That was a long journey, mh? I'm soooo glad for you that this has an end now! Our payment with the arrears took a couple of weeks, but everything runs normally again. I hope you can relax and soon forget about all that chaos!

Just a quick update: My Partner had his medical assessment 11 weeks ago, we didn't have any letter since so we called the ESA yesterday and asked for a callback. The lady informed us that the doctor gave him 6 points, but the decision maker checked the medical evidence, letters etc we send in and gave him 15 points. He will be in the work related group I think it's really important to call them some weeks after the assessment if you don't receive any letters. So our total waiting time was 47 weeks and I really hope other claims will be process quicker! Maybe it takes 1-2weeks to sort the claim out, but we're so relieved!

Hi lottiesnan, my partner had the same problem before. We called the ESA and a lady said they never received the sicknote, but we should get a new sicknote and she'll make an appointment at our local Jobcenter the next day. We got paid only 3hours after we hand in the sicknote at the jobcenter Maybe this would be an option for you?
-
Do you mean to get an earlier appointment? Within the waiting time it's impossible because you have no chance to speak to the right person, as soon as you receive an appointment letter, you're able to call a number to rearrange it. Maybe it's possible to get an earlier one, but we didn't try it because the appointment was after two weeks.

A couple of pages before I wrote that my partner claimed ESA in October 2013. We finally received a letter for a face-to-face appointment End of June. He had his on Friday and everything went fine. The doctor said we'll receive a letter in the next 6 weeks about the claim. So we waited 36 weeks for the appointment + an extra 6 weeks for the process.

What are YOUR opinions on 'shopping' someone?
Lebleuet replied to essexmat's topic in Benefits and HMRC
I used to live in a country in the last 10 years where it was a kind of civil courage to report benefit fraud. How can you ignore it if somebody uses your money/taxes, when they are not entitled? -

I appreciate the objective answers. I don't want an argument here and wait until DWP contact him. -
PIP - terminal illness isn't existing anymore since 2012
Lebleuet replied to Lebleuet's topic in Benefits and HMRC
Thank you nystamite and essexmat for your answers. To be honest I didn't know the fact about the car, the person told me that the car and some miles are for free. It was a bit misleading that I compared PIP with "able to work" - sorry for that - because I know both is possible. I'm annoyed about about this man, because he's bragging all the time how easy it is to fool the system and if they catch him he'll declare himself bankrupt, leave the country etc. In my opinion it's just not right. -
Can I stay at my girlfriends place while on JSA?
Lebleuet replied to Alfie29's topic in Benefits and HMRC
Hi! Yes you can live with her, but you won't receive any JSA because of her income. If your partner is over 25 she would be able to claim working tax credits. As far as I know you can only get tax credits if you're working or have a child.- 6 replies

Hi there, I'm wondering what your thoughts are and if I can/should do something. The father of a friend had a serious heart problem and his condition was really bad in January '12. The doctor said he won't survive so he claimed PIP because of terminal illness. Luckily his condition changed and he was much better end of '12, where they bought a fancy new car. At least I thought they bought it. I had some discussions with him about benefits the last few months, where he told me that he's still claiming PIP on the highest rates and he received the car for free. He was able to choose one and he has some free miles with paid petrol. His last medical checks were great and in my opinion he would be able to work. (he should do some exercises for his heart, but he prefers to stay at home and watch tv allday) I asked him if the PIP department or DWP ask about his condition and he laughed and said "they think I'm still dying so they won't ask questions" I feel really sick when I think about it, because they having a great life with full wages from his wife (full-time worker) + free car + full PIP and going on holidays all the time while my partner has a medical condition and is waiting for his PIP (and ESA) since last year October. Nevertheless there thousand other people who need even more help and support and don't receive it. Is it possible to do anything or just wait until DWP contact him again? Thank you very much!

My partner and I receiving the couple rate for ESA and as far as I know we'll get the extra amount on top if he's in the work related or support group (this could take a while).

Hi there! I'm not so sure if there's any difference with your daughter, but I was receiving JSA and then moved in with my partner (ESA). We called the ESA and received a change of circumstances form some days after, filled this out and then got paid the couple rate (both under 25, so its around 113 pound/week). I only had to bring back my sign-on-booklet to my jobcenter.

