  1. As expected EVRi came a day before the deadline for the hearing fee payment was due with their offer to settle for the full amount, didn’t update here as I was waiting for the payment to come through which has now happened. Thank you everyone for the input and help, @BankFodder and the team as well as I wouldn’t have even tried without you, that being said I have donated to the forums the little I received from them.

  3. @FruitSalad1010 Thanks for the input however on the notice that I've got it says my hearing is set to take place on the 17th of May and "...all documents upon which that party intends to rely at the hearing including witness statements..." must be submitted to the court by 2pm on 17th of April otherwise they may strike out my case.
  4. Sure, this is what I will add to the bundle: - Witness statement Supporting documents: 1. eBay order details (before and after refund), this will serve as proof of value (2 pages) 2. Packlink Investigation complete email - this is meant to be the confirmation that the item was lost (1 page) 3. Evri's tracking page which shows that the parcel hasn't been marked as 'delivered' or even 'out for delivery' (1 page) 4. First page of the Contracts (Rights of Third Parties) Act 1999, Section 1 from legislation.gov.uk (1 page) Assuming this can be emailed to the court (will call tomorrow and ask) would it be better to have all this in a single pdf file or should I post it via recorded delivery?
  5. Understood, will read up on the insurance problem a bit more then and familiarise myself with it a bit more then. As for the court bundle, I will go ahead and compile it now and send it over to the court and evri by tomorrow.
  6. Will include what you suggested and check the link, thank you. I noticed about insurance and I assume it's because I used eBay's Delivery page to buy the label. When using eBay's Delivery page the option for insurance is pretty much invisible and "no insurance" was always selected by default so people like myself that sell a couple of items a year might not even know that option exists, this has changed recently and you are now forced to select something if you use Evri. However this doesn't seem to be helpful in my case, but might be for others if I actually get in front of a judge and win?

I would add the eBay order details page (before and after refund), which I've already sent to Evri as proof of value, and the Packlink email (titled "Investigation complete") which confirms that the package was lost, quote: I also wanted to include a screenshot of Evri's website with the tracking as well, sadly the tracking number doesn't work anymore on there and I don't seem to have taken any before.. the only page where it still works is Packlink's, not sure if I should use that? Looks like I have a PDF of their tracking page, guess I'll use that.

I believe I do, I have gone again through their defence to double check and it does seem very basic but I believe the issue is relatively straightforward in this case which is maybe why it feels that way? Now, I admit, the simplicity makes me a bit nervous... but at least it makes it easier to explain and get my point across.

  10. Then with 19th being the payment deadline, I'll arrange that on the 17th which is also Monday. I agree, the whole £103.10 is nothing for them, just trying to keep it simple in case they give up on it.

X_Evri_Redacted.pdf I'm still confused about the hearing fee, should I pay this now or wait till the last day just in case Evri comes up with something an hour before the deadline?
  12. Just got it today, 17th May. LE: It seems that I have until the 19th of April to pay the hearing fee, I assume this will be added on top of the claimed amount? Also, I have to send the witness statement by 17th of April.

That's shocking but I believe there's some truth in their statement, I remember getting a very similar response from Royal Mail however it was for a small parcel (covered by their £20 maximum payment). Oh.. what a shame but at least it all adds up now, they hold on till the last moment because they are allowed to.

Same here @Audioboxer, this is their (prompt) reply to my refusal that was sent shortly after my previous post: Earliest court date should be from 1st of April onwards, I assume that them responding to my email means we are getting close to a court date but will update here once I have one. There was no insurance for this parcel if that's what you mean. @BankFodder Should they make an offer for the full amount, am I forced to accept it and will it have any impact on this case if it gets to court after?
