  1. Wife has a 57 plate cmax 2.0 auto on LPG without the gas I would cry daily, does around 20MPG ! Terrible gearbox but keeps her happy
  2. MCOL keeps telling me online that the defendant has to be in England, the Scottish small claims court only deal's with amounts upto £750 as my claim is for £1187.04 they won't cover it, I have emailed the sheriff office in his district to ask them some advice
  3. mediation was a compny in Leicester, I explained everything to them fully before handing over any money, they knew where I was and where he was, I can only assume that as I have at least attempted mediation it shouldn't matter if they were scotish or english (after all it's a thirdy party talking to us both) will be looking at the MCOL website (the form's to download fill in) shortly, failing that will have to try and apply in Scottish court

  5. started with MCOL this morning, got to defendant section and it stated the defendant address must be in england or wales, do you know the link to the scottish version of MCOL please ?
  6. your outside your 30 day right to refund but you do have rights still upto 6 month's, the tyres shouldn't get that bad within 1000 miles however could have been just legal at point of MOT or even was MOT'ed with a different set of wheels (not unkown in car sales)
  7. a rubber suspension bush on a used car i think would be classed as a serviceable item, if the car was brand new I would speak with the manufacturer of the car ignoring any third party warranty, once the car is fixed I imagine you could maybe request a refund of the RAC package I personally can't advise with that sorry

Seller Refused Mediation Issue I purchased a used quad bike from ** A MAN WORKING FOR HIMSELF ESTABLISHED AS A COMPNY ** 7h May I paid the deposit of £2050 (£2000 off quad and £50 fees) on my credit card to **THE MANS COMPANY **, I attended **THE COMPANY ADDRESS WHICH IS ALSO HIS HOME ADDRESS** 11th may with remainder of cost in cash £2000 I was not given a receipt at the time of purchase I was issued a receipt later on after several requests The Quad bike became faulty 2nd June when I contacted the seller, he told me the sale was between myself and the last registered owner of the quad bike as shown on the V5 and was not a sale by him or his company. I have never seen or spoken to anyone else about this transaction, other than ** THE MAN WORKING FOR HIMSELF ESTABLISHED AS A COMPANY ** he is the man / company I gave all my money to and it was his business / home where I collected the quad from, there was only 3 people visible in his yard (myself, THE MAN and a friend of mine who had traveled with me to collect the quad) **THE MAN WORKING FOR HIMSELF ESTABLISHED AS A COMPANY** was inspecting the quad as I arrived to collect it,the inspection was being carried out in the workshop he has established as his business within his personal dwelling At the point of collection I was told he found a few small issues (parts that needed replacing) to which his company provided me with replacement parts (I don't recall paperwork but certainly the packaging tape from him established business was used The quad bike was sold to me as a used machine, the quad was 2.5 year old with 5k ish on the clocks, I was informed the quad had a manufactured rebuilt engine recently, I was told the quad was in good condition Repairs carried out so far Repairs carried out so far Part’s supplied by seller Replacement hand/foot brake cable Stater motor Voltage regulator Part’s purchased by myself 3 Set’s Of brake pads (needed on the day of collection but wasn’t mentioned I paid for these parts) Part’s I have replaced but will accept as fair use and wear on second hand quad Water pump gasket CVT Belt after 2nd June the quad was sent to a dealer for repairs, Various repairs have currently been carried out costing a total of £1355.96, I have secured £718.92 for repairs via section 75 via credit card company leaving a shortfall **THE MAN WORKING FOR HIMSELF ESTABLISHED AS A COMPANY** after the issues had been brought to his attention gave my personal mobile number to the previous registered keeper who he states was the seller of the quad, although all payment's were made to THE COMPANY Total Looking To recover £30.00 Mediation Fee's £100.00 Labour To fit faulty parts supplied by seller £637.04 Shortfall difference on repair bill £45.00 Brake pads £45.00 Labour for Brake pads £90.00 0181-314000 Gear Motor £40.00 Labour To Fit Gear Motor £200.00 Gesture Of Goodwill (misuse of my personal data) Total £ 1187.04 **THE MAN WORKING FOR HIMSELF ESTABLISHED AS A COMPANY** stated to MEDIATION COMPANY that the sale was between myself and the last registered keeper, THE MAN offered details of a third party PREVIOUS REGISTERED KEEPER and suggested talking to a finance company aswell ? I am trying to establish if the sale was legally between myself and **THE MAN WORKING FOR HIMSELF ESTABLISHED AS A COMPANY** I need to know which court's I apply to England (where I live) or Scotland (where seller live's) I need to know would the judge allow the cost's of mediation I need to know would the judge allow the gesture of goodwill for misuse of my personal details I need to know would the fact I have received a section 75 claim for part of the repair effect the outcome ? I am not applying for the money the S75 covered just the shortfall which cam after THE COMPANY refused to communicate with me, prior to requesting mediation I was given details for THE COMPANY solicitor, they have ignored all letter's sent to them via recorded post, is this acceptable ? Sorry for the longer post, I hope that everything can be seen clearly, I just need to find which court I should apply to I have done everything I can to try and resolve the matter
  11. a little update, first reply from the repairer, they say your quad came in for major oil leak to be fixed, we have done this so we don't owe you anything My reply was, you ignored all my points my complaint shows, you failed to take reasonable care of my quad, and you have already accepted the current issue is your responsibility due to offering to repair it I requested they give me there ADR details let's see if they even know if they know what an ADR service is

