  3. Hello, Although I have been eligible to make use of the Motability Car Scheme for a long time, I have never used it, preferring to always buy my own cars. However my current car is now getting a little long in the tooth and problems are starting to appear. Therefore I am looking to join the Motability scheme for the first time. I think I have worked out how the scheme works, however I have tried to find out the answers to a few questions from the Motability website, but cannot find the answers so am hoping the knowledgeable people here can help. Firstly, can I specify the optional extras I would like fitting to the Motability Car?. Obviously I know I would have to pay for these if it is possible to specify them, but is there room for negotiation on the price of the optional extras? (The cost of the optional extras I would like actually exceed the Advanced Deposit cost), I have a hoist to lift my wheelchair in/out of my current cars boot, could this be transferred to the Motability car, or do I have to buy a new one under the Motability Managed Adaptations scheme? Can I use the car for work? I have business cover on my own car, is it possible to have this cover on the Motability car (as I attend the odd meeting at premises other than my normal place of work)? If anyone has experience of the above questions and can answer them it would be appreciated. With thanks Ian

  5. Thank you DX100UK and BazzaS, Can I presume it is in order to return the form with a letter attached explaining the circumstances, or does it have to be actually written onto the form? Sorry if I appear naive but I have never had a problem like this before. As I said I have my train ticket, seat reservation ticket, and the assistance print off I got from the station when I booked the assistance. What I don't have is proof my train was actually cancelled but I hope they should be able to know it was cancelled that day? If the worst comes to the worst and I have to go to court, would I need a solicitor etc who knows the law? Just in my mind I am guilty that I did sit in first class with only a standard ticket - I cannot deny this. Would it be mitigation that I was put there by a railway employee (a chap wearing a blue and white reflective tabbard thing)? I didn't get anyone's name unfortunately. To be honest this incident has certainly knocked my confidence in travelling on the railway, even with the booked assistance. Many thanks. Ian
  6. Hello, I am hoping for some help if at all possible. I am a disabled person. I can hobble a few feet on crutches but generally need a wheelchair. Whenever I travel by train I book assistance at both the departing and arriving station and always make sure I book a seat on the train. in early June this year I travelled down from York to London. My pre-booked assistance worked wonderfully. At departure station I was met out of the taxi by two people, one of whom pushed me in a wheelchair to the train and the other carried my suitcase. My seat was booked and all went well. I was met at Kings Cross with a chap with a wheelchair and another man to carry the case to the taxi rank. It's really nice when all this comes together. However on my return journey a week later things started to go badly wrong. Firstly when the taxi arrived at Kings Cross there was no one to meet me. I waited around stood on my crutches for a while and eventually another traveller offered to help me and went to get someone. Eventually one chap arrived with a wheelchair who stated they hadn't received a request to assist me (despite it being booked). no real harm done, but I was then told my train had been cancelled and I would have to travel on the next train. This meant my seat reservation was 'void'. However the chap pushing me said not to worry and he would pre-board me onto the train before it was called to make sure I got a seat. The chap pushed me to one of the cafe's on the concourse and said he would return to me before my train was called as he had other disabled passengers on arriving trains to deal with. he didn't return and the train was 'called' and all the other passengers started to make their way to the train. A few minutes later another railway chap approached me and said he was here to get me to my train. I had to put my case over my knees (not comfortable at all) as there was only this one chap. He wheeled me along the length of the train and looked in all the carriages and said they were all full (with sitting in the wheelchair I could not look through the windows to verify this as I was too low however it sounded reasonable as the previous train was cancelled. He then wheeