  1. Hi all - brilliant thank you I will take your advice and see how it goes. I'm confident that I can get the extraordinary fees removed and of course I will happily make arrangements to pay the original loan amount, my biggest concern is getting the default removed. Fingers crossed!
  2. Hello all .... Quick(ish) question ..... Original debt with minicredit in 2013 passed to opos - usual story escalated from £400 to almost £1800!! Several emails with a Vicky Johnston up until September 2013 then all went quiet. I sent several emails requesting a response in 2014 but nothing and then obviously in December 2014 all changed and minicredit and opos ceased trading. I has been trying to agree a settlement figure but all my attempts were refused and then I stopped getting any replies. Last statement of account stood as the following: Loan reference: xxxxxx Date issued: 10/12/2012 Due date: 03/01/2013 Loan principal £400.00 Interest £576.00 Overdue charges £80.00 Debt Recovery fee £100.00 Attempt fees (£5 per attempt) £640.00 Total balance £1,796.00 Payments received 08/02/2013 £20.00 Total repaid: £20.00 Current outstanding: £1,776.00 Amended balance £1052.00 I was horrified to note a default registered on noddle this April by Kapama for the £1052 - I had heard that they were sold a number of debts however I had not received ANY communication from opos or kapama... Certainly no notice of default. What can I do? I have no contact details for kapama and am reluctant to talk to them before I am armed with some information about my rights! Any advice great fully received ... Thank you! M
  3. Hi - sorry for the delayed response! Thanks for your replies, I thought as much, so I can just send them a basic income and expenditure as I did with my other creditors? Do i just keep asking for their bank details so that I can make an affordable payment each month? I really don't know how to respond to OPOS - do I send them my name and address by email? Do I respond to Pay Day Express? Gah! Now i'm having problems with Vanquis threatening to pass my file to Impact Collections - they have refused to freeze interest and charges on my card, and have only agreed to me making three small payments and then returning to the usual paying each statement! The Simply Be and Marisota catalogs have also been unhelpful, Reliable Collections that is, they wont freeze interest until I have made 6 monthly payments and then they 'might' consider 'helping me with the interest' - apparently they don't deal with individuals and debt management companies, only with CCS and CAB, and say they must have an official letter from CCS or CAB to say that I can only offer so much per month etc ..... talk about jumping through hoops! Losing the will today .....
  4. Thanks for your quick reply! So I guess I just keep plugging away? Just had email from pay day express telling me: "Unfortunately we are unable to continue with your repayment plan application. Our accepted criteria for a repayment plan is proof of one of the following: · Significant Loss of income · Unexpected change in personal circumstance, e.g. Long term sickness · Severe Disability or illness (including close family members) · Terminal illness or Mental illness (including close family members) · Deceased (including close family members) · Redundancy or Reduced hours (contractual hours reduced by company) Our opening times are: Monday to Friday: 9am – 5.30pm Although we are unable to accept your payment offer, please contact our Financial Difficulties Team on 0115 908 1163* so we can discuss alternatives in assisting you or you can contact us at collections@paydayexpress.co.uk. This is hugely frustrating! No responses at all and then this!
  5. Hi there ... A rather long update I'm afraid - and lots of advice needed PLEASE!!! To date most payment plans are now in place and ticking along nicely, most have been very helpful and supportive of my situation, some have been harder to persuade. The four who I am having the biggest problems with are: MiniCredit, Pay Day Express, Lending Stream and 24/7 MoneyBox! Despite frequent emails to 24/7 moneybox i have had absolutely no response at all - what do I do now? Lending Stream - I had the following response (grammatical errors are not mine!): "Thank you for your email and we apologize for the delayed response. You have an existing loan account with the agreement number **** and the total outstanding balance on this loan as of today is £236.40. This account was already set up for payment plan on 05/12/2012 but you have not made any payments from your end since continues payment authority was cancelled on your request. We are unable to reduced the outstanding due amount as the payment plan was set up for this due amount. However, we can understand your situation and we are willing to work with you to clear the loan. To review your payment plan via email, we require some few information. Kindly send us your up to date monthly income and expenditure report along with a copy of your recent payslip in a non-editable format (e.g. pdf, jpg, jpeg files). For your convenience, we have attached the income