  2. Brilliant thanks, I sign him up to experian today and they I will have a better idea if he has any other debts too…this is going to be a scary afternoon!! Really appreciate all the help. I have never had to deal with stuff like this before and they can be quite bullying some of the companies. If it is statute barred, do I just send them a letter? Thanks
  3. The first debt is Capital One Credit card for £1451.92 and the debt company chasing it is Lowell Portfolio 1. The sent me a letter on 15th May saying that they have asked for the original lender for a copy of the credit agreement and they will do their best to get it to me within 12 days. Then I had another letter on 27th May saying that Capital One are trying to retrieve the agreement from the archive and as soon as they have it they will send it out, then once I see it, it will need to be paid in full! My boyfriend thinks* this credit card is over 8 years old and doesn't remember paying anything (he has quite a few debts) so I think you're right in us signing up to experian or something like that…if this debt is not on his credit report what happens then? The second debt is a lot bigger, this is for just under £4000 and the letter was from a company called Debt Mangers (Services) Ltd and they are recovering it for Arrow Global, for Natwest. I rang them first and requested the info and the girl on the phone said no payment has been made since 2006. I requested the paperwork and it never got sent so I sent the letter asking for the paperwork. The letter was sent on May 7th and I got a letter back from debt managers ltd on May 12th to say that they have requested a copy of the agreement and will revert them to me once received. I then got a letter from Arrow Global on May 15th, which says… "We acknowledge your letter…we do not accept that we are the creditor as envisaged by the above statute. However we are willing to assist in obtaining that which has been requested. We will now process your request for documentation from the originating creditor and will revert in due course". They also sent my £1 cheque back. As far as I am aware in the last two years which I have been dealing with his finances he has had no default notices or court letters, prior to this he may well have done? It is hard work when they are not your own debts!! Thanks Sara
  4. Just a query really… My boyfriend is in debt and he had two big debt letters which I believe he hasn't made payment to for over 6 years (one is a definite, the other i'm not sure). I had some advice on here to send a letter requesting for the paperwork for both of these debts. I have done this and both debt companies got back to me within 12 days to say they have requested the companies for the paperwork. However it has been over a month now since I have heard anything, what should I do? Thanks in advance Sara

  6. I never though about PPI...thats a good call, as if he had all the credit cards then surely they'll be some PPI..know any good companies to help with that? Just sorting the SB letter now, thanks. They just intimidate you so much, they're not even my debts and I they make me feel poo when I speak to them!! Grrrr...

  8. Hello, Just a query really as I am unsure how to proceed. My boyfriend is a fair amount of debt and as am sorting through them and working out payment plans more and more letters start arriving. ..very frustrating!! he had a letter back in March for a debt of over £3000 for a credit card and I gave them a ring (a company called Debt Managers (Services) Ltd, based in Rotherham). I was told that the card dates back to 2002 and the last payment made to the account was 2006, so over 7 years ago. I said that I would like copies of all the paperwork before payments could be sorted so that I could be sure that it is his debt (it possibly could be as he has forgotten all the loans/cards etc he took out?!). I was told that this process would take up to 4 weeks as they have to request them from the card company and then they need to be sent to themselves before they can be sent to us. ..the phone call was on March 19th, I have since rung back in April to check that this was being processed and I was told it was. I have received nothing as of yet!!! Should I write to them to ask for the records again, or do I ring them? Is there protocol I should follow? Additionally he had another letter with no reference number saying he owed another debt for a capital one card from a company called Lowells. Do companies try and get people to pay debt that is not theres? He has had a debt with them before and there has always been a reference number? Thanks in advance, financially confused Sara

  10. Hello I was wondering if anyone could give me some advice or head up on Welcome Finance. My bf has a debt with them for £1383 and back in November I spoke with them and it was agreed on the account that I would be speaking for him as I am sorting out all his debts (many of them!!) Anyway they agreed on a payment of £10 per month and when we asked to set it up as a direct debit they insisted that it can just be an automatic card payment every month and his details would be kept on file. Great...or so I thought!! We received a letter yesterday to say that he is behind on his payments?? The letter has the payments taken for November (when I set it up), December, January, February and then nothing for this month...because they haven't taken it. There is money in his account as I always make sure of that!! So anyway I rang their offices today and spoke to a lady who really couldn't be arsed talking to me and she said she couldn't speak to me because I am not named on the account grrrrr...so I said can I get my bf to ring from work to OK it and then i'll ring you back. She said yeah thats no problem...or so i thought!! BF rings to say that they won't approve me to talk as i'm on the same line as it for approval grrr...anyway they inform him that they have sold his debt to "Empingham" WHO ARE THEY?? Are they allowed to do this without telling us? Having looked at the letter again which they sent not only have they charged £35 default (which is their fault) but after the first initial payment back in November it says the dec-feb payments were taken by Empingham!? I am very confused and annoyed!! Hope someone can fill me in on Welcome Finance and Empingham?!?

Oh ...I don't know, how do I access those? 1st Credit just sent me a letter saying explaining what statute barred means and that due to the letter from the Cit Advice the 6 year period started again on Jan 2011, they then go on to say that they do not consider the account statute barred and suggest we take free independent legal advice. They enclosed a payment history sheet where the last actual payment was 2006, they also enclosed the letter from the Cit Advice saying they're acting on behalf of my bf, the consent form for this and a financial summary statement he did with them. Additionally they add they are still awaiting further documentation from the client CitiFinancial and will be in touch. Sara
