  1. I have now received a reply from Smart Parking & as expected they have decided to uphold the PCN. I shall be appealing to POPLA. I did not admit to being the driver in my appeal to Smart as I was not even present at the time, I did not disclose who the driver was.

For PCN's received through the post [ANPR camera capture] please answer the following questions. 1 Date of the infringement 24/10/2019 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 30/10/2019 3 Date received 02/11/2019 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] No, only that it is subject to the Data Protection Act 5 Is there any photographic evidence of the event? Yes, vehicle entering & exiting car park in darkness. 6 Have you appealed? [Y/N?] post up your appeal] Yes online. Have you had a response? [Y/N?] post it up No 7 Who is the parking company? Smart Parking 8. Where exactly [carpark name and town] Havens Bank Retail Park, Exeter For either option, does it say which appeals body they operate under. Hi - As registered keeper I have received a Parking Charge Notice - online it states not enough paid for parking - a ticket was purchased for more than enough - but - only the last 3 letters of the Reg were input into the machine. It does state on the parking notice by the payment meter in small writing, the full correct registration should be entered. However, it was dark and the writing is small & not noticed. I have seen others lost their appeal for doing the same. What are your views please.
  4. My son has just received a ticket for the same car park. He also believed being late that the car park was free - as it was previously. He was at the Bowling Alley clocked going in at 21.10pm - so also dark & he didn't notice the signs saying he needed to pay as it was now 24 hour parking.
