  1. So it would be best to use that money and go to a solicitor? Do we hide the car? They're getting nasty!
  2. They are trading as Log Book Loans I believe. And that is who the payments go to. And is on all letters. Our local Trading Standards have taken details, they seem to be interested but who knows. They say they're not part of the CCA? My parents cannot afford a solicitor, they are on a DMP and funds are tight. They are on course to pay £300 to them next week and then a regular £200 each month until it finishes. But if they are going to take their car anyway I don't want them losing that cash. They have had enough to cope with this year and only just avoided an IVA for a DMP.
  3. Hello, I wonder if anyone here could give some advice? I would be most grateful. My parents took out a loan on their car from the above company in May 2009. Danesmead Investments Ltd - Log Book Loans Registered Number 4246206 They have been behind with their payments although they are in fact catching up with them. And in total the loan will be paid for by Autumn. But suddenly today, they have a letter stating the car will now be repossessed? Looking on this board, a few questions come to mind. 1} We have no proof that the BOS is registered, just an agreement signed and witnessed by the manager. 2} I know the OFT are investigating them, would they consider Danesmead a part of Log Book Loans? 3} Are they even covered with the 1974 Consumer Credit Act to serve default notices? Any help would be much appreciated. My parents are pensioners and tis only because I have a computer that I have found out anything at all. They are panicked and intimidated, they do not want to lose their car. Once again, any help and advice would be most welcome. Thank you :0)
  4. Thank you. So in idiot terms, how would you know if your CCA goes against any or all of that?
  5. Hello, Can anyone tell me what exactly is the difference between CCA's signed before 2007 and those after? I hear a lot about it but I've never found an answer to tell me what changed? Cheers.
  6. I is well out of the loop here. Is something good happening today?
  7. Wel they have replied again stating that they do not have to send a copy of the agreement with my signature on it and when am I going to resume payments? Not sure what I do next?
  8. There is an article on Cattles in the financial pages of the Guardian today. Something I don't understand about it though, it said that FSA does not regulate Cattles' lending yet on every letter I have seen from Welcome it says that they are regulated by the FSA? I assume there is a difference between being 'regulated' and regulating the lending part? I was hoping someone here would be able to explain the difference.
  9. Are they doing their own version of 'The Long Goodbye' ?
  10. Millymo....cheers...just noticed this letter isn't from head office, just a local branch....lets tally up the figures. You'd think with all that is happening they would be making sure that they were dotting the i's and crossing the t's...at least give an impression that they know what they're doing...but no...same old same old.
  11. Okie dokie....parents received a letter from Welcoem this morning. Not the CCA that we have requested but a Default Notice. I am under the impression that unless they can produce a CCA that there is no action they can take? What are they playing at and why won't they send it?
  12. Is this any good? [your address] [their address] [DATE] Dear Sir/Madam Data Protection Act Subject Access Request ACCOUNT NUMBER: xxxxxxxxx (or multiple numbers if more than one account) Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable. Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response. I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee. If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable. I would be happy to collect the Data from my local branch. Yours faithfully, [name]
  13. With a SAR you are just asking for infomation with a CCA you want the signed agreement. If they can't produce that, you become in dispute...I think...there is a very strong possibility that I might be learning something here lol.
  14. Parents have a letter from Welcome. No CCA as they requested, just a letter saying thank you for your SAR ??????? The fee for a SAR is £10 and the fee for a CCA is £1. Well....we knew that. We enclosed a £1 postal order for the CCA and sent it Special Delivery and we know it was signed for. Lord knows what they're playing at, but it works in our favour if they don't send it I suppose?
  15. According to Mr Simon Spencer-Brunt...a Claims Team Leader.{ My email to NU was forwarded to him at DG.} Direct Group are 3rd party claims administrators and deal with insurance claims for Welcome Finance policy holders. The Underwriters of these policies are Norwich Union. He emailed me info of several old policies........and absolutely no info at all on the ones that apply to now.
  16. Surely the phone charges and letter charges can be claimed back using the same kinda methods as bank charges. IE : you agree to a charge when you sign but anything above and beyond what it actually costs becomes a penalty?
  17. Gosh yes, very interested in AD HOC FEE's and Capitalisation. Morning good peeps.
  18. I'd just like to ask that when all becomes out in the public domain, could all those that have been there, done that and are enjoying wearing the t-shirt guide the rest of us non-t-shirt wearing peeps in the right direction I honestly never realised I was so dumb until I read these boards
