Hi, I had a good number of credit card debts - the usual suspects: virgin, mbna, cap1 etc. They all dropped off my credit report a couple of years ago, so I now have what Halifax describe as an A1 rating I would like to remortgage. Should I be worried about a bank or building society that has one of my old credit card accounts in the business group using some sort of set-off mechanism to recover some of the monies I never paid. I'm thinking in particular about a deal I heard on the radio between Yorkshire (building society or bank - I can't remember) and Virgin. But am interested in the principes, too. Thank you.

  3. I spoke to the ICO about this. They: 1) Confirmed that a signature is not required for a SAR request, but that a bank, because it is dealing with financial records, may ask for a signature to compare with one they already have to confirm identity. 2) Canada Square were being less than helpful in the way they have handled this. (Another bank I Sar'd have written back with a letter for me to sign and an envelope). 3) Suggested I write a letter along the lines of: I have spoken with ICO who say that a signature is not required by the act, but on this occasion I will supply one. As for the postal order, if it has not left your building, please hold on to it. If I receive it I will post it back to you by return of post. The 40 days started from the date of the first letter.   4. I've had a reply to my SAR request from Canada Square Operations. In summary is says: Its annoying they return the PO separately - and without indicating a time scale - as I'll want to use the same PO again, so can't just send a new request by return. Also, if I write to insist they act on my previous request they won't as they don't have the £10. What is the best course of action on this? Thank you, Mike

  8. OK, so this is my first draft of a letter to DG solicitor. Comments and corrections welcomed: Dear Sirs, I am writing to you with reference to the CCJ above. In a letter frpm you some months ago you suggested I contact your office to see if we could arrange a full and final payment. A friend of mine has offered to pay £500 to you on my behalf in full and final settlement of the CCJ. This offer is made on the understanding that, once accepted, neither you nor any other organisation will take any further action against me to pursue this debt in any way and that I will be released from any liability. I also wish to request that, if accepted, you will mark any entry on a credit reference agency file as “satisfied” in full, that the court will be advised that the account is settled and the charge order that you have over 21 Some Road will be removed. Payment will be made direct into your account within 5 days of receiving your written agreement of my offer and method of payment. Is it good enough? Is it missing anything?   9. The background - DG Solicitors took me to court about current account bank charges. They won the case and I have been paying £50 a month ever since. They also go a charging order over the house. There is currently about £1300 left to pay. There is also an HSBC credit card debt of about £9000. HSBC defaulted on the CC and passed it out to metropolitan, but I haven't heard anything from them about this for a couple of years. Divorce means the house will be sold this year, probably. The mortgage is with HSBC. I suspect that HSBC will try to snaffle the £9k when the house is sold somehow. I have SAR'd HSBC and asked for info on the credit card and the CCJ. Still waiting on what they will send me. I also asked for all the DG solicitors files. Now - I'd like to offer some money to DG sols as a full and final payment. What should I ask for as part of the conditions of that? for example: - CCJ marked as satisfied. - negative markers removed from my credit file - no more attempts to collect from them or anyone else - ?? and as for the charging order, what wording word I use for that? That the charging order be quashed? Removed? Annulled? Thanks for your help, Mike

  12. While searchng for the canada Square Address address I cam across this web page: citibank. co. uk/personals/cards/cards/feedback/egg.htm about PPI reclaims which suggests I need to send an SAR request to Barclaycard as my account had been moved to them. Is this correct? Thank you, Mike

  14. Is it more than a standard threat-o-gram? It seems more intentional than I've seen previously. It was for an egg credit card. Date of default was March 2009. I haven't paid anything since. It is on my credit file. (I've just signed up on Noodle). Thank you, Mike

  16. I've just had a letter from Mortimer Clarke saying Marlin have passed the account onto them. The letter has words like "could" when referring to court proceedings, but also has: As you have not agreed a reasonable payment plan " ... our client has asked us to issue Court proceedings against you. " And "This means we will be asking the Court to make a judgment against you." This does seem quite definite. I haven't been in contact with Marlin - basically ignoring all their letters. Should I CCA them in the first instance? Thank you. Mike

  18. Thanks for the replies, and Scouserat, there is no need to apologise for the long post. It was helpful and useful. I take your point about living in the house where I lived with my ex. My friends have raised their eye-brows when I have mentioned this. Its more to do with keeping on the property ladder than anything. Thanks for your post, Stigman, I'll start a new thread for each with the details. A couple of years ago I did use a free trial at the two CRAs, so I guess I'm into paying for online service this time. Its not bank breaking, for a month, though. ScouseRat, you say "no cca, no debt" - but can I get the CRA files cleaned even though there is no CCA? I seem to remember reading a few years ago that a judge had decided it was ok for DCAs to mark your file in this situation. Though it is highly likely I've mis-remembered. Thanks again, Mike
  19. I have quite a few debts, totalling about £50k. I have several credit cards that I have defaulted on and a CCJ of a debt related to bank charges that I didn't manage to reclaim. The CCs were defaulted about 4 years ago, the CCj was about 3 years ago. I'm paying £50 a month on the CCJ and have paid nor contacted any of the debt collectors for 3 years. My marriage collapsed at about the same time and I have been living in rented accommodation since. I'm looking to get back into home ownership-there is a possibility I can by my ex-wife's share of the house, if I can raise the funds (about £70k). I guess no lender will go near me with my credit history, so I'm looking into clearing up the situation. My thinking is that I could offer each of the debt collectors 10% of what I owe in full and final settlement, and the same with the CCJ. If I do this, and this is accepted by the DCAs, will it be enough to enable me to get a mortgage again? I get letters often from Lowells and Kapita. The solicitors I need to deal with about the CCJ are DCSolicitors- HSBC. Thanks for your help, Mike