and expenditure form in this email for you to fill in and send it back to us so that we can discuss and provide you suitable repayment options. Should you require further assistance, email us at payments@lendingstream.co.uk. We look forward to hear from you. Customer Care Team, Lending Stream" I have responded by again requesting that they consider a reduced settlement amount. I am happy to send them a basic i&e but do not feel comfortable sending my payslip info - any advice? And so to Pay Day Express: I have sent numerous emails without response including requests to stop telephone harassment and to be contacted in writing only. The calls stopped for a while, then a few texts trickled in and now I have been repeatedly contacted by telephone (about 10 times over the last 48 hours, all from different numbers belonging to this flippin' company!). I have emailed them again, again stating my request to cease telephone contact. So far today I have not heard anything. Not sure what to do next though? I refuse to contact them by telephone. Finally, MiniCredit 1.On the 24th of April they emailed to say that the balance due was now £1720.00 (on a £400 loan) 2. On the 2nd May, before I had responded they sent me an email saying: "Dear ***** We have reviewed your hardship application. Your account will be sent to our DCA partner. They will contact you. Kind regards MiniCredit Hardship Team" 3. On the 2nd May I emailed requesting confirmation of what was happening to my account. 4. On the 7th of May I got a long winded email which ended with the following: "We are willing to accept the amount of £1072.00 as a full and final settlement repayable under a payment plan through our payments collection partner. The settlement balance consists of the original due date balance of £496.00, interest until the default date of £480.00 , the overdue penalties of £80.00 and the decreased failed debit attempt fees £16.00 until the first contact was made less by the payments in total of £20.00 that we have received from You. The contractual interest rate is 1% of the principal per day from the date of issuing until default date the 120th day overdue. The above described overdue charges and interest is in accordance with the Loan Agreement. Your account has been forwarded to our payments collection partner Opos Limited who will contact You shortly to set up a mutually agreeable payment arrangement" 5. Then I received this on the 23rd of May from OPOS: "Opos Ref: ********* Client Name: Mini Credit (https://www.minicredit.co.uk) ; Client Ref: ******** Amount Due: 1,052.00 Dear *******, FAILURE TO RESPOND Unfortunately we have still not managed to resolve the outstanding balance of 1,052.00 with Mini Credit (https://www.minicredit.co.uk) despite several repeated attempts to contact you. This is not a circular. Please contact our offices immediately 0141 375 7403, email us at general@oposlimited.com or make payment and manage your account by going to our website http://www.oposlimited.com (PIN***) and quote your reference ******. Failure to do so will impact your credit rating. This may affect your ability to obtain further credit in the future, including other pay day lenders. We are sure you want to resolve this matter and we look forward to speaking to you soon. Thank you" BTW: I had not had ANY correspondence from OPOS before this email! 6. On the 28th May I responded with: [/i]Dear Sir/Madam I write in regards to your latest correspondence to me dated 23/05/2013, the contents of which have been noted. In order for me to continue corresponding with you in regards to the above account, i now require a full and complete breakdown of the debt, including what each amount you have added has been used for. I require this information to be sent to me within 7 days of receipt of this email. Should you fail to provide me with this breakdown, i will have no choice but to place this account into dispute and will no longer enter into any correspondence until my request is fulfilled. May I also remind you that i hereby withdraw all permission under common law for you or your representatives to set foot on any part of my property(s). Should this order be broken, you will be committing trespass and further action will be taken including police attendance. I also wish to be contacted in writing only". 7. Then on the 6th of June I recieved this: "REDUCED SETTLEMENT OFFER Our records indicate that you have failed to date to resolve the overdue account with our client Mini Credit (https://www.minicredit.co.uk) with the recovery of the monies outstanding 1,052.00. As an effort to resolve this matter in a timely manner our client has authorised us to offer as a full and final settlement 736.40 on or before 20/06/13. On receipt of this payment the remaining balance will be written off by our client, thus saving you money as well as benefitting your credit rating. Please note, we recommend payment is made by debit or credit card by calling the office on 0141 237 1033. If you are paying by cash please pay at any branch of the Royal Bank of Scotland quoting your reference above; the details are as follows: Bank RBS Account Name: OPOS Ltd Account Number: ****** Sort Code: ******* We are here to help and our experienced advisors are able to assist you with a manageable repayment schedule in the event you are unable to take advantage of the above saving by calling us on 0141 375 7403 . Alternatively you can manage your account by going to our website http://www.oposlimited.com (PIN****)) and quote your reference ********* . We are sure you want to resolve this matter and we look forward to speaking to you soon. Thank you". 