  1. Can somebody please explain the right of entry LAW. Most on here say they cannot force entry, (as they incorrectly use the domestic violence act as a cover) yet the CAB have stated that this is fact and they were within their rights as it was a magistrates warrant
  2. Renegadeimp, i have visited two Police stations, on three seperate occasions, and the inspector will conveniently not take meetings as dealing with bailiff is a "civil" matter
  3. No Coughdrop, because the CAB havent got a clue when it comes to Bailiffs, so how can i trust them with helping issueing a claim?
  4. Im back, as you suggested, and i REALLY need your help Seanamarts. Police dont want to know, courts don't wants to know, solicitors don't want to know, CAB dont know what they are talking about, ive run out of options!
  5. Im back on here because a fter months of trying to get help and advice im back to square one. Ive visited all four courts in Birmingham, and nobody wants to know. Ive visited countless solicitors, and they are all "criminal" and not "civil" Ive been given two envelopes with "pack 7' and "pack 10" i think but have no idea how to fill them in or to what end. Why are everyone scared to attempt to bring bailiffs to justice? Even the CAB can't give the correct info. According to them, a "magistrates warrant" gives the bailiff the right to force entry? PLEASE HELP
  6. Latest update. Still no joy. Can't even find a solicitor locally that does a no win no fee case against a bailiff! No wonder the scumbags get away with everything. I won't let this go. Can anybody advise how I can take Collectica to court? Thanks in advance
  7. It just gets better. I've had a letter from the courts saying they are no longer interested in any further correspondence! So the court are refusing to take blame, and so are the bailiffs, and we are now left with a damaged door and a bill of £500+
  8. The latest here is that the court have sent me a £200 cheque with no letter or phone call explaining what it's for. I presume it's to cover loss of earnings and costs of calls etc so no compensation, and nobody is willing to pay for our damaged door. Even the police keep fobbing me off. I have had to get an appointment tonight at the police station to make a complaint as they keep saying its a civil matter. Am I definately correct in insisting that the matter is criminal, and they are definately not allowed to force entry when they lodged their boots in the door? I need to be clear if I'm talking to the police later. Thanks in advance
  9. I have today received a cheque from the court which I presume is compensation but its a joke. It's for £200 which I presume is to cover my loss of earnings and telephone calls, but we still have a £600 bill for our damaged front door. The bailiffs have told their employers Collectica that they didn't cause damage. Liars! So how do I get compensation for our door!!!!!!!
  10. The court have still not given me written confirmation, but they have admitted being at fault for sending out a distress warrant by mistake, but the bailiffs are also at fault for the way they held open and damaged our door, yet I cannot get any help on this its just ridiculous!!!! Bb
  11. Only just seen this Tom. Will get dates. I'm back on here as I've send two letters now, one to Collectica, and one to the managing director that was advised on here. Nearly three weeks later and still being ignored

Tom, these are the dates and times according to Collectica:- Account passes to Collectica on 22nd Feb under a warrant of distress Balance at time £55.00 Letter sent to me 28th Feb £85.00 admin fee added to my account increasing balance from £55 to £140.00 £55 received by Collectica via HMCTS on 26th, but admin fee still stands Second letter from C sent to me on 11th March I phoned C on 19th March to advise I had paid on time and would not be paying their fees. I was told action would continue Allocation of bailiff to my account on 22nd April Bailiff apparently visited on 23rd April and incurred attendance fee of £215.00 making total of £300 Further letter to me on 1st May followed by second bailiff visit on 4th June at 7.59am. Both visits we had no knock at the door Due to no further contact from myself bailiff allocated on 9th July and had the visit on 15th July They say their bailiff had informed them that to the best of their knowledge no damage was caused during their visit BLATANT LIE
  13. Problem I've got though is that they are saying I've got no proof that the bailiff damaged the door. I need conclusive facts on the law and whether they broke the law by putting their boots inside my property. Nobody seems to tell be what is LAW and what is OPINION.
  14. Collectica. The court have asked for itemised phone bill to compensate my calls and loss of earnings but the letter is from Collectica basically sticking their two fingers up at us. We have a front door getting looser on its door frame by the day. I bet the video of them filming me (obviously to intimidate me) will conveniently disappear!
  15. I have received a lengthy letter this morning basically stating that their bailiffs have been asked and that they did not cause damage. Basically, blatantly lying. I am not letting them get away with this. Where do I go from here? If it helps, I am willing to send a copy of the letter to any expert on here to get advice on how to respond.   16. Not sure why the replies have stopped coming, but could do with further advice if possible? The court have said they will compensate certain parts such as loss of earnings and costs for telephone calls, but Collectica are completely ignoring me, despite threats of legal action. How am I suppose to get compensation to pay for our door when they are ignoring me?
  17. Thanks for the help all, and to bankfodder. Im sorry you feel you wasnt getting answers but I was trying my best. If you had followed the thread you'd have seen that I was waiting for answers from the court which I didn't receive until Tuesday morning. I have send two email complaints. One to the court and one to Collectica. I will obviously now be awaiting replies now
  18. How strange that Collectica said it was impossible to send my refund before the end of the month,yet after a threat I received it today in the post!
  19. Hang on, everyone else on here have been saying that the bailiff IS NOT ALLOWED FORCED ENTRY! So which is correct? Im using the forced entry as the main reason for complaint! Plus the damage to the door and intimidation
