  2. Hi everyone, I am a bit of a newbie and I am trying to clean up some old debts that are haunting me. The usual story really, serious illness, made redundant on medical ground in 2010, I won't bore you or wait for the violins to come out. So here is the debt - I owe £853 to a Marks and Spencer credit card which I think I took out in 2004. I raised a SAR last year as I wanted to check for PPI. They sent me back some weird computer print outs that were not very clear but I could decipher enough to see that there was no PPI on it. That was all they sent me, there was no credit agreement (but I didn't specifically ask for one). Should I raise another SAR and ask for a copy of the credit agreement? The account has been in default since February 2011 and a default notice was issued in 2011. I currently have an arrangement to pay them £5 pcm. So my question is, what can I do about this debt? What would you do? All suggestions welcome.
  3. Thanks, sorry I thought I had hidden all the information. Ok so nothing I can do about that one then? Just keep the £5 payment. I have been reading about the site and notice something about AP markers. Is there a chance that the longer this goes on they will put AP markers instead of DF on my CRA?
  4. If the 2013 DN does stand would I have a case for asking for it to be backdated to when the account DF the second time? It would have been in 2011 I have had a look through my paperwork and the account defaulted in February of 2011. However I reclaimed PPI and they put the money owed to the account reducing the overall debt. Also they said that some of the PPI would count towards monthly payments and as such the account came out of default for a number of months but closed 2011 in default again. The date of the second default notice and the one that is on my CF is 06/02/2013 on the credit file but on the Default Notice the date is 16/05/2013 with the date set to fix the arrears by 05/06/2013.... Then there is the issue of the first DFN from 2007. So I will raise a SAR today but I just wanted to give this update and see what anyone thought.

  6. Ok I will raise a SAR and come back to you when I have the information. I am pretty gutted that I now have another 5 years to wait till I can clean up my file, I hate that they have penalized me for being ill, it is very unfair.
  7. Ok I will raise a SAR ....what should I be looking for to see if the original DN was served? Thank you for your help with this. Also if the 2013 DN is correct would I maybe have a case for asking them to change the date to reflect when the account actually went in to DF?   8. Sorry about that, it is because I am new to this. The account as far as I can recall did not get fixed until after the DN in 2007 was served. I will need to look back at my statements but I am pretty sure it did default then I brought it back into performing a few months later.. .. Does that mean they maybe cancelled the first DN? Also the account was defaulting since 2011 but they served the DN in 2013.. .I kind of need to get this fixed as otherwise I have another 5 years of this nightmare
  9. I have a Default Notice dated 8th December 2007 so this is no longer showing as it is over 6 years old. The account is still not paid so they have issued me with another one dated 16th May 2013 which is showing on my CF.
  10. On Noddle there is only the 2013 default showing and that is in the Nationwide name. I have the paperwork for both defaults and they are both from Nationwide

  12. No problem, I can do that. Do you want to see statements? I was diagnosed in 2011 with a rare illness and I have medical evidence to support it. I was also on benefits from October 2010 and I am pretty sure I have the paperwork to prove this as well, but I will need to check. Please tell me what you need me to give you and I will look it all out. Thank you so much for your help
  13. Hi, I am just starting out with all of this and I am finding it a little overwhelming but I wonder if anyone can help me with a debt that I have. I was seriously ill etc ... and was made redundant on medical grounds in 2010. I defaulted on my Lloyds TSB bank account which had an overdraft on it. I now owe them £2282 and I pay £5 per month on a repayment plan. I really want to sort out this debt and the site team said to start a new thread. They have said that I should possible just stop paying AK but I am not sure what this means. Can anybody help me figure a way out of this debt hell??
  14. Thank you so very much for all of your help. It still feels like a minefield but I will make a start on all of it. I will send a CCA to Idem for M&S and Nationwide personal loan and also the 2nd default needs a letter to Nationwide compliance manager. I will go and try and search the site for templates for the default and start the CCA for the others. Thank you again you have been an amazing help Will do thank you I wonder if anyone could help me. I have been issued with 2 defaults on a Nationwide Personal Loan account. One was in 2007 and one in 2013. My understanding is that they can not issue 2 defaults on the same account. I have been advised by the site team to start a new thread on this. The site team told me I would need to write to Nationwide's compliance manager, can anyone give me a letter template? Also should I raise a CCA on this account? I am very new to all of this and the debt has caused me really problems with anxiety I am scared to move forward but the thought of a life with this hanging over my head is also not appealing. I am looking to write a letter to Nationwide as they have put 2 defaults on the same account. I have found the following letter but I wonder if someone would check over it for me and tell me if it is correct.   15. Wow ok....this helps. Nationwide was a personal loan not a bank account. Lloyds was a bank account
  16. Sorry what do you mean by cash cowed? I will send a CCA to M&S, should I also do this for Nationwide? How can I just stop the payments to AK? Will they not come after me? I was very seriously ill and the debts defaulted because I was made redundant on medical grounds with a brain tumor. The debts have caused me to have serious anxiety to the point that I am now agoraphobic. I am scared of these companies and what they will do to me. I couldn't cope with the letters and phone calls starting again....

Penalty charges....repeating my stupidity here Oh the BMS has been sold on to Idem Capital Securities Strangely the Nationwide account is still showing on my CF as being with Nationwide but I have letter from KPR showing them as having the debt. I am getting this information from Noddle. So to be clear, I should send CCA requests to KPR and Idem Capital Solutions? I know that M&S don't have a copy of the original signed agreement as I sent them a SAR last year and all they could supply me with was print outs of statements historically. I am not sure about penalty charges though. I am pretty sure all of them put penalties onto my accounts for non payment. Also should I be double checking the dates of the defaults? I have no paperwork from any of the other ones showing that they were going to default my account. I am very good at keeping paperwork and I have both DF notices for Nationwide.... The M&S card was taken out around 2002, the Nationwide loan was 2005 and the Lloyds TSB account was from 2004... What should I do about the Lloyds TSB overdraft.. .nothing?

  21. Hi Sorry I wasn't alerted that you responded. All accounts are now with DCA's. So if I understand you correctly, I should just remain on the payment plan that I have as no matter what I pay for the next three years it is not going to improve or worsen my CF? Then I will just continue to pay them the £5 a month if that is the case. Also could you point me in the direction of who to write to, to have the default notice date changed back to the 2007 date on the Nationwide Account?   22. I am on a very small repayment plan but it is only £5 a month on each so I will be very old before they clear at this rate. I am in a position to increase. When I look at my CF it shows as DF each month on these accounts. Would it be best to get them satisfied ASAP or does the monthly df not affect as badly as the main default? I was thinking that if I satisfied them all as soon as possible then it would help then just 3 years till the remaining df notices fall off. I would need to borrow that money from family if I was wanting to pay it all off immediately and I am not 100% sure that would be an option. I just want to know whether it matters how quickly they are paid now so long has gone past - in terms of my CF
  23. £850 to M&S credit card, £2240 to Lloyds TSB over draft, £1994 to Nationwide (this is the default account) was made redundant on medical grounds in 2010 due to brain tumour and couldn't pay. Back working full time now. M&S and LTSB have defaults from July and October 2011. I want to know the best way to tackle all of this debt so that I can get my credit performing again as quickly as possible. Any help would be great. No PPI owed on M&S or Nationwide and can't see anything on LTSB that would suggest ppi on the overdraft
