  2. a> the car was removed even though it was not causing an obstruction - Yes, it was. It was stopping a disabled person from parking in a spot reserved for them. Whether there were other avaialble spaces is irrelevant. b> it seems as though the car was towed within a very short time of it being spotted. Maybe within an hour - Irrelevant. They could tow you away after 5 mns, and still be totally right to do so. c> the parking sign did not have any times marked on it, it simply said something like "disabled parking only", the rest of the street is free parking after 6pm. - A disabled space is 24/7, because disabled people are disabled 24/7. I wouldn't normally bother too much about it as I was parking illegally and certainly deserved a ticket but being towed away late at night when there were loads of other empty parking spaces (standard and disabled) on the street just seems a bit extreme. - Irrelevant. The other thing which was on my mind is that if the same thing had happened to my girlfriend she would have been stuck in a dodgy area of Manchester, on her own in the middle of the night which seems like a very harsh punishment for such a small mistake! - Small to YOU, not small to the disabled person who might not have been able to park. The fact that there were other free parking spots is, yet again, irrelevant. One would hope that your g/friend would be less careless, for her own safety.

  4. Cancel your d/d asap and set up a standing order instead, otherwise, their "payment arrangement" will mean they can up your payments to pay off your debt in 3 or 6 months, and they can help themselves as they like, and there'll f*** all you can do about it. Don't give them that power!!!

The person posting has said they are under mental health, which is a brave thing to say on an open forum, do they need your kind of judgment on them? As for the reasoning of: "I'll take a debt, then run scared for 6 years so as not to pay", that is nothing short of absurd. This forum is about helping one another, not coming down on the weakest elements with a holier-than-thou attitude. Lookinforinfo's advice is sound, should change name to givinoutinfo, hehehe.

  8. No, you're paying for a "service" - allegedly. Yoiu can reclaim it if it was added on without your knowledge or consent, or you were self-employed, etc... But if you knew it was on, agreed for it to go on, and let it go on, you're screwed. Do you have it still as I type this? If yes, why? Cancel it asa soon as you can, and start saving yourself a few pounds! Don't forget they charge interest on that too!

  12. 0800 777 111 if your car is under warranty, that's BMW emergency services. Make sure you say you want one of their own techies to check the fault, they carry a very sophisticated portable diagnostics machine. Or if you don't have the assistance package anymore, call them anyway, explain the problem and tell them you want Head Office number to complain (in Bracknell). BMW want to keep the image of the product where it is, they hate it when they get complaints about their franchises. Making a BIG fuss, especially is staff's been rude, is more likely to get you somewhere with BMW than with most companies. ;-)
  13. No. Not Barclays. Can you start your own thread instead of posting at the end of someone else's? This way, your story and theirs won't get mixed up. Go to Barclays main page, at the top, it says "new thread", click on that, give it a name, type your message, post, and you have your own thread. You can use it in future like a diary to put your questions or let people know how you're getting on.

    Actually, you can get a 4 port one in Poundland. Before you ask, it costs £1. AND it comes in different colours, for the well-coordinated man or woman. ;-)
  16. And when you get your money, make sure you put a bit aside for your claim fee for the next one, and get that prelim sorted for the new lot of charges. You'd think they'd learn, wouldn't you...
  17. You need to search for a thread with "contractual" in it ("why isn't anyone claiming contractual interest?" I think it is) But before you decide to do that, make sure you know what you're doing, as it not an easy one to do, and you have to be able to argue it should you end in court.
  18. Yeah, after all, if they delayed and it cost you money in the meantime, you should recover those expenses, they caused you to be out of pocket because of their stalling.

I wouldn't have been quite so head-on, but I must admit my first thought when I read the original post was that if as new driver manages to go through a red light and get done speeding within a short period of time, the driver should really take a long hard look at his driving technique... I am no great friend of the DVLA, but in this instance, I'd be hard put to blame THEM. Sorry.

  22. What do you mean, he is right? Is your suit frivolous? Do you not have a valid complaint? Looking at your first post, I think you have perfectly good grounds to pursue. Secondly, even if you lost, the judge would be unlikely to award costs against you. It is his decision. Losing doesn't mean that your claim was frivolous, it means that on the balance of probabilities, the judge decides to lean with Thmsons, even if he agrees that you had good cause to complain, for example. A frivolous claim would be, let's see: YOu had a fab holiday, but you drank too much, due to the freely flowing booze, you tripped and hurt your ankle, you're suing Thomson cos it's their fault that they let you have too much to drink. Or you slept with the rep, you're now pregnant, let's sue Thomsons. That kind of thing. ;-) I think you misunderstood Bookworm's sentence.
