  9. She signed the contract on Friday and took possesion of the house that day (although the physical move ofd furniture etc was to be on Friday this week) The landlord contacted her on Saturday evening at home. If she fails to complete on her present home on Friday she stands to face compensation to her purchases for breach.
  10. Friend of mine has sold her house and because she hasnt found a place to buy yet decided to rent for a while. She finds suitable property and pays deposit and months rent in advance. Landlord and her sign assured shorthold tenancy agreement and everything is hunky dory. Arrangements are then made to move in to rented property. Before the move can happen lanlord telephones and says there is a problem with the gas boiler which he says needs replacing and arranges to meet my friend at the property, she goes to see him and the landlord says he cannot allow her to move in because the boiler needs to be replaced and it could be "a few Weeks" to get organised so offers her a full refund of rent and deposit and takes keys back. Problem now is that her house sale completes on Friday and arrangements for removals etc have already been made, BT have been organised and mail redirection undertaken to the new address. Is the landlord allowed to merely tear up the contract he signed and agreed to or is there any way she can take action against him for breach of contract , she is going to have out of pocket expences associated with this as well as potentially losing her house sale if she cant find any where else within the next four days.
  11. Here is the link to the relevant part of the FSA site FSA Register__ The firms concerned have obviously got to be registered with the FSA though if they arent then try searching the people who look after Consumer Credit Licences which I think is the Office of Fair Trading. Best of Luck Jon
  12. Which companies searched your file? We looked at the FSA website and got the details of the person responsible for compliance and e mailed him copying in the FSA it worked wonders. Let us know how you get on Jon
  13. Well as Sb suggested she wrote to CRAs then to Black Horse. Experian said that they had contacted the Black Horse who then said the searches stood so nothing they could do:mad: . Black Horse then replied that the searches where correct but as a gesture of goodwill they would remove two:roll: She then contacted one of the chiefs at Black Horse by e mail and copied in the FSA and within 24 hours the other search was removed no reply to e mail no letter no nothing just removed the search. So all in all a result:grin: She still didnt get a loan though (Thank you God and all at Experian) Jon

  17. Great stuff thanks SB, I will draft letters this weekend and post here Jon
  18. Heres one for the DPA experts. SWIMBO made an application for a loan to A & L just after New Year, she was declined........... (no surprise ther then). Out of the blue she gets a phone call from Freedom Finance we can help etc etc.......... I dont want a secured loan she says........ ok they say sorry to have bothered you. Couple of days later another phone call from Black Horse this bloke says "you have passed all our criteria and if you come down Friday to our office bring payslips bank statements etc we will do the application. So SWMBO goes down to Black Horse's office and was told at the outset sorry you dont meet criteria not a home owner etc cant help. She the logged on to Credit Expert to check her file that evening and was amazed to find that Black Horse had carried out no less than three seperate searches on her now the point is that she never actually made any application to Black Horse for any form of credit so are they allowed to do searches willy nilly? I suspect not and if I am right what can she do about it where can she complain? Thanks all Jon
