I have had dealings with MBNA Aplins Hillesde DLC, The bad news (or maybe good news, if we can do something about them), is Hillesden DLC has been taken over by CABOT , and we all know what they are like. I am trying to deal with my problem, by complaining about Hillesden DLC to CSA (Credit Services Association). Does anyone have any knowledge of them? Looking at a definition of fraud with WWWactionfraud. I believe DLC/ Hillesden Securities are guilty of it. I* would like to share the story with you. It goes back to 2008 when I was already in a DMP with all my creditors, I had been keeping up with all payments to the DMP. Then I had a letter from Dlc /Hillesden for MBNA (who was already in the DMP)* they threatened me by saying they wanted to take me to Court for an interim Charging Order. I was naive. They went to Court in Northampton. They told me that if they obtained a Charging Order, I would still be able to pay them what I could afford. The Court had all my income and expenses and the details of the DMP, yet they still set a CCJ payment to DLC of over £400 a month, which they (them and The Court) knew I could not afford to pay. So Then, I was in default, and then had to go to the Lewes Court for them to obtain a Charging Order which they did because I was in default. I was approached by my then DMP Company, Harrington Brooks (previously Fresh Start), I did not think I would meet the requirements of an IVA. However they did a stepped IVA to increase when my HP was cleared. That was fine and I had an IVA 3years ago. Problem was, they could not put DLC in it because of the Charging Order, which was now secured. This now means that when my IVA is finished I will still owe DLC £19,000. This affects any future equity in my flat, after my IVA is finished. What I do not understand is how DLC were given priority over all of the other creditors in my DMP? Maybe they did not pass on all the paperwork to the Court, (paperwork has to be sent to them, not the Court) that would have told them that I could only afford £5.77 a month, which they were receiving under the DMP.
