  2. Hiya last year my husband took out additional borrowing on his loan he had with welcome finance. he originally did not have PPI insurance with his original loan. When he got home, (the whole loan process actually took 10 minutes as they were rushing as it was a friday and they wanted to go home) I checked through the agreement olny to discover that it was a brand new loan and not an extra amount on top of the old one. My husband did not realise this either at the time as the whole loan was rushed. He then realised that as well as signing for the loan he had also been signed up for PPI and something called medicare. I phoned them to say that we did not want these included and was not aware why we had been signed up for them as it was meant to be additional borrowing and we assumed it would be on the same basis as before. They then told me that we could not cancel as it was to late, even thou i explained that it was not wanted and my husband did not even realise he had signed for it as it was not explained during the application. the lady on the phone then said. He was fully aware has had loans before so he knows what he signed for. I then cot into a debate that he didnt have it before so he didnt etc. I have then sent various faxes/letters to the branch over the past 6 months trying to get it cancelled but they still havent done it. each time i state that it was never wanted and we didnt know it had been signed for etc. and what so i get nothing, no response for months until saturday - it just staed that he had been passed to the local branch which is bristol (i took the loan out in swindon) and they would contact me shortly. I dont believe they will but i firstly need to know if my reasons for wanting a refund are good enough and if anyone else agrees that this was missold seeing we didnt even know we had it!!! I have sent my SAR yesterday for the charges details etc and asked for a copy of the original agreement. enclosed my cheques.   3. hiya, i got a letter through today stating that they will not pay. it was dated 1st march. i presume this is just a late reply to my LBA as it was not signed Mr Bacon, and it had no ref to court claim. My notice of issue also states they will defend. it is standered.
  4. Nationwide Acknowledged on the 28th. same day it was deemed as served. not sure if this is commen as this is my first claim with nationwide. only dealt with halifax/hsbc/f/direct/natwest previosly. hopefully wont be to long. my mum could do with the money lol

  6. Hiya, I would send them another LBA. they have started to pay out straight away recently so i would give them another 14 days, and enclose you scheldule again. I wrote to them for 2 accounts a couple of weeks ago and they wrote back saying that they will consider regunding these, just waiting for an offer now. Good luck

  8. hiya, Just thought id join in. i too am at the same stage. My claim was issued 26th, Deemed to be served 28th and they have till 14th to be acknowledged. I am claiming on behalf of me mum for just over £3000. it will be interesting to see who gets their money first.

  11. I dont want to get into a debate about the right and wrong ways of claiming as i believe that the CAG way works, but so do other methods from other websites. I understand that the CAG is a valuable tool for lots of people. i have claimed and won 5 times already doing it this way. I disagree that i am being Lazy, I am following the correct proceedure and I will win. no one has lost yet and i will make sure the 1st person is not gonna be me. I dont think that estimating charges is a big deal as i have already followed the scheldule in the post yeaterday. Thankyou for all your help
  12. hiya, im going through my second claim also, dont worry about the account closure just open another account just in case. they havent closed anyone i know whoo have claimed more than once. i just sent my lba last friday good luck
  13. i would wait for the other claim to be settled first. I am on my second claim with halifax and they keep insisting that they wont pay as it forms part of my first claim (the charges happened after my first claim) so to avoid confusion with them it may be easyier
  14. i have estimated an amount previously and they have still paid up so im not worried about not putting the figures on the prelime. I also want it to go to court as the interest on all of my claims im doing are quite high as the majority of them are claims for over 3k and the mahority of the charges date back over 3 years so its nearly an extra 1k in interest. As for not enclosing a scheledule in the first letter, the banks have all the charges listed on their computer systems, they have to send me them so they do have all the details already. i will of course send these with the LBA.
  15. I have claimed most of my charges back so i am now sharing my knowledge for free and helping my family and friends, who really are to lazy to help themselves. I sent SAR to nationwide in december and the statements came exactly 40 days later Prelim was sent 16 days ago, reply rec'd on day 12 basically saying they disagreed and would not pay back as they are fair etc, their scare tatics do work as my mum phoned me distraught (bless her) so i sent the LBA yesterday..... aqnd a seperate complaint as in the first lletter we enclosed a letter of authority stating that all corry should be sent to me as my mums sole representative in this matter and they oignored hetr request lol so court is set for Feb 23rd i will try to keep this updated as this is claim number 5 (i have 8 on the go at the moment and have been paid out from 4 already) and i know it can be helpful and reasurig to see how similar claims are progressing and the banks reactions etc Good luck to all
  16. Have also started another claim for another friend, SAR got sent with cheque on 09/2/06 so all in all i am doing 8 claims at the moment, all at different stages though. it hasnt got confusing yet though lol,

Ok, so my claims for Natwest are for 4 people now. 2 i have rec'd a reply for their SAR, they have said they acknowledge reciept etc, but havent cashed the cheques yet. the other 2 have just been sent (SAR) so should here back in about a month he he. I have sent off estimated prelims for the two that they have acknowledge SAR for as they only have about 2 weeks left to send statements so should have them in time with finalised figures for when i send the LBA
  18. So i have rec'd a standered response saying we will look into your claim etc etc, standered t/a and financial ombudsman letter. I have written back with my LBA so court action is set for the 23rd feb' ***** watch out HSBC*******
  19. ok , so i became lazy and left this one for a bit. I did get a reply in december saying that as i 'Apperently agreed to accept a payment in full and final etc (did not do this they just paid me) i was unable to claim. it was christmas time and i was skint so i left it. so i have now started again, prelim went off, and i have just sent LBA on thursday so hopefully they will pay up - just applied for new account with natwest aswell, just in case lol
  20. to Mr2Phil Are you being sarcastic??? Cause it does not come accross that way. Being someone who has incurred charges yourself must be well aware that sometimes no matter what you do circumstances arise beond your control that mean you incurr charges, because of the banks ecess charges the situations get worse.....meaning more charges..........less money......and hardship. the charges are unlawful which is why we claim them back. this website was made to support people and offer help and advice.. no one here is perfect which is why sometimes people here have to claim more than once. I dont see how your comment has helped or supported anyone .......
  21. Hiya, Congrats, i think you were doing your claim in august the same time i was doing mine and we got paid on the same day!! Im doing my second claim now. only just over 200 quid . prelim has been sent and got a letter saying this compleint had been dealt with etc and that as far as they were concerned the matter is closed etc. So im gonna email them my LBA today. could do with the money really badley aswell. I just hope they dont close my account as i cant open another at the moment. my credit is crap.

  23. Go to tax credit overpayment this website is really helping me at the moment. i recieved summons 2 weeks ago and am in the process of getting the court action stopped. We are all victims of a crap system, you should not have to pay and this website will help you fight all the way Good luck
