  1. They Were Right and I was Wrong! WON Okay I messed up. I went back to my statements and realised that I had included the charges at the end of the month and the payed ones the following month. So yes I doubled up my charges and I feel like a real fool for making such a big deal when I was at fault. Anyway I can now safely say that I've been settled by Nationwide. Settled after Mcol filed. I have contacted MCOL to inform. Please advise how I can make a donation and change my thread to settled. It's really wonderful that we have such a supportive community on this site. My next claim will be with capital and Monument. Thankyou and good luck to every one.

Received reply from Sam Phipps, customer care manager stating that they have checked my schedule of charges against the charges they have refunded and have noticed that it includes dates direct debits were returned as well as the date the charges were debited giving me a wrong figure. They also said that the onus is on me as the claimant in the proceedings to establish the amount of my claim. Now I don't know if this is some kind of tactic that nationwide is using and I also find this corrupt and deceitful. I was never interested in the dates the direct debits were returned because it does not state any fees, but at the end of the statement it tells you unpaid dd fee and the amount. I am really angry that this person is actually giving me wrong information about my claim after they claim to have investigated it. I feel that the court needs to be aware of the tactics nationwide are using to try to get claimants to accept they part payments. I do not have an overdraft with them, so they should pay me what they owe. It actually makes me realise that they see their customers as idiots. I would like to write another letter to charles Bacon about this unacceptable reply and how misleading it is. Any ideas will be welcome. In the mean time Nationwide have filed a defence for the full amount so the case is now going to court, and they will send me an AQ. Support and advice will be very much appreciated.
  3. Bev77, sorry if it appears like I'm hijacking your thread but I thought I'd share with you whats happening to me. It appears that nationwide is now trying to make things difficult. I'm going through exactly the same only you are slightly ahead. They refunded me half of what I was claiming leaving me short of £1600 approx. I have written to Mr Bacon and e-mailed an got a reply stating that my schedule of charges was incorrect because it included the date direct debit were returned as well as the day they were charged, therefore duplicating charges debited and giving me a figure in excess of the sum debited. This is total rubish as you may well know that in the statements the fees are actually recorded clearly and there is no charge on the date the direct debit is returned. I feel like nationwide are trying to confuse me and in a deceitful way. They have now filed a full defence and the case has now moved to court. I will be following your thread closely. I have also been going through the statements thoroughly as they have made me paranoid. In the mean time good luck!
  4. Nationwide have now given me 30 days to close my e-savings a/c and flex account. They have said that I have broken their rules and therfore my punished is for them to close my account. I wish I knew away to challenge them on closing the accounts because they are actually in breach of their own contract....if that makes sense. Anyway that just made me more determined to fight all the way, I mean aaaaaaall the way. Surprisingly they did not mention my ISA account. Would never have done it without the help of this site. Letter to Charles Bacon accepting partial payment and reminding him that the claim continues sent today.
  5. Thanks Caro, I've had a look at the templates and they are very useful. Do I still allow them the deadline as I've received an acknowledgement of service and Nationwide intend to defend. It says they have 28 days from date of service 01/11/06 acknowledgement of service filed. I really am becomming nervous. Do I just go ahead with my letter for the partial payment and see how things go.
  6. Received my statements and sent off my prelimanary letter for £880. Received letter from Capital One dated 26/10/06, offering a refund of £352. I guess I have to now send my LBA accepting partial payment. I don't think I should sign the form accepting the offer, as this will mean closure of my complaint. Does anyone suggest how I should word my LBA including the acceptance of their offer... Nationwide- MCOL- £3144.43 CLAIMED-Partial payment received £1543.56 STILL REQUESTING DIFFERENCE.

Nationwide offer partial payment I received a letter from Nationwide on Friday informing that they have refunded me £1320.34 plus £94.22 to cover lost interest and £120.00 to cover costs for my claim. Nationwide actually owe me £2579.00 plus 8% interest plus £120 for charges. This comes to a total of £3144.43. They have actually paid a total of £1534.56 in to my account. Nationwide explains that that they have thoroughly investigated and calculated all the charges applied to the account and that is the figure they arrived at which is short of £1600.87. I think this is alot of money to just let go. I have come across some template letters in one of threads on how to accept partial payment but continue the claim. Can anyone direct me to that. All advice greatly appreciated. I am so greatful for all the info on this site. It has given me alot of confidence when dealing with such large wealthy organisations that can easily intermidate us if we do not know our rights. I will definately be donating to this site once all my money comes through. In the meant time I need to push forward and need some advice please.
  8. Claim acknowledged on 01/11/2006. I guess Nationwide will defend. Does anyone know how long they take to defend.

  10. Filed my claim with MCOL yesterdayagainst Nationwide and today it says START, Does anyone know if I'm supposed to do anything on line at this stage. I'm not sure what that means. Caspital One-prelim sent 13/10/06 Halifax - SAR sent 16/10/06 Monument- Sar requested

I sent my LBA on 13/10/06 and received a letter from nationwide dated 17/10/06 informing that I had sent the letter to the wrong department and they have sent it on to member services department. Can I still continue to use the fourteen day period or do have to give a grace period? I sent the LBA to the complaints department initially.

  13. Prelimanary letter sent 26/09/06. Received letter from nationwide informing that they are aware that,'there has been a lot of speculation about fees and charges in the media and that the OFT has issued a directive regarding credit cards. They also say if I'm not happy to abide by they terms and conditions, then go bank else where. I will be sending the LBA today. Do I just send a copy of the original spreadsheet or can I add any recent charges to date? Thanks. Monument received statements 30/09/2006 Capital S.A.R - (Subject Access Request) sent 06/09/06- Acknowledgement received. Still no statements
  14. I used the simple spread sheet and just left out the interest. prelimanary request sent today for £2519.00. fingers crossed all the way.`
  15. Please advise further. Data protection letter was sent out on 30/08/06. Received well binded file with all statements on 14/09/06 I've only been with nationwide since February 2004 and yet they have taken approximately £2519.00 in charges. There was one month my salary was paid two days late and Nationwide charged me for ten unpaid direct debits totalling £300.00. I would like to reclaim my charges but I'm slightly confused. I know that we only claim the 8% for court claims. Whilst doing the claims schedule it automatically caculates the interest.
