Definitely not a guy! Glad to hear of your success. Your letter from assessor much the same as mine. Doesn't it feel great!!. Loads of people park there now and know it's safe. This site's the best. Let's hope they all go out of business. Take care and happy parking. The precedent has now been set.

Hi, sorry I haven't responded to you earlier. Haven't been on my email for over a week. I expect you have read my thread as I think you attached your first message to that. Suffice to say, that what everyone here is saying is correct. I appealed to POPLA and won, the main basis being that ANPR couldn't substantiate a genuine pre-estimate of loss and also the signage positioning. Like you, I also found that there was no clear signage at the entrance to the car park and also some of their signs were above the shop which were out of the view of any driver keeping his/her eyes on the road and any potential hazards. ANPR supplied their photos, but I supplied better ones. Just be aware that when they send their rejection of your appeal, they will quote a 'reference no' at the bottom and ask you to contact them again quoting this number. Don't. This is actually the POPLA reference no. They are trying to delay you in submitting your claim to POPLA so that you will be time barred. I managed to get mine in on the last day (online). It'll take a couple of months for your case to be heard by POPLA but it's a great feeling when you win and just think of all the money they've wasted for nothing! All the information you need is on this site to help you with the appeal and what to write. It has been a great help to me.I hope you get on OK, I'm sure you will with a bit of perseverance. Don't let the b*ggers get you down. -
Thank you, although I can't say it's been easy. It's been very time consuming. It's easy to see how some people just cave in to avoid the hassle. I suppose that's what they rely on to make their money.

Sorry to hear of your troubles. They tried to sucker me into missing the deadline too by supplying a 'verification number' on their first letter to me. It was only by reading this site that I managed to get my appeal in on time using the original number they gave me. I've just been reading your thread and every bit of correspondence they sent to you, I have received, apart from the court claim form. I wouldn't worry if I were you, as you have enough information to hand to smash them if it goes to court, which I very much doubt. I'd just ignore them from now on and only respond if you get official court papers (which I very much doubt you'll get). They are a bunch of shysters and I'm sure all the good people on this site will help you towards your inevitable win. Take care

Hi, I must thank the CAG for all the information I found on this site which helped me enormously in my fight against these morons. It took a lot of my time, but was worth it in the end. I sent POPLA my own pictures as their aerial diagram was a lot of tosh. There was definitely no sign at the entrance to the car park and as far as LDs are concerned, I personally, don't believe that they would have a leg to stand on if it went to court. The onus is on them to prove they have suffered loss as a result of you parking on the site, which they obviously didn't provide to POPLA. I suggest that if the Landlord really doesn't want people to park at weekends when shops are closed, then they should instruct their contractor (ANPR) to erect a barrier. The parish council has had a meeting with the Landowner to try and appeal to her to lift the restrictions on the car park to no avail, as apparently, she is disinterested. Good luck with your appeal. If you follow the advice on this site, I'm sure you'll succeed.

I got the same letter from them, you can appeal to POPLA online. The popla reference will be on their original letter but they call it a 'verification code'. Sneaky or what!!

Hi folks, just to let you all know that I got response from POPLA today by email saying that my appeal had been UPHELD. WooHoo. Who says Friday 13th is a bad luck day......well maybe for ANPR. What a bunch of shysters. POPLA says their signs weren't clearly visible to cars entering the car park and that also, they hadn't demonstratedthat there was a genuine pre-estimate of loss for Liquidated damages or that there were indeed any losses as a result of parking there. I think a victory for ordinary people and common sense.

Hi James, I've just received a letter from their 'Debt Collectors, H&S Litigation' even although my Popla appeal is still ongoing. I've advised Popla of this and reiterated my previous points. H&S even sent me a copy of the agreement between ANPR and the proprietor, which does not mention anything about a charge of £100 if they allow people to park on car park. I'm going to scan it tomorrow when I get to work and send on to POPLA. My partner has just shown me a site called Parking Prankster. Have a look at it with ref to ANPR, they have just lost a POPLA appeal. It's a very refreshing read and should put your mind at rest.

Hi, I did the appeal to POPLA on line yesterday. I didn't attach any correspondence as I don't have ANPR letters on computer. I'm going to scan them tomorrow when I get to work then I'll be able to send the lot. The letter they sent dated 1st October with the verification code, didn't state that it was for appeal to POPLA and I had no idea what it was, so I decided to ignore the ref, when I responded to them again with the copy of my original letter. I think I've just made the deadline for sending in the appeal. I wish I knew how to send the lot to you so that you can see the trail.

