  1. It was a secured loan. When we moved there wasn’t enough equity to pay it off so they allowed it to be secured on the new house. We couldn’t have moved otherwise.
  2. It was taken out roughly 2004 and secured on our house. We moved in 2007 and the security transferred to that house. That house was repossessed in 2014. Last payment was roughly June 2014. They send yearly statements but that’s all we’ve ever heard.
  3. Just a quick update. One of the creditors we wrote to (Picture) have thanked us for updating our address with them but as we didn’t sign the letter they won’t change it on their system and have included a document for both of us to sign to confirm our current address. How do I proceed. Thank you
  4. I’ve posted letters to each creditor. I kindly asked my daughter to take them to the post office, send them 2nd class and get proof of postage. She forgot about the proof of postage only getting me a receipt stating cost of 2nd class postage. Hope it won’t be a problem. Also Moorcroft are texting my husband on a weekly basis. They’ve not tried ringing. If they do ring should he tell them he’s written to NatWest or she just tell them nothing. Many Thanks
  5. Hopefully one last question. I’ve found the original paperwork from NatWest that Moorcroft are writing to my husband about. This was a joint loan but they are only writing to my husband so I guess they’ll write to me shortly. Should I actually write to NatWest with our new address doing a separate letter for each of us or in the case of my husband should he write to Moorcroft and I write to NatWest?

  7. Hi. I’m back. I’ve managed to find information to write to our creditors. In the letters do I advise of my husband’s situation of poor health and we survive on benefits or do I just write to them and confirm that they have the correct address. Many Thanks
  8. OK so I’ve mucked up by burying my head in the sand to long and not following the advice given. I might have some Pay Plan paperwork so that will list all the creditors at the time. I’ll write to each one of them but for those that I’ve never heard from since stopping payments am I not causing more problems for myself. I thought I’d read that after 6 years of no contact or payments then the debt becomes SB and if I write to them the 6 years starts again. Also even if they did have my correct address would they still not have been able to get a CCJ. Thank you for your help
  9. Sorry for the very long delay in updating. i filled out the paperwork for the attachment of earnings. I called the court to confirm they’d received it which they had. They advised the case is closed as my husband doesn’t work so can’t attach to anything.
  10. We have no documentation for any of the debts and I know one of them just came off my credit report as the default was 6 years old so I’ve no idea who had took the debt on. I know Cabot is one of them for me and Moorcroft and Cabot for my husband. Hopefully they’ll write again soon so I can confirm we live here. Also I take it we can’t dispute one of his CCJ’s as being at the wrong address as we didn’t tell them our correct address even though on his credit report on 1 section they have the correct address but under Public Information it’s our old address.
  11. So even though they are writing to us at our current address do I still write confirming where we live or should I now just acknowledge the letters.
  12. that CCJ will be coming up 4 years. I sent back to the courts the attachment of earnings but when I rang they said it was closed as my husband didn’t work so they couldn’t attach to anything. I’ve not heard from Reston’s since.
  13. Yes you’re right. We couldn’t be bothered. Our lives ended when he got sick and I became his carer. We have a back up plan which will work well for us. I’ve just been checking our credit reports and for me I can only see 2 defaults, 1 for the mortgage and 1 for a credit card for £557 although on my husbands he has got a CCJ registered at our old address even though they wrote to us where we live now.

  15. I was hoping to try and ride out the next 6 months then they would be SB. My husband and I aren’t bothered by any court claims. It will just make us put our plans in motion sooner. Thank you for your assistance.

  17. They already know where we live as we are receiving the letters to our current address. I have just never responded to any of them. They have offered reduced amounts to settle but we just don’t have any money.
  18. In 2013 my husband became ill and lost his job. In July 2014 we stopped paying all our non essential debts. We allowed our home to be repossessed. We also had a secured loan and a charging order. We stopped paying those too. Over the years we’ve had letters regarding the debts but I’ve just ignored them. I’ve signed up to see our credit report and can see the defaults recorded on a few of the debts but some don’t appear. The 6 years is almost up (roughly 6 months before they become barred) letters are now coming quite often now. I think it’s because it’s not long before they become barred. Am I OK to keep ignoring? My husband doesn’t work and is on ESA and PIP and I’m his carer. We have very little money and 3 children at home although 1 almost 21 at Uni and also a 17 and 15 yr old both in education. We rent our home and have a mobility car. Im also just wondering though with the charging order as it was secured but obviously not now as nothing to secure on does the 6 year limit still apply as I had read about it being 12 years. Its Moorcroft that’s just started writing to us regarding the charging order and Cabot for the other debts. Many thanks for any advise.
  19. No he just said they’d post it out to me. Didn’t offer any alternatives. Restons have responded and said as a CCJ has been registered then they are under no obligation to provide a copy of the CCA. Is this correct?
  20. Thank you for the advice. I requested everything to do with the CCJ which they are sending out. When I receive the info I’ll come back.
  21. The CCJ was awarded in 2016. The debt is for just over £13,000. I’ve returned the AoE but as the lady said my husband is unemployed due to poor health, my house is rented and the car is on mobility so there is nothing further the court can do. I’m awaiting a response about obtaining the CCA.
  22. With Payplan we’d been paying but apparently while someone was doing a review on our account they done some error with it so the money I’d been paying was never sent to my creditors. They apologised but due to being a bad time in our lives I closed my account with them. We moved house a few months later I’ll ring Northants bulk and ask for a copy of the CCJ although I’m not sure how this will help us
