  1. Lovely thank-you again. I will have a read of that. Yes I was thinking that regarding the agreement but surely if provided there should be a cut-off date advised? Maybe a silly question but after liaising with company today and an afterthought regarding full pay, should this be stipulated or something mentioned in my original contract? Sorry for further questions but just want to look at all angles at the moment for clarity if this goes on for a long period of time.
  2. Many thanks again Emmzzi for your time in responding. Pleased about holiday pay as yes got full annual entitlement to use if need be. SSP - Never done this before. Where do I get a form from? The last point I will bear that in mind as I have 8 years continuous service. I will see how things go to consider that as there will probably come the time when there will be no deliveries. Finally, again if we are asked to restructure our hours pay do they need to put something in writing? Should there also be a clause in our contract about if no work / no pay?
  3. Many Thanks Emmzzi We have just recieved a brief email from our bosses regarding deliveries tomorrow. Due to the downturn of business they are asking that one driver is to continue on full-pay but the other two have to take unpaid leave. Are you still able to propose taking paid holiday if not in agreement with the above? Also one of the other drivers already had next Monday booked as paid holiday. Is this still to be honoured under the current circumstances? I have noted your comments regarding reduced hours and will bear that in mind if issue escalates in which it probably will. Regarding any SSP if need be, is it done through the company or by the individual concerned? Cheers again for looking.
  4. Hi Uncle Bulgaria, Many thanks for your kind reply. My contract only states that I am paid a daily rate and hours are from 4am - 11am but finish when last drop is done, if before. Nothing about notice regarding reducing my hours only in respect of working bank holidays / changing working days over christmas. Yes I have looked at SSP thanks but have not had a day off in 8 years so all new to me. Previous company I recieved full company sick pay. No I am not claiming any credits. Well if it comes to it and depending what happens next, I may have to as sure that they will propose unpaid leave if a shutdown.
  5. Hi, Just recieved a text (and 2 other London Drivers) from my employer stating that due to recent outbreak and downturn of business they are considering reducing my hours / pay. Our deliveries are slightly down from recent weeks in which usually happens certain times of year due to bad weather / bad fishing etc. Now, I totally understand the circumstances and that others are in the same boat in all industries and alternative would obviously be redundancy, but I just have a few concerns going forward. Should my company put something in writing to all 3 of us to view and agree? If so should they put a temporary cut-off date in writing? Can this only apply to us drivers and not rest of company staff? Will this set precedent going forward when some days / weeks are not as busy? How would they define what is busy / not busy? Now my job is a delivery driver for a family run company. I work 3 days a week, Monday, Wednesday & Friday. 4am - 11am. I get paid a daily rate and reduced hourly rate for overtime. Also there is no mention of Sick Pay in my contract. Any comments would be very much appreciated.

  7. OK thanks again stuwebb I only have First National account number but no policy number for Cardif. Do you think it is still worth a call? I looked on the Santander website and there is a online link. With the clock ticking and age of account I wanted to cover all angles, so wanted to take Underwriter complaint option. Cheers
  8. My OH is in the same boat aswell. All we could find was an early settlement figure details with A & L loan that showed rebate of PPI and account number. This was settled when we moved property in 2001. Contacted Santander but as usual they could find nothing apart from confirming the account was closed? They were really not very helpful. No idea who Underwriters are and would be interested to know how we can find out.

  12. Ok sorry a little confused dx. First National Bank now GE Money ? Window sales person sold policy / loan on behalf of FNB? Yes but website requests that you complete FOS form and email it to relevant ppi address. Cheers
  13. Ok lovely dx always much appreciated. I will submit a complaint online as probably be quicker. Also as per my earlier post, is it correct that any data held on me electronicly, I am not privy to? Sorry so FNB were the broker? Never remembered anyone from them at my house. Just remember a sales rep from window company saying sign here today for your discount etc and advise you to take out insurance as you will have more chance of being successful. On copy of CCA, the sales rep has signed on behalf of First National Bank. I am filling out a FOS questonnaire online, so shall I add this to my complaint and that Underwriters have a duty of care to ensure fair sales?

