  2. Hi Lucie, I do not need you to cancel my membership, it was cancelled in writing within the 14 day cooling off period, at the gym itself. The letter was taken by a staff member called . It is unfortunate that they have not informed you but it is their issue not mine. I have fulfilled my obligations on this matter. I am happy to pay the £20 joining fee as well as the £20 membership fee. I will pay £40 sum total. No unlawful penalties from yourself will be acknowledged by me. This dated offer was put to yourselves in my first email and expires soon. Once you agree to this amount I will pay the monies by BACS. Once this offer expires I will not liase with you, or anyone claiming to act on your behalf. The matter will be left in dispute. I will only pay any monies when instructed by a court of law after this time. Thanks
  3. Thank you for your email. We can confirm all cancellation requests for Xercise 4 Less are dealt with directly via their Website. Under the terms and conditions of your membership with Xercise 4 Less 1 months notice is required to be given directly to Xercise 4 Less Website, as the Direct Debit was cancelled and no notice received from the Xercise 4 Less Head Office, an automatic letter was generated to advise you reinstate your Direct Debit. Please note Xercise 4 Less will only accept a cancellation requests if you membership is up to date and your Direct Debit has been reinstated, therefore you must contact them directly- Quote: to discuss if you have previously given notice to cancel your membership. To reinstate your Direct Debit and pay the outstanding £64.99 to bring your account up to date, please call Harlands: 01444 449033 Quote Reference: We are simply the Direct Debit company on behalf of Xercise 4 Less, we cannot cancel a membership until we are advised to do so by Xercise 4 Less Head Office. To date we have not received any cancellation advice from Xercise 4 Less.
  4. Hi Joe, Thank you for your email. Can I ask you to check again with the gym. They have 100% recieved the letter. I have fulfilled my obligation by passing this to a member of staff. It is their obligation to inform you. Reading the reviews of yourselves and Xercise4less it seems to be a common theme these letters dont make it to you. The administration fee is an unlawful penalty, I will not be paying it. My initial email offered £40 and this offer was dated. Once that date passes the offer of payment expires. I will then cease to liase with you or any of the companies I named earlier and will only pay once instructed by a judge. Thanks
  5. Dear Thank you for your email. We can confirm we will await for a response from Xercise 4 Less in regards to your cancellation. However, in regards to your payment, you are in arrears for October for £64.99. This payment includes your £19.99 monthly instalment, a £20 joining fee plus a £25 administration charge due to mispayment. It does state in our terms and conditions, which you have agreed to be bound by, is that "If you fail to pay any monies due under this agreement or if any Direct Debit is returned unpaid or any cheque is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay us on demand an administration fee of £25.00 (which we require to cover our costs of seeking to pursue such payment from you).”

To whom it may concern, I passed in a letter confirming my intent to cancel my monthly membership after just ten days (within the 14 day cooling off period), this was passed to a gentleman on the front desk who gave a name as . This was not acknowledged by yourselves. I now have a company called Harlands claiming to be collecting monies on your behalf. Could you please inform them of the cancelation which was collected from your staff member ASAP. Please remove me from your members list as I requested over two weeks ago, I now deem this matter closed. Thank you.

All membership cancellations are to be processed via Xercise 4 Less, the cancellation of your Direct Debit instruction simply prevents us from collecting payments, it does not cancel your agreement. We advise that in order to cancel your membership you must contact Xercise 4 Less directly, we cannot action any cancellation on your account without receiving confirmation from them to do so. We advise you either go in branch and speak with a member of staff directly. Alternatively you may go onto the website and fill out a cancellation form, Please follow the link below: Please select 'If I no longer want to be a member of X4L how do I cancel my membership?' and fill out the cancellation form.   8. Dear Sir or Madam, I write in reference to a letter I have received from yourselves suggesting you act on behalf of Xercise4Less, and requesting £64.99 for fee’s and “administration costs”. I have cancelled my membership on site (Hunts Cross – Liverpool), via a written letter given to a member of staff on the front desk (.... was the name I was given). I decided to do so after, on my third visit to the gym there was three minors aged around 11/12 running around the facility, climbing on machines, the cage fighting ring and swinging around on punch bags etc in a very unsafe and disruptive fashion. This was stated in the letter. I cancelled my DD mandate, this was adequate notice in itself as per the case of The OFT v Ashbourne Mgt Services Ltd in 2011. But along with my written notice which I am sure you have seen, you are right to assume I no longer want to remain a member of the club. I have now realised that upon cancelling the DD mandate, that the £40 I had agreed to pay initially has not been taken. I am happy to pay this amount and no more. The administration fee you have applied is actually an unlawful penalty and I will not pay this. So my offer is to pay you £40 sum total, this offer will expire in 14 days. If you fail to accept my offer within this time period, or demand any admin, cancelation or other fee’s (also unlawful penalties) my offer will be withdrawn and I will ignore and further demands from you, CRS, Zinc or Spratt Endicott...as well as any other company to have previously been affiliated with yourselves. After 14 days any correspondence from you, any of the above, or anyone working on your behalf will be reported as harrasment to Trading Standards and The CMA.
  9. Hello All, I am new to posting, but have read many of the topics on here via google searches...some excellent work I am currently enjoying a comical exchange with Harlands / xercise4less. I signed up for the rolling monthly membership, this was done online . After a mere ten days it was clear this facility wasnt for me... I have been a member of many gyms but this one had 12 year old kids hurtling the barriers to run around the gym climbing on equipment and disrupting people without a single member of staff flinching. That was me done. I handed in a letter after 10 days stating that during the initial cooling off period I had realised the gym was not for me and I wanted to cancel. I stated my reasons, this was taken off me at reception by a staff member who gave his name as ..... I noticed the direct debit had come out one afternoon a fortnight or so later, no problem. £20 membership and £20 joining fee, I then cancelled this via my banking app on the Friday. From here I was introduced to the riddlers at Harlands. they have said I owe £65 due to a £25 admin fee plus the earlier fee's. The initial £40 was not accepted and returned to my account on the Monday morning. They have also told me they cannot cancel my membership it needs to be done in branch. I have done. They know nothing about this they say. Not my problem I say . Cancel online they now say. No need to I say, writting is perfectly acceptable. I am now engaging them via email, and quite sadly enjoying the whole process of annoying them. I will post the emails below. Any advice welcomed.