Geoff, sorry, I've not been on for a while. See my comments below. As you can see it's still ongoing. I've just this minute sent my appeal to POPLA, although I've still got to send some evidence. Need a bit of advice on what to send though, apart from the correspondence. I suppose I could take a picture of entrance to car park. Watch this space to see what happens!!

Thanks for response. After their initial letter, I sent legal type letter (recorded delivery as advised on forum) which they have continuously ignored, Like Geoff, I got a letter on 1st October, quoting a 'verification number', which I ignored, then a week later a final demand. I then wrote back (I didn't quote their verification no.), sending a copy of my original letter, highlighted with all pertinent points (that was nearly the whole letter) saying that if they continued to ignore my request, I would complain to appropriate authorities, and would, if necessary defend their action in a court of law. I also said that I would have no further correspondence with them. Yesterday I received a 'letter of intent' saying that the debt of £140 would now be passed to H&S Litigation Services. We checked this out on internet and they appear to be the same people as ANPR, just another guise. When I write to POPLA, should I enclose all the correspondence that has been generated so far? I have letters I sent on my computer, but don't know how to attach them. I can't attach theirs, but I'm sure you've seen them all countless times as they are just standard letters.

I've had no response to my letter as stated previously. I expect I should just wait to see what they send next.

Hi Betty Boo here again. I ignored the parking charge notice that they sent me, but lo and behold, last month I got a letter demanding £50. I didn't pay but sent a letter that I found on your forum, basically saying that I didn't think I had a contract and that LDs werenot enforcable as were punitive. I asked, as letter stated, that they provide landowner details, copies of photographic evidence, diagram of where signs were placed etc, I don't remember on which thread I found the letter so probably have not explained what was in it very well. There was a lot of legal jorgon in it. In any case, I received another letter which completely ignored what I'd asked for and proceeded to spout off about what the numbering convention of their reference meant, and that I should admit liability. I ignored this letter, and have been sent another showing additional costs I will incur for debt collection agency and preparation of court papers. I responded to this saying not to contact me again unless through a court of law etc. and enclosed a copy of my original letter. I have kept copies of everything and when I find out how to attach them, I could send to you if necessary. Should I try to contact the landowner? Any advice would be appreciated.

Yes, I agree, we were saying that yesterday. It's just a cash cow for them. I wonder if the landowneres are aware of their mercenary behaviour!!

Hi Everyone, I'm new to the forum and am struggling a bit finding my way around. I think I've just tagged myself onto someone else's thread and now can't find where I put my message!!....I'm very much a novice at this and don't understand any of the jargon. Anyway, I'll start again. I've jus been issued with a Parking charge notice from ANPR Ltd asking for a payment of £100 for 'trespassing' on a car park in The Precinct, Lodge Drive, Culcheth which will be reduced to £50 if we pay within 14 days. They state that they have a contract with the land owners to prevent 'such incidents'. We parked on car park at 6.30 last night for an hour. All shops were closed and we thought that it would be fine to park there as there were a number of other cars there too. The notice said we went to the pub, so there must have been someone watching and issued the notice immediately we left our car there. I'm going to go back to the car park today to see what the notice says and take a photo of it. I've noticed that you have said to other people to ignore the notice, but as my circumstance is slightly different, I wondered if I should ignore it too. Any help or advice would be greatly appreciated. Thanks

Hi, I've just joined this forum and not quite sure what I'm doing as it's first time I've ever done anything like this. Anyway, I've been reading all the comments on the site regarding ANPR Ltd. I received one of the Parking Charge Notices for 'trespassing' on a car park that is used by shoppers on a precinct. All shops were closed and I presumed, rightly or wrongly that as it was in the evening of a Saturday night, that I would be Ok to park there. There were a lot of other cars there too. The notice said we went to the pub at 6.30pm so someone must have been watching us. We were there for about an hour before going for a meal. I ramble...... The notice said we had to pay £100 (liquidated damages), reduced to £50 for early payment, because they had broken their contract with landowners which I assume is to prevent trespassers. Should I ignore this. We intend to go back to car park and look at sign to see what it says.