I had a 2 day a week job which early in January this year I quit with no notice to employer, i had no contract at all with my employer and no written term's of my job / notice / wage (which I now believe is a legal requirement) since quitting my job I have received 1 envelope from my employer with my last pay slips, I have had no response to my letter to quit and had no P45 sent to me, I have requested my P45 via e-mail again no response, the DWP have asked for my P45 for review of my wife's claim for ESA and PIP is there anything I can do to get a P45 direct from HMRC instead of relying on my ex employer

After a few call's to CAB consumer help line and reading the CRA215 I have now requested the repairer to give me a refund, I believe that the repairing garage has 1 right to repeat performance which he gave instruction to a local third party , the quad was not repaired on the first right to repeat performance (in all honesty it put the repairer in terrible light) I have requested the repairing garage to refund my payment's for 2 separate invoice's and to reimburse me for the third party cost's that the original repairer instructed me to use The repairing garage's solution was to allow another third party to collect the quad bike for them to repair (the second repairing garage being a pal of the original repairer) if the second third party was unable to repair the quad them my quad would have been sent down to the original repairer (over 300 miles away from my home)
  14. on going issues for nearly a year now with a quad bike I have purchased, my current issues is on a repair, I sent my quad bike to a garage over 300 miles away for a major repair (the engine needed removing, splitting in 2 for gasket replacement) got the quad bike and the next day I found another oil leak I spoke to the repairing garage who suggested I put my quad into a local garage for this minor repair to be carried out and the original repairer would pay the bill The second garage close to home have suggested the engine has never been split and the original oil leak is still there so within 24 hours of getting the quad home the issue was present, I have suggested the garage who did the major work are responsible to repair the quad and should collect it, they have now nominated another garage of his choice aprox 1 hour drive away (a garage I might add I find arrogant, and has bad reviews online) what's my rights as it stands ? I feel the original garage should still collect the quad, inspect and repair then return back to me which he should do in the first place the second twist to this story, is the second garage who wrote the report have charged me £85 for there inspection / report should the original garage pay this bill as I only submitted the quad there upon there request
  15. on other day's I'd be suprised if the traffic warden's come out, on match night there like all over the place, had to enter a match permit zone a few week's ago to collect an item in the middle of match time, ticket's were everywhere
  16. could it be you have a faulty speedo unit ? if it's an older car with different wheels fitted this could cause the speedo reading to be inaccurate, you can check this with a satnav or even an app on your smart phone
  17. take photo's of the drive way in the day light, also try get a log to show what time you delivered the parcel in order to prove what the light condition's would be, when taking photos of drive way point towards the air to show lack ok street light's, if possible take photo's of the oil tank if it's still there
  18. if this should happen to anyone best thing to do is park up and let the person past, speeding to avoid someone is not an excuse in law
  19. recently had a car repaired by a GOLD star approved body specialist "Lookers Speke" first time we went to collect was 4 day's later than originally agreed, this caused us to have to driver 80 miles round trip First collection refused not ready bumper insert was still damaged, paint had run's in it Second collection early afternoon (again had to arrange child care drive 80 miles trip) originally refused car seat's and door cards were covered in dust, bird poop all over paint work took car away with a replacement number plate with lookers written all over it that was screwed to bumper (Old plate was undamaged and had no screws in it) not happy and insurance company ignored all complaints
  20. knowing these cars well can I suggest it wasn't your window motor that has failed, it was more than likely to be the window mech that failed which is operated by cables (it kind of looks like a bow and arrow) A design fault in my opinion allows water inside the door and rust's the cable I know these can be expensive £500+ for a new mech, I have used a rebuild service in the past for these (under £100) warranty's genrelly are not worth the paper they are written on
  21. not 100% sure an insurance company is held with DSR as it's a service not a good, you will be getting a full refund minus the broker's fees and any extra's you agreed to purchase at the time, all of the above would have been clearly stated to the policy holder at the point of payment
  22. chilli, your brother in law should of send the left hand side of the logbook of to the DVLA with your details to show change of ownership UNLESS he's done it ONLINE, you get the green slip V5c to retain and if within 6 week's you do not have a new V5 in your name you use the V5c to apply for a new logbook, I think you purchased the car in july and paid tax / setup direct debit, the DVLA were waiting for conformation the sale has been completed (bearing in mind people return car's if they don't like them ect) so you paid for tax in july, and then in august DVLA were not aware you purchased the car as the logbook clearly has not been set (UNLESS your brother in law done the transfer of ownership ONLINE) DVLA took payment august as they should but when september came didn't notice new ownership and assumed car sale didn't go through (this I'm guessing at by the way) therefore without transfer of ownership they have no right to take tax money and stopped if you do a search online you will find a DVLA website you can notify dvla of change of ownership online with a few details from the V5 logbook to clarify another post on this thread, a SORN declaration requires a V5 referance number OR a V11 tax reminder I feel OP you may now be at a loss due to paperwork not being sent of correctly in 1 post you state paperwork has been sent off and in another you stated brother in law still has other section therefore no change of ownership with DVLA