Disciplinary while off sick
Lebleuet replied to Lebleuet's topic in Employment and minimum wage problems
No worries, I absolutely understand this. I was wondering as well why they didn't dismiss me earlier. It's only a speculation but I think there was something wrong with the phone call on the 5th May and that the managers brother never told my manager that I cannot attend the meeting, but would like discuss it over the phone -> I never had a phone call from the manager and now they want the disciplinary meeting because I didn't attend the meeting? I will try to contact my employer again and hope that I can reach the manager directly.- 8 replies

Disciplinary while off sick
Lebleuet replied to Lebleuet's topic in Employment and minimum wage problems
@ Sidewinder thank you very much for your detailed answer! I have to agree that the length of my employment is the biggest problem and I understand my employers view. I started March '14 and was off sick since April '14. The accident wasn't in work, but I have to be honest that I always had problems with my hip (surgeries etc) and fell down the stairs on this hip again. Probably I should never start this job, but after looking for a job for 4 months I had to do something. I would like to work again, but unfortunately I don't know when I'm fit for work again.- 8 replies

It's a bit more mixed up. I'm on my partners income based ESA claim since January '14, then found a part-time job (under 100pound/week) and we received the reduced ESA because of my wages. I got sick, but didn't qualify for sick pay.. so I finally got the SSP1 form to claim ESA. So if I'll be dismissed or not, I stay on my partners ESA and be a ESA claimant as well. I think?
-
Hi there, I wrote already a post in the employment forum and it may be that I will be dismissed soon. My partner is receiving ESA, I was working but I'm currently off sick. I send my SSP1 form yesterday to get paid for my sick days.. so I'm claiming ESA as well soon as long as my sick note lasts. After that I'm still on my partners ESA claim. Is that correct? If the worst happen and I will be dismissed, will I and my partner receive sanctions? I'm worried because my employer wants/will? dismiss me for a wrong reason and I'm still in probation period. So he can dismiss me for any reason, but say it was my fault. I read about sanctions for ESA if you don't go to appointments or work related interviews, but nothing about being dismissed while working and claiming ESA. Can somebody had similar experience and give me some advice? What do you must provide the jobcenter after being dismissed? Thank you very much!

Hi there! I'm really concerned because I received a letter for a disciplinary meeting next week, reason: absence from work and no attendance for a meeting on the 11. May 2014. I've been off sick since April '14 and always called in to inform them about my sick note and sent it on the same day via post. On the 5th May the assistant manager (managers brother) called me to arrange a meeting to "come back to work". I had an accident and because of my hip pain, I'm not able to sit in a car for long (the company is around 20-25mins away). I told him, that I cannot attend a meeting at the company, but we could discuss this over the phone. The assistant manager declined my idea and wanted to speak to the manager again. I never received a call again and because my sick not is probably extending I thought it would be fine as long as the manager wouldn't contact me. After I received the letter I called the company to explain that I don't agree with "absence from work" and tried to explain the previous phone call, but the assistant manager (managers wife) said "you can discuss this with the manager next week" and "if you cannot attend, you may be dismissed" Would this be a unfair dismissal because I'm off sick and cannot attend? Besides that the reason is absolute nonsense? I'm still in probation period, does this matter? What should I do? I feel a bit lost now. Thank you very much for any advice! Edit: If it comes to the worse and I get dismissed from work, will our benefits be affected? My partner is receiving ESA, I send my SSP1 form yesterday to get paid for my sick days.. so am I claim ESA too as long as the sick note lasts?)

Yes this is what I'm telling my partner to hold on. But sometimes I fear that they decline (for whatever reason) and we have to appeal again..and wait again. We're waiting for the PIP the exact same time. You just have to be patient and hope for the best

Oh sorry, I mean October 2013. We live in North Wales, maybe it's quicker in England? We called ESA in January 2014 and they said there's a backlog for 4 months and last week a lady said "if you're lucky, you'll receive a letter within 1-2 months"