8. This was shortly followed by an email from a 'Vicky Johnston' in response to my 'you have 7 days to respond' letter from the 28th May: "Good Afternoon, We are in receipt of your email below, before we disclose any details, for security can you please confirm your full name address any previous address your postcode and your date of birth? Regards" - exactly like that, no OPOS information, and no signature information - just replying to my email - several days late!. Sooooooo ... I'm sorry this is so so so so so long but I am utterly confused! I cant believe how much the 'debt' has gone up and down - from £400 to £1700 then £1052 and now £736.40!!! Unbelievable! Please please please - any advice on any of this would be VERY gratefully received! Thanks, M
  6. Thanks for that Renegadeimp - I wondered if you had had a chance to think re an appropriate response that i could use for mini credit? Thanks
  7. Ok so have been into bank and had both letters stamped and dated and was assured that my request would be actioned! Hmmm seems a little too good to be true! I have just got back to QQ with the hardship form and made a repayment offer over 18 months, as I have to all my creditors - if swift sterling accepted it then that's a good sign? Still sweating over mini credit tho
  8. Thanks BM, I will get back to them with an repayment offer. I have had a response from QQ confirming that they will accept a repayment plan based on £600, I just need to complete their income/expenditure form, which is very basic, so will do that now. What shall I do about MiniCredit? Really stuck on that on! Thanks, Bx
  9. Hi both, Sorry for the delay .... yes it was an installment payday loan. The email from them is all a bit odd, i've been digging around to find previous correspondance as I was convinced I only owed one final installment of £96. Anyway, here is their email to me today: Good Afternoon, Thank you for your email and we apologize for the delayed response. You have an existing loan account with the agreement number XXXXXX and the total outstanding balance on this loan as of today is £236.40. We can understand your situation and we are willing to work with you to clear the loan. Kindly contact our helpful team of payment negotiators at your earliest convenience on 0845 351 1482 to discuss the repayment options for the outstanding balance and avoid termination of your account to a third party collection agency. Should you require further assistance, please email us at payments@lendingstream.co.uk. We look forward to hear from you. Regards, Customer Care Team, Lending Stream Email: payments@lendingstream.co.uk Website: www.lendingstream.co.uk As you can see the dates are all over the place and make little sense! I had a look at the original contract and the payments were originally set out for June 12 to Nov 12 as: £100.50 £167.50 £147.40 £127.30 £107.20 and £87.10 As far as I can see I made payment up to the 01/10/12. The final payment confirmed as recieved was for the £127.30 Which leave £194.30 outstanding I guess. So confusing!
  10. Helloooo! So, todays news ..... have received a response from Lending Stream. I borrowed £335, I have paid them £574.80 and they want another £236.40 to settle the account. They say they are willing to work with me to fix an arrangement to settle this outstanding amount (£236.40) ..... I think I've paid them enough already! What d'ya think??? Thanks, Bx
  11. Sorry BM missed your Q re the catalouges - I have sent an email to Home Shopping Direct re both accounts. Couldn't find email address for Reliable Collections. Had standard response saying my email had been passed to their finance team who would be in touch within 3 days.....
  12. I have 2 copies ready and I'm prepared for a fight as I've read a lot in here about Barclays and their lack of knowledge re CPA! Thanks
  13. Thanks Renegadeimp - I have written to them (via email) with a similar email to the one above sent to minicredit - I have also written to my bank and have a hard copy to take into the branch tomorrow. I will cancel my card now - thanks!
  14. Loving the 'minimuppets' tag! No not heard from Pdex as yet, I rang last month to try and arrange a payment plan and they told me that changing jobs was self inflicted poverty! Regrettably they talked me into paying a token amount and rolling over to the end if this month so I expect they will attempt to clear my account for the full amount a week tomorrow! Bx
  15. Hey both! Thanks so much for your replies - accounts still with minicredit at the mo Bombaymix. That would be fab thanks Renegadeimp! Cheers!
