  1. It's been many moons since I was on, or had notification about, this thread and so it's gonna take some time to assimilate the info I've missed. However I would not wish to miss the opportunity to wish fireprism fair winds and offer any help I can - though I can't imagine what that might be. If support is needed come the great day, then I'd do my damnedest to get there.
  2. Hi Caro, Thanks for the indulgence. Which court did he go down in? I should have thought that some of the arguments that can be presented couldn't be dealt with at county.
  3. c'mon Caro, I well remember when CAG was dynamic with a capital D and I do realise that things do 'go on' behind the scenes that it would be unwise to advertize but I understood that there are numerous cases being pursued both in UK and Europe and we haven't even been appraised of any of the poc; this is a tad restrictive is it not? At least if we knew what grounds were being explored then others among us could try to exercise even more points of law. Personally I'm a 'wrinkley'; would be prepared to start a 'hare' running and if I lost well - I've no property assets 'they' could go after: in other words 'wot the hell'. I just don't want to appear in court looking a right whalley if the grounds I deploy have already been found wanting.
  4. I can't believe that everyone is wealthy enough to b****r off for the festivities - but no posts for 3 weeks!!!! Any chance of a 'where we are now' assessment from someone ( and no references to paddles/canoes/ creeks etc); given the significant number of legal actions ongoing, it would be really good to track them. I would wish one and all the very best but given the absolute lack of ability shown by the ruling classes (and I don't believe we've missed the opportunity to see the population take to the streets) such a greeting might be construed as facetious in the extreme.

  6. Since this has been clearly known now for some while, is it not possible to challenge these lies and perfidy in a court case; just to keep us jogging along whilst GLC do their thing. If so then some guidance on poc etc would be most welcome - come on Banky et al; givus some pointers.

  8. Thanks Erica - never thought of an SAR for this purpose; are you sure that they ARE obliged to detail their methods - after all they already refused to for an MP. The banks of course won't disclose their method of calculating your charges.

  10. Some years ago I applied, on line, for (the then) Working Family Tax Credits and an award was made. A year or 2 later I was advised that the grant was too big and I would have to repay a vast sum. However, in keeping with many many other folk, officialdom would NOT provide details of how my grant had been assessed. I 'dug in' and wrote to my MP who took it up and 'officialdom' backed off at about 1000mph and decided to reduce all future claims to effect repayment - they are doing this even now. I hear on yesterday's news that the SCOJ has decided that, where a legitimate claim was made in good faith, then if overpayment occurs, officialdom can't claim it back. As yet I haven't located 'chapter & verse' on the subject (and have emailed BBCs Money Box to try to identify the item) but haven't yet been on the SCOJ website if there is one. Since this could affect many thousands of people (cos I know that very many errors were made by various gov.depts) does anybody have any input on this?
  11. And in a former life I had positions in Budgetary control and international relations in Defence and dealing with NATO most certainly did not inspire ANY degree of confidence!

Very many thanks oily (You're a braver person than I, submersing yourself in Lisbon Treaty detail!) that alone gives some flexibility however I'm pretty sure that the item to which I alluded was a decision handed down in the past 5 years and, at the time comments were made, there was no obvious exclusion of UK citizens. Indeed it seemed as though the UK was badly out of step (as the French tend to be on so many aspects of various aspects of 'eurolaw') and the ECJ was more than a little miffed. I'll just have to find time for a bit of digging. Ken

If I required biblical quotes I would look for some nebulous US Southern State Baptist site, however please can we stay on subject; I realise there's not a lot happening on the surface but it appears that some parties (GLC to name one) are paddling like the clappers below and it strikes me we could all do with a bit of ECJ familiarisation particularly since the UK seems to be one of the few NOT 'in harmony'. I seem to recall from past posts that euro legislation actually favouring our endeavours was passed some while ago - anyone?
  14. However I do seem to recall that there are some things stirring in Europe that might have a bearing. And, anyway, I thought current UK bank practices had already been shown to be at variance with some Euro laws and regs.
  15. Some of the foregoing is encouraging but where, exactly, are we on the ECJ cases and those in UK courts being fought by GLC et al; the legal 'debates' etc. I ask this in light of Ken Clarke's utterances in the House yesterday vis-a-vis legal aid's future or lack of.

  18. I seem to recall from some way back in the bank charges saga that, if the opposition actually file a defence then that case may not be revisited; but there again me little grey cell ain't wot it were
  19. I have to discontinue my son's claim owing to his ill health; can we disengage without costs if in small claims? I've asked 'their' solicitors but haven't had a response.

  22. OK people NOW it's getting urgent. They've filed a defence (it's in the post to me) so I NEED to amend my poc. ASSISTANCE please!!!!!!!!!!!! Also I note this evening that FSA is going to contest the banks action defending their ppi activities; should I request a stay until this action is over? PLEASE ASSIST