  15. Cheers again dx, I will have a look and reply anyway. Now if I do go to Underwriters am I still restricted by cut off date even though I have started ppi complaint process? I am not sure who they are but got a feeling it is Cardiff Pinnacle or Aviva. I have looked on websites for limitation details but I have had no luck. I just want to respond quoting relevant details. Any help would be appreciated. Sorry tried looking for any insurers / Underwriters details but clutching at straws now. Thought it was Cardiff Pinnacle / Aviva but OH not sure. Is there anyway of finding out? All I can find is window company, First National Bank and GE Money on agreement. Window salesman sold us the loan. Would there be a broker involved do you think. I have also found a copy of Window companies letter last year in response to my GDPR. They stated that they have located order details with them in 1997 and quoted address, telephone and Finance arranged details. They also state that the information is held on their electronic database but I am not privy to have it? So is this correct? Should there be a letter of destruction if no information is available? Sorry to keep on but trying to find who the underwriters are. Thanks for looking.

I did request paperwork some years ago but got fobbed off with no paperwork available but acknowledged the loan.   18. Further to my earlier post, I submitted a PPI claim to window company to get the ball rolling. I have now recieved a very brief response saying that due to the Statute of Limitations Act, they are closing the claim and thats their final response on the matter? I thought they had to at least respond accordingly if whithin six years from date of discovery? Please correct me if I'm wrong. Cheers
  19. I have located an old loan agreement with First National Bank (Reg No:592986) for 1997 (through a window company) showing upfront PPI payment. I have also found letters from July 2001 from First National Bank stating that they are a member of the Abbey National Group? Loan was paid off and satisfied later on that year. On seaching various websites including Companies House, I have found that G E Money aquired FNB in 1988 - 2003 and also FNB Finance Ltd. I know that the PPI cut-off date is looming but who should I direct my complaint to to get in before PPI deadline? Shall I start with GE Money? Any idea who the Underwriters are as I cannot locate any details on the agreement? Any help would be much appreciated.
  20. Just an update regarding the charge on our property. Coast finally responded a few weeks ago and said they would liaise with Welcome regarding the removal. Today I checked the Land Registry details and charge has finally been removed. I would like to thank DX and all those who have assisted me since my first post. Thank-you all.
  21. Thanks again dx for your reply and help. Ok will get a letter drawn up back to Welcome stating that. Is there any formal way in wording it? We have had years of stress and time and effort dealing with this lot, like others. Don't want to look a gift horse etc Should we be asking for further evidence as to why it has been written off i.e. breakdown of amounts involved? can we contact the Land Registry to have the charge removed?
  22. A belated thanks dx and did not want to start another thread so here goes with my update. Finally received an Ombudsman's decision (only taken six and a half years) regarding the original PPI mis-sale Complaint in which has been rejected. regarding the PPI Non-disclosure Commission offer refund from Welcome, in which was accepted in May 2018 (before transfer to Coast in June 2018), no funds had been transferred or offset against outstanding balance until this day. We continued to pursue Welcome for status of payment in which has been ignored. Account balance transferred to Coast Finance Solutions was therefore incorrect and further complaints were submitted in which again still to this day have not been fully addressed. They even had the liberty in submitting a Notification of Recoveries Letter in which again we disputed on the basis that our complaints responses were outstanding. This did cause some distress and upset to myself and my wife as they insisted that the balance outstanding was correct. Charge on our property has now been changed from Progressive Financial Services to Coast Finance Solutions on last checking with the Land Resgistry. Therefore we decided to contact the Financial Ombudsman Service regarding our circumstances and they contacted Welcome regarding the Undisclosed Commission Refund status. FOS have now responded advising that our account is being repurchased back from Coast and they will be exercising their right to offset against the debt outstanding and no payment will be made direct to us. A letter dated 5th March has been dispatched to explain this and have attached a redacted copy. It was only addressed to me and did not include my wife even though it was a joint loan on the same property? They have also attached a final loan statement advising a debt sale bad debt write off for amount double what should had been refunded (as of May 2018) and Nil balance outstanding? If this is correct and all above board, will the charge on our property be removed and if so how is this done? Sorry to bleat on but we would appreciate any further thoughts to the above mentioned.
