  1. Thanks again Andy. Would it be worth contact this new company via post/e-mail to advise them of my current address just incase they do instigate new court action and request that they send me confirmation that this debt does not exist as not wanting this to keep cropping up.
  2. Hi, After a period of quiet I've now had another letter from a company called DLC based in Northamptonshire sent to an old address dated 26th June 2017. Notice of sums in arrears, Creditor name MEIII Limited, account type: Fixed sum. This has added External Solicitors Costs of £105 and External solicitor fee's of £80 to the non existent debt from the original letters sent at the beginning of this year. As you say this is probably a bit of willy waving from another company in the group but it beginning to become annoying and my concern is that as they are using an old address from 5/6 years ago so if they do instigate court action again I may not find out in time to prevent it. Would you recommend ignoring this or would you contact them to refer them to MEIII failure to provide any evidence of the debt and also to update the address?   3. Hi Sorry for the delay, Quick update for you. After receiving the letter on 9.2.17 from Mortimer Clarke solicitors advising that they do not hold the documentation I requested under section 77 of the CCA (on page 1 of the post) I have since received a letter from Cabot Financial on 21.2.17 (had no dealing with these before and no mention of them), they advised that the account is currently assigned to Mortimer Clarke solicitors for collection so they are unable to action my request in relation to providing information under section 77-79 of the CCA and that all requests should be re-directed to Mortimer Clarke who will liaise on the matter, also that they have updated them on my correspondence. Further letter received on 22/3/17 from Mortimer Clarke Solicitors advising that they have received my defence and were taking their clients instructions in relation to this and would come back to me asap, in the meantime the matter has been placed on hold. Since this I have heard nothing, the claim is still showing on MCOL. No correspondence received at all from MEIII Ltd, no closure from Mortimer Clarke Solicitors and absolutely no idea where Cabot Financial have fit into all of this.

  6. I have added the personalised defence statement below, as recommended I have moved a couple of the paragraphs around. Do I just copy and paste this into a section on the MCOL when I log back on there? Out of interest, why would I not receive a reply to the CCA Request prior to the defence date? Surely this is the evidence / documents that this debt somehow still exists. What is the claim for – 1.By an agreement between Black Horse Ltd and the defendant on or around 9/2/06 (the agreement) Black horse Ltd agreed to loan the defendant monies. 2.The defendant did not pay the instalments as they fell due & the agreement was terminated. 3.The agreement was assigned to the claimant. The claimant therefore claims 2681.18 Proposed Defence. The Defendant contends that the particulars of claim are vague and generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 1. Paragraph 1 is noted. I have, in the past had financial arrangements with Black Horse Ltd, however I do not recall the exact details or am I aware of any outstanding balance. I have requested the claimant verify the details of this claim by way of a CPR 31.14. The claimant has failed to comply. 2. Paragraph 2.The Claimant alleges that I the Defendant did not pay the instalments as they fell due. The claimant is put to strict proof to evidence such breach by way of a Default Notice pursuant to CCA1974 section 87 (1) 3. Paragraph 3 is denied. I am unaware of any legal assignment or Notice of Assignment allegedly served pursuant to the Law of Property Act and Section 82A of the Act 1974. The Claimant has yet to provide a copy of the Notice of Assignment its claim relies upon. 4. On the 2nd February 2017 I made a legal request by way of a section 77 request to the Claimant. The Claimant has failed to comply and therefore is in default of this request and as such unable to request any relief until compliance. 5.   8. Hi Andy Do I use a similar defence to what I copied from another post above (once I've edited to my own details) At what point do I register this defence? As you noted I have until 4pm 3rd March, do I wait until then or register it prior to this as some of the posts I've seen suggest companies tend to reply to the CCA requests at the final minute to reduce the available time to draw up a defence.
  9. Hi Andy, Yes I sent a CCA request and the CPR 31:14, both were sent on the same day to the same address (but in separate envelopes and addressed to the relevant company). The CCA request had the £1 po attached to the letter. I had received a response relating to the CPR 31:14 as above but nothing yet in regards to the CCA request.

I've had a bit of a browse (while logged in) and I'm guessing I need to complete something like the below for a no paperwork defence (just copied and pasted from past thread would need editing to suit if it's the correct route).   11. Thanks Andy, I've now set a calendar reminder to get it done. At a guess I'll need to go back onto the MCOL site and state that no documents/ evidence relating to the debt has been provided. I've tried to look into this myself and Blackhorse have no record of it or documents to provide and seems similar with this company trying to register the ccj. What will happen once the defence is registered, will I get any form of notification this has been removed or am I likely to have someone else try to do the same thing?

