Thanks for shedding some light on it, anyway to be safe I have instructed all my flatmates to lock all windows (its winter anyway), and double lock the doors when leaving the house.   5. Thank you brassnecked, will do so. Tomtubby, that indeed was our first contacts, also all three of our certificate of study letters are provided by the university. Regarding the revoking of LO, this was confirmed on two accounts, once when I was physically at the Lambeth Council, and the second time over the phone with a Lambeth Council representative who assured me the phone call was recorded when asked. They both stated that when the issue is resolved, they will pull the accounts back from the bailiff and revoke the initial LO. Hmm there seems to be different regulations between councils regarding the period in which you graduate at one university and you being your postgrad at another. Taking as the worse case scenario, how much would 2 months cost of council tax cost for an individual (Since my other two flatmates have yet to graduate)? In the case which I had to pay, I'm fairly certain that I would pay directly to the council and not the Bailiffs? With all this discussed, is it still wise to send an email to Lambeth Council and CC-ing Equita stating that everyone under this roof is a student (attaching the three COS letters as proof). In the case which I do, should I black out any details and are there particular things to state in the email? Once again, thanks so much for the help guys Regards S.

Thanks brassnecked, I have replied the bailiff with the following text: "Dear Mr M Furlonger, After speaking to the Lambeth council on a recorded conversation at 20/11/13 1635hr and seeking advice from further council, they have advised me to state to you that all tenants of the address [My address] have student exemption. That the liability order was an error, and hence will be removed by the council. They have advised me to email the Lambeth Council and cc Equita the Certificate of Study letter so as to proof the student exemption of council tax. There will be no further correspondence, and all text messages in this thread may be used as formal evidence if necessary. Regards S." Apart from staying vigilant and ensuring all doors and windows are locked, is there anything else I should be aware of or any action I could take? Regards, S.
  7. Dear All, Just came back from Lambeth Council today. They have photocopied and certified that they all three of our Certificate of Study Letter have been received. The lady at the counter informed me that this will go through the system by Friday. I also asked them regarding the Bailiff problem, they have instructed me to ignore the bailiff until the system processes the documents. Following which I informed the Bailiff (via text) regarding the submission of the Lambeth Council, the chat log goes Me:"Dear XXX, After speaking to the Lambeth Council today they have certified the receive of my confirmation of study. They confirmed that it will take two working days for it to go through the system. By which, the liability order issued by the council will be revoked. I also seek advice with regards to what you inform me yesterday (19/11/2013) regarding the payment of exceeding £200. Upon checking your name in the bailiff register and equita database we have confirmed that there is no [Name Stated in Bailiff Notice] in the system. Upon seeking further advice I was informed that I could fill in a Form 4 for the improper charge you attempted to fine us with. As spoken yesterday, you informed me that I have an outstanding charge with Equita of over £200. However the council states that a charge (if applicable) could be fined for the first visit of £24.50 and £3.00 liability officer. This creates a minimum discrepancy of £172.50 which is not stipulated under Council Tax Regulation 1992 45(2)" Bailiff: "I think you need to read it again and look at the details instead of the rubbish you are texting me" Bailiff: "And I am registered with Shorditch Courts thank you" Me: "Dear Mr M Furlonger, Can I confirm that your full name is [Full name of the one name which surfaced when searching the Certificated Bailiff Justice Website, the first name on the website does not coincide with the Letter I received]? Can I confirm if you work for Equita? Could you please provide a break down of how you arrived at your cost. I am keen to understand how there is a discrepancy exceeding £170. Regards, S." Bailiff: "No my name is not, [First name of the one name which surfaced when searching the Certificated Bailiff Justice Website], it is [Another Name] and we will provide a breakdown on attendance to your property today when we attend thank you" Bailiff: "I suggest you phone shoreditch court if you wish to clarify my identification thank you and do not text me, if you wish to contact do so on the phone by calling myself regards Mr M Furlonger Bailiff in Charge" Me: "Mr M Furlonger, Just a reminder that the Lambeth Council, your employers, have told us specifically not to allow entry to you no matter the situation. And that you would only be allowed peaceful entry, and as long as the electronic gate isn't left open, the security guard doesn't question your authority, the door to our left left open or unlocked, and our apartment windows in a high-rise isn't locked shut [should have wrote open, my bad] you are not allowed to force entry into the apartment.   