  16. Hi ya! Another update .... I asked QQ to consider a reduced amount, and they agreed to £600, which I think is probably pretty reasonable .. well you know what I mean!! I have just asked them to confirm that this can still be paid through a monthly settlement plan. Nothing from PDEx as yet. So - to MiniCredit. ... this is what I sent to them initially: CREDIT AGREEMENT NO: XXXXXXX Dear Sirs, Unfortunately since making the above loan agreement with you, my circumstances have changed and I cannot now afford the previously agreed loan repayment by the 5th of May 2013. This is because my financial situation has become overwhelming and stressful due to many factors - mainly unemployment. I do however now have a new job, which I started this week. Unfortunately I will not receive a full months salary payment until the 1st of June 2013. In view of these circumstances, I would like to arrange a pro-rata repayment plan with you to repay this debt in full. In order to do this I would like to request that you first send me a full breakdown of this loan account to date, including any payments made by myself, as well as all fees and charges added to the debt by yourselves. If interest or other charges are being added to the account from today, I would be extremely grateful if you would freeze these so that all payments made will reduce what I owe, therefore enabling me to clear this debt as quickly as I possibly can. I would like to inform you that I withdraw any authority for MINI CREDIT to take any payments from my bank account, the details of which I have supplied you with in the past and hope that you respect this as my current income is made up of Child Tax Credit and Child Benefit alone and to take this from my account knowingly after informing you of this will be detrimental to the living conditions of myself and my child. Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you. There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance. I also request that you contact me via email or letter and that you do not contact me by telephone. I look forward to your early response. Yours faithfully ...." They replied with the following: "A MiniCredit Claims Department member has replied to your claim, #XXXXXXX with the following response: The Following Response is being sent to You according to the Formal Complaints Procedure. The total outstanding balance GBP1720.00 from the date of issuing (10th of December 2012) until today the 24th of April 2013 consists of the following: 1. Loan principal GBP400.00 2. The current outstanding balance that is GBP1700.00 Microcredit Ltd provides short term payday loans. The Customer chooses the due date him/herself and it is also possible to apply for the roll-over latest on the due date and keep the loan for another period of time if the credit check result allows You to. The Loan Agreement was signed by Yourself and sent to the e-mail address You entered on our webpage during the registration. According to the Loan Agreement You have to make all payments with a debit card and the only possibility to make payments is available on Your MiniCredit.co.uk online account. All the overdue charges and interest have been added to the balance according to the Loan Agreement and will be added until full repayment. Interest will not be charged on any interest or Default Charges applied to your account. Missing Payments Missing payments could have severe consequences, including legal proceedings being taken against you. We may provide details of any missed payments. Please provide us with Your monthly offer for repayment as You have not kept any of the agreements that Microcredit Ltd has set up with You. Microcredit Ltd considers that all the overdue charges and interest have been rightfully added to the outstanding balance according to the Loan Agreement You accepted. We are willing to consider the possibility of a settlement figure if it is reasonable and paid in full. Please contact our Customer Support on the number 08718903015 when You have funds available to offer as full and final settlement. If the settlement is agreed, the payment has to be made with a debit card immediately. We hope this response has sufficiently answered your questions. If not, please do not send another email. Instead, reply to this email. Kind regards, Minicredit Claims Department GAH!! Where do I start???? Super perplexed and somewhat angry (and a little bit worried!). Any advice anyone? Thanks, Bx
  17. Hi - yep seems to be mostly roll over / extension etc - ah well Thanks for the help though! ...... I shall plod on!
  18. Hi Bombay, Hope all is well with you. Just a quick update, I have heard from Swift Sterling who have agreed to my proposal for repayment! No problems at all! Not heard from MiniCredit as yet other than a standard response 'we are dealing with your email' email! Also, Quick Quid have got back to me, and require a basic breakdown of incoming and outgoing expenditure - no problems there. However I also requested a breakdown statement of my account to date and it transpires that from a principal loan of £1400 I have repaid £1962 in total, however they say the default balance on which they are prepared to consider a repayment plan is £1012. Can I negotiate this amount down at all? Any tips / ideas? Thanks! Becci
  19. Hi, I hope you don't mind me chipping in .... Firstly I appreciate how difficult this must be for you, it must be awful to be in your position and you must feel powerless, particulalry as you are not being given any clear information. However, be reassured that the timeframe for these investigations can vary greatly based on a number of different factors. I would guess from the information you have provided in previous posts, that due to the communciation needs of the alleged victim, they will need support to provide information, possibly an advocate, to work with them. This can take time to set up. It is of paramount importance that people with disabilites are given as much support, guidance, information and time as is necessasry to ensure that their human rights are upheld, and that they are empowered to recognise abuse and alert the relevant people to this - as I'm sure you are aware. Secondly, if there is not enough evidence uncovered through the investigation to bring a charge of theft against you, then I doubt very much you will be told the full details of who raised the alert. This is to protect both them and you once you return to work. That is not to say that you should not be supported throughout this process. Managers have a duty to provide support to both the alleged vicitm and alleged perbetrator in these situations. You should contact your HR department and ask for