  1. Can anyone help on this matter? Does the takeover company not have any obligations for underpayment by previous company? In that case, one company could underpay employees as they know they are being taken over and once the takeover is complete, it won't matter as the taken over company is no more and everything is now under a new company name with no liability to the underpayments??   2. Yes I was under the impression that the company should have paye records for at least 7 years. Even if they have taken over a company I believe they take over the contractual obligations of paye etc of the previous company? Can anyone advise on this? Many thanks, Mike
  3. Hi everyone! Ok, so this is my first post on an issue.. I checked my wage recently on how I get paid shift allowance. Basically I get a set 17.5% on my contracted hours. If I do overtime it doesn't change this set shift allowance figure. I noticed though that they were only giving me around 16% and this has been the case going back years (I have worked for my company for 15 years - all with shift allowance) Now my company was taken over by another company in 2010 and they have agreed to back date the underpaid shift allowance back to then. They say they don't have any payslips pre 2010. I found an old payslip from 2005 and it had the same discrepancy. So, what I'd like to know, if anyone can help. Is does my new employer have any liability to my paye from before they took over? Should they be liable for the underpayment going back years before they took over? Any help on this would be very much appreciated. Thanks, Mike