9. dx100uk, Thank you for your prompt reply and the necessary edits. So just to confirm, after proving my Confirmation of Study Letter to the council i. The council is required to call the bailiff company (Equita) and I will be exempted from the additional enforcement costs incurred mentioned in [Equita Bailiff Removal]. Even the legal cost stipulated by the law (24.50+3.00)? Not complaining here, just trying to understand a bit more ii. Do I have to call the bailiff officer in charge to inform him of the change? Because during the brief phone call he mentioned that he will be at the property at 10.30 sharp if the fess are not cleared and he may remove good even in my absence. I apologise if i seem to be double confirming everything. This is because of two things mainly. 1. Due to the nature that I stay with 2 other girls (all of us are students and I have all their Certificate of Study letters), after making the trip down to the council tomorrow morning, I really want to ensure that neither of them have to experience the experience of receiving a bailiff notice again. 2. I've read many different forums and many different advices and some advices seemed to be heavily discussed and debated about ("deploying of NORIA) hence my slight paranoia about the correct advice. Having said this, I'm truly grateful to you dx100uk for answering so quickly, it has certainly calm my nerves down significantly.

To anyone who can help, Please advice [Enforcement Notice from Lambeth] Received enforcement notice on the 29 Aug 2013 from Lambeth council stating that on the 23 August 2013, Camberwell Green Magistrates' Court granted a LO against me for non payment of council tax totalling £1798.37. Cost of £127.00 were incurred. A balance of £1798.37 is currently owing under this order and this amount should be paid in full by 15 September 2013 [/Enforcement Notice from Lambeth] [Equita Reminder Notice] Received a Reminder Notice dated 07 Nov 2013 regarding unpaid council tax. The letter states "Dear XXX, We write further to our previous applications for payment. To date we note that you have failed to settle your outstanding Council Tax. Our removal teams will be in your area in the coming week and will be looking to seize goods. Further substantial costs will be added to your debt once this action has been commenced. The additional costs include bailiff and porter, removal vehicle and auctioneer expenses. Should you wish to avoid this course of action we urge you to contact our offices immediately. [/Equita Reminder Notice] [Equita Bailiff Removal] Received a "Delivered by Hand" Bailiff Removal letter on the 19 Nov 2013 stating that Payment was due in full - 24 hours. The text reads "I have attended today with the intention of removing your goods and chattels as are necessary to discharge the outstanding council tax liability order and any additional enforcement costs incurred. PLEASE NOTE - No further arrangements are acceptable and payment is now required in full by CLEAR FUNDS ONLY. I will re-attend at your address with immediate effect and may remove goods even in your absence. Should you wish to avoid this distressing course of action, contact me immediately on the telephone number below to arrange prompt payment of your debt. No contact will be taken as your refusal to pay. Yours Sincerely *signed* .........- Bailiff in charge [/Equita Bailiff Removal] Now that I have stated the three letters I have received, I shall proceed with my question. i) I am heading down tomorrow (20th Nov 2013) to the council to show my Confirmation of Study Letter which suffice as an exemption. Will I have to pay the council anything? Does the £1798.37 and £127.00 stated in the [Enforcement Notice from Lambeth] affect me in any way ii) After proving to the council that I'm indeed a student and am exempted from council tax, will they call off the Bailiff? Does the Bailiff still have any legal rights to bother me? Does the bailiff have any rights to force entry into the house? iii) On a brief phone call to the bailiff to understand more he stated a incurred charge of about £200+ (forgot the exact), from what I've read and to my knowledge, since he has only made one visit to deliver the [Equita Bailiff Removal], and the council has applied for a LO. I should be fined a total of £24.50 + £3.00 = £27.50. Thus who should I pay this to if necessary? iv) If this helps at all, I tried inputting "....." into the Certificated Bailiff Justice Website and only received a ......which is not the same as "......" stated in the [Equit Bailiff Removal] and does not state an employee. Another search of certified bailiffs in Equita resulted in a list without ...... at all. I'm not sure if this will help at all, but just wanted to mention it. All help is greatly appreciated.