support. If you work for a private home, whereby the Manager and Owner provide all employee support, then contact your Local Authority Safeguarding Team for advice and guidance. Thirdly, I am not suprised that your Manager asked you to attend the SOVA training before suspending you. The Care Quality Commission (CQC) as part of their registration procedure and monitoring framework insist that all Care Workers receive Safeguading training and that this is regularly updated. It should be mandatory training for your organsiation, therefore I would be interested to know if you had Safeguarding training when you first started your job, during your induction? Your employers must also provide evidence that employees are thoroughly vetted, not just through CRB checks, but also robust references and for example proof that the indivudal has the right to work in the UK. Lastly, a SOVA Investigation requires an internal investigation, but may require an external case conference arranged by the Local Authority Safeguarding Team. This will include relevant key people from your place of work, the Local Auhtority Care Managerment Teams and Contract Management Teams, the Police, Nurse/GP etc, your Home Manager and so on. Getting these people together (particulalry over the last few weeks due to the Easter break) is a huge challenge and takes time (and yes I agree it should be priority, but the reality is it can take a few weeks). The priority for your manager will be to ensure that she adheres to her Duty of Care to protect the residents of the home. In situations such as this, it is not uncommon to suspend a staff member on full pay. However they should have supported you, and explained clearly that an allegation had been made and was to be investigated, that there was no evidence to suggest you are guilty, however, as is procedure, and for your own protection (emotionally / socially / future realtionships with colleagues and residents etc) you would be suspended for the duration of the investigation. You would also be told that should you be found guilty you would have you employment terminated for gross misconduct and likely also face criminal proceedings etc. It does not sound like you received this support, and this is the basis for your grievance, and you can put this forward as part of the feedback process that should follow all Safeguarding investigations. You can then also forward your feedback as a formal complaint to your employers. There is a huge number of allegations investigated every day across the country in Health and Social Care. This is of course absolutely justified, and should continue. But try to be assured that there are also many indiviudals who are falsley accused, and do return to work and continue to provide high standards of care and support and have a very successful and rewarding career. The procedures are in place to protect the people we support, and sometimes for a variey of reasons, innocent people get wrongly caught up in these. If you are innocent then you really do not need to worry about your future career in H&S Care. Hope that helps! Cheers, Bx
  20. Hi! So sorry for the delay BM - and thanks again for the fab advice I have started drafting letters and got most of the addresses together to send them to, I've struggled to find the templates for the letters on here though? Biggest update so far is the brilliant nights sleep I had last night! Thanks for that! Although obviously still rather anxious about swift and mini credit, but I'll crack on and keep you posted Thanks again, Bx
  21. Hi BM, Thanks so much for your quick and hugely helpful reply - I really do appreciate it. A couple if things I should have mentioned is that I was bankrupt 4 years ago which is now obviously discharged, but means I have limited options re bank accounts. I did have a co-op but they closed my account after a few direct debits were returned unpaid. I now have a Barclays account. The good news is that only PDexpress have my card details as I had to cancel my card and have a new one issued recently as I lost it! Lucky, it turns out! Should I contact swift sterling and mini credit before sending the harassment and doorstep letters with an offer of payment first? I note that minicredit say in their recent letter that I owe over £1500 now, querying this I am told that this is what I will owe if the £1080 is not settled by the 3rd of may. How do I get them to agree to a lesser figure, say the original loan amount and a reasonable amount of interest And fees? Also, I have two large catalogue debts with Simply Be and Marisota, already I have an arrangement in place with Reliable Collections to repay £90 & £107 per month, which is now also going to be unaffordable. Also they still add monthly interst so less than half of the payment goes towards the balances. Should I request a payment plan with them also? Not sure how it works with catalouges! Thanks again! Bx
  22. Hi, I wondered if anyone could advise please? I have loads of outstanding PDL's and have affordable payment plans in place with all except quick quid, swift sterling, mini credit and pay day express. SS - £1380 due by end of month (£1000 borrowed and was due end of march however given an extra month to pay in full, would not accept repayment plan as just repaid previous loan over 2/3 months and they said this was unacceptable to default again - but had to re-loan to get through the month! Usual story I guess) MiniCredit - borrowed £400 in December and have to pay £1080 by 3/5 which I just can't do (and have already paid about £200 so far) Receive regular letters re doorstop collections etc (which scares me to death) when I ring they tell me to ignore as I have agreed to settle by 3/5 (but I can't - pay by then or ignore!) Quick Quid - owed £1750 and they accepted 5 x payments of £350 if which I have paid three but have three outstanding which I can't afford to pay Pay day express - owe £370 by 1/5 - tried to set up payment plan but would not accept as could not provide letter from previous employer etc. Basically my job ended with little warning I have spent the last two weeks unemployed but start a new job on Monday. At the end if the month I will be paid approx £650 and then £1400 a month following that. I previously earned approx £2800 per month. I have tried and failed to set up affordable plans with these companies and find myself scared into agreeing to ridiculous terms over the phone - particularly when they mention debt collection and doorstep collection and court. I'm a single parent and live with my elderly folks who would not cope well with debt collectors calling for me! I'm in such a pickle - any advise??? Thanks, and sorry for the long post! Bx
