Hello Guys, I'm currently helping my neighbour with the above (shes only next door) , she has sent me whatsapp on the parking charge and the notice to keeper, which she ignored but unfortunately she had a LOC which she also ignored.

i have so far:

done acknowledgment of claim

sent CRP request to sols.

she said she went to the shell garage to put petrol in, however before she entered the carpark her phone rang and she pulled over to answer it, next thing this arrives in the post.

the time stamp is 1 minute on a "no stopping zone". i have reassured her with all the knowledge i have learnt over the years on the site, reading ect but whats everyones thought. i think they are playing a dangerous game and will discontinue this.

They emailed me back today asking to try a different charger, I have tried multiple, the usb adapter I got also from.amazon to use my wired headphones bring up the same message about moisture. So weird.

A trader, I paid via debit card

evening everyone,

my old phone was doing my head in being slow, so decided to get a budget phone , the price was £219.95 on eBay, bought 11.11.2023.

the phone was bang on,  then around 2 weeks after started randomly displaying the water detected error message(i have no where been near any water).

I thought it just need restarting but its constantly on the message beeping at me, wont even let me charge it.

the phone is dead

eBay say the Return window closed on 14 Dec to do anything,

is there anything i can do.

looking at the attachments, this looks like a fake claim form what the seller has made and printed themselves, i maybe wrong...

Just downloaded the CPR from them, is it a joke? , where the breakdown of each one? Is that all you received ?

i would go all the way with this IMHO..can see them discontinuing later down the line..

Section9 [2][f] includes the wording in brackets  the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid;.

As they have missed the words in brackets off that is another fail and they have failed to meet the applicable conditions  by not stating the parking period the keeper s no longer liable for the charge.

Please be advised that I have absolutely no intention of paying these extortionate and ridiculous made-up sums of money for allegedly breaking some imaginary contract which I never entered into and which you have not demonstrated how I personally became party to.

You do not even have the identity of the driver who had the vehicle on the alleged date of offence, yet you want to litigate against me. 

I could go on but it is enough to say that this whole claim is utter nonsense and I’m sure that any Judge would agree.

Should you wish to proceed with this farcical claim, then i will be requesting  unreasonable costs order under CPR 27.14(2)(g)

Well hoops and hurdles maybe needed, we can all advise on this forum to help but you need to put SOME effort in.