Hi all, I have had a reply from the solicitors as below "Thank your letter dated 2/2/17 We Acknowledge your request for documents pursuant to section 77 of the consumer credit act 1974. for the avoidance of doubt, this firm acts on its client's instructions. This firm does not hold the documentation you have requested. We have asked our client to provide them and will come back to you as soon as we can. In the meantime, the matter has been placed on hold and no further action will be taken. " Any suggestion of what to do next, the solicitor and the MEIII company they act on behalf of are at the same address, however I have had no response from ME III yet in regards to the letter sent to them.   13. MCOL has been updated as advised. I've sent the letter to the solicitor today recorded delivery and will send the letter to the claimant tomorrow when I can get a postal order raised. (Both solicitor and claimant are at the same address). Will be interested to see what they provide and how this debt has suddenly surfaced after all these years. I'll keep you posted on any response, again thank you for your help.
  14. Thanks DX100uk, that was the POC word for word listed above, had another look through and nothing that looks like a reference number anywhere on the documents. Am I able to send a cheque for the £1 fee or is it best as a PO? I'll adjust the form to ensure I request copies of all of the mentioned documents.
  15. Many thanks for the help guys. As an update, I phoned Blackhorse and they were unable to find any records of the debt on their system, they went through to their legal dept who advised that without an agreement number they can not find anything. I had provided them with name and every address / postcode since taking the agreement and nothing found. As I presumed this to be cleared a long time ago I no longer have any documents to find the original agreement number so I can't seem to find out the last payment date. I have completed the CCA request but will need to get a postal order raised, unless I can forward a cheque. The CPR 31:14 has been filled out but I had to omit most of the requests for documents (1-6) as these were not included within the particulars of claim, however I would be interested to see these and where they were sent. Can I still request them despite not being on the Particulars of Claim or am I best to leave that for the moment? Again thanks for your help its greatly appreciated.
  16. Thanks for your help I'll get these completed and sent tomorrow. As a side note would I be able to get any information from Black horse due to the time period and also I believe their personal loan division closed down some time ago. In regards to the credit file I've checked clearscore and noddle today and neither of those have any listing of this debt.

  19. Hi All, Hoping for some advice. I have today received a county court letter issued on behalf of a claimant called ME III Limited in regards to a very old loan with Blackhorse Finance from 2006. If memory is correct this loan was paid off back in 2010/2011 (it had previously fallen into arrears). this was paid via an ex partners bank who now lives in Australia so I have no way of verifying this with her. I have had no contact with any company relating to this debt since this period, and if in the event it hadn't been cleared as advised, I believe this would be Statute Barred due to the time period. I have checked Noddle and Clear score and neither have any record of this debt. How am I best to respond to this without proof of payment? Should I respond to the claim online stating it had been cleared or at least should be statute barred or should I contact the claimant solicitors with this information and a statute barred letter template for good measure? Would be grateful for any advice.
  20. Just thought I'd come on to give you an update. I've now gone through the 90 day waiting period to contest the tax years used and they have now taken into account the 2012-13 tax year where I was working full time......and I'm still not eligible. Apparently now it is based on an average NI contribution over a 3 year period so once again they have managed to penalise me for doing the right thing of using savings instead of claiming benefits. Moral to the story is don't do the right thing as it will get you nowhere, due to lack of income I no longer have the use of my phone or car so arranging and attending job interviews is impossible and very soon the internet will be stopped as it's another expense which isn't feasible. I can't even make it to the job centre to sign on for my vital NI contributions which have served me so well due to the location and definately can't phone them on their premium rate number. Sorry if this offends some but the entire system is completely shot if someone who has worked solidly for 17 years paying tens of thousands into the system gets nothing while people who have never contributed a day in their lives get homes, rates and bills paid and have enough disposable income to have fully kitted out TV's, games consoles and blu ray players in every room. Now to go and watch some Jeremy Kyle and Loose Women while weighing up the best option of either becoming a drug dealer or prostituting one of my cats.
  21. Apologies, it's solely borne from frustration, and I'm not basing my opinion on propaganda or rumour but from what I've seen over a number of years first hand. I appreciate the vast majority of claimants are genuine. It's just hugely annoying that I know I have paid more than my fair share into the system, I used my savings when I could have easily claimed a benefit I've even dropped from £30k pa manager roles to £13k pa call centre hell holes to ensure I pay my way when the financial services collapsed and I went from one redundancy to another. It just seems that the one time I need some payback for my contribution I'm being blocked for what I thought before was doing the right thing and using savings and as a result of not claiming what I know is a meagre amount but it has the potential to hinder immediate job opportunities as my travel ability is reducing and potentially future opportunities if any of my credit falls behind and effects my rating. I'll try phoning the benefits office again tomorrow (during Jeremy Kyle as likely to be quieter....joke don't shoot me and see what they say first hand. I'm just at a point for either laughing or crying and I'm not one to reach for tissues so excessive sarcasm is keeping my frustration at bay. Thanks for all the help it is appreciated.

Unfortunately I'm out in the sticks so walking to the job centre isn't really an option and my time is better spent job hunting and writing application letters before my phone gets cut off at the end of the month when I can't pay the bill and default on my contract, which then effects my prospects further as I tend to work in roles where a credit check is mandatory and any black marks result in retraction of job offers. Very vicious circle at the moment, maybe if I had claimed for dla when I was unable to work due to back problems rather than use my savings it wouldn't be an issue. Series of events has truly changed my opinion on the term honesty is the best policy because trying to do the right thing and not rely on the system has led to this series of events. Shame on me for trying to support myself when I could. Well hopefully I'll be back working soon and make my tax contributions so the lazy and deceitful don't have any issues funding their next 60" TV upgrade, Jeremy Kyle just isn't as good on a 52" plasma.
  23. Irony stipulates that the benefits office for people struggling financially have to phone a premium rate number to speak with them. Certainly is an eye opener. Anyone needing a kidney will give a good price.
