me financially so whats going on? What is happening ..anyone got any idea of my next move? Thanks

Our decision to process customer data overseas was made to facilitate greater processing efficency whilst maintaining a high level of service to our customers. Where data is processed overseas, we ensure that an appropriate contractual arrangments are in place which complies with our obligations in that respect uner DPA and that the data is protected to the same standards required by the DPA1998. I hope this has addressed your concerns and reassured you regarding the legal bais on which our agents act for us and the importance we place on the protection of customers personal data.   18. OUCH!!! Bookworm that scared the pants off of me heheheh. Anyway a bit of an update here? I received a call from them today (possibly in realation to the s.10 i sent) and the woman explained that the reason the claim was being stopped was due to the fact that i had NOT got the disabilty form stamped by "The Benefits Agency", i again explained to her that: A) The Benefits Agency does not exist anymore B) The Deaprtment of Work & Pensions will NOTstamp "anything" that does not relate to them . I told her that when i went to the DWP they advised me to Photocopy all documents in relation to any benefits i recieve and send them with a letter explaining the above and that this should be sufficent. Which i did! However the only paperwork the woman had was the 1 sheet of paper outlining my illness (completed by me) and the "missing stamp" from the now de-funct Benefits Agency, i explained to her that i would have NOT just sent that 1 sheet back without a covering letter at the very least and proceeded to explain to her that the letter was sent R/D and what should have been in the package, as this was a Package. She then said she thinks the paperwork "may have" been seperated in different departments? So Bookworm, shall i still send the letter you posted?, what dya think mate, i will await your reply. Hello Bookworm, Thankyou for your reply, i will have to answere the Questions you raised like this as i still havent worked out how to use multiple quotes..Der! 1)The barrister: Well due to the amount they charge (no disrespect to them) we have had to let him go, he was worth the money on our day in court, and probably without him we would have been made homeless there and then, but we couldnt carry on financially. 2) The PPI, now that's another story... Sorry to ask such an obvious question, but what documents do you have? I have all the documents relating to this from the original one sold by the broker and to the new-renewal one. 3)How were they made aware of it? Do you have a letter confirming this? Or a response from the insurers? I wrote them a letter enclosing the original letter from the hospital, but never recieved a reply? 4) Was this confirmed in writing, either by you or them? they only confirmed that the insurence was to "carry-on" Did they in fact continue to collect premiums, either at £62 or at the increased rate of £65? They started to collect £65.33 Did your insurance reference number change at all? Well yes and no? strange, i know but the reference number when i have dealt with them didnt change but the policy number did? Did they send a new policy leaflet at all? A new certificate specifying exclusions? ANYTHING? I received another policy leaflet, but everything in it was exactly the same, ie it didnt say in the exclusions regarding that they would cover me for everything else other than a brain tumor? 5) Playing devil's advocate here for one second: They could have kept on insuring you for other things, (say if you dropped of a heart attack), but specifically excluded the pre-existing condition. A lot of inscos do that. Yes i understand that, but they never exluded me for the "brain tumor" and stating this, it was the general pack they send through. 6) How did the FO decide? Can you post it here? The F.O.S. were my intitail complaint, they handed the case over to lloyds, and they felt that, the insurence company had acted correctly? My arguement all along has been this? a) they or someone underwrote that policy knowing that there was an illness. £60 plus pm on a 140k mortgage for single person cover only. b) why have they changed their reasons for not paying out on 3 occassions. 1) you have consulted a Dr within 12 mnths prior to the inception date of the policy (this was their fisrt reply) 2) It was a pre-existing medical condition. 3) When lloyds got involved, baiscally the answere given to why they were not paying was a mixture of No: 2 and the fact that they had not asked me to see one of their Dr's? PS: At some point, I may well ask you to let me have a read at the actual policy wording, so you'd better look for that as well I am willing to email/post any docs required, to stop this blatant organised and legalised robbery, for myself and others who are /may be in the similar position.   24. Hello all thanks for reading this , was wondering if anyone could help with this one? Sent S.A.R. to swift they replied within a couple of days, sent another letter stating they had left out certain bits of data, again they response was very quick but the main info im looking for still isnt there? Basically im looking for the amount we paid to them as part of an early redemption /settlement figure. Both my wife and i know we paid around £4/5500k due to this when we remortaged we couldnt afford to pay off all our debts. Swift, up until now have been very quick with both replies, but im wondering if this wil change if i approach them again? On the actual charges it shows: Redemption admin fee £165 Sealing/discharge fee £95 Checking/releasing deeds fee £95 and then the final balance Am i missing something here? i just cant seem to grasp the concept here, the figure we paid to them, we know, did involve an ESF/ERF or penalty, whichever way you look at it, but i cant seem to find it. Any help appreciated Thanks in advance
