  1. I used the cards, ages ago and got some charges, then new charges were added on top of those charges and so on. If I wasn't charged then I wouldn't have been defaulted. So you think even though there is no CCA I still cant get them removed? Surley I can seek compensation for breach of the DPA (they might remove it rather than giving me compensation which is fine with me)
  2. Hi I have 2 accounts that I need to sort out. 1. Argos After lots of disputes regarding charges which I have reclaimed my account remains in default. The problem is they don’t have a Consumer Credit Agreement they just have an application form. What can I do about this, I would like the default removed on the grounds that they do not have a CCA for that account. 2. Barclaycard The same as above. But they don’t even have an application form for the Barclaycard account; they have one for my Barclays account with a tick box for a Barclaycard. Again I would like this default removed and possible a small sum in compensation, can anyone suggest anything?? Thank you in advance
  3. Hi, thanks, I have told them that that I am disputing the amount, 20 per month is all I can pay at the moment but they want 60. They should not be able to default someones account just because they can't pay the figure they would like. I have done the Data Protection Act part and I have all of my statements (times 3!), sent the LBA, they have offered me a partial refund but I refused it. What do you suggest I do now: 1. File my claim with moneyclaim, including something to prevent them defaulting on the basis of paying off my o/d as this was only prompted by me claiming back their unlawful charges (don't know if this is allowed) 2. File my claim for charges, let them default me and then take them to court 3. Get an injunction (how?) as well as filing my claim
  4. Can anyone explain how to get an injunction to prevent the closure of my bank account? Basically I am £190 over my limit due to their charges, I used a cheque cashing service and got the dates mixed up and the cheques bounced and was charged approx £400 plus a further £190. Other than this my account has been ok; I have always been in O/D but it was a student account interest free and did not go above this limit. I would like to know if anyone thinks this counts as running the account badly; this happened over a 2-month period but other than that the account was fine. When I first began my claim I told them I would be claiming my charges back, this was when they asked for my card and cheque book back; which I did, now they are asking me to repay my overdraft in their letter the asked me to make a suitable offer to repay I said £20 per month now they say this is not enough and need at least £60 a month otherwise they will default my account and pass it on to another department. Surely as long as I’m paying it back it shouldn’t matter even if it was only £1 per month. I haven’t issued my claim yet; is it possible to include the prevention of account closure with this claim or should I seek to get an injunction. I have done the Data Protection Act and lba; just waiting for payday to go to moneyclaim. They have put my account on hold for 2 months whilst I sort out my claim. Any advice?
  5. 3 Mobile! I'll try that too but I think the SAR request is my best option, I am going to dispute a default as they didn't send me a default notice!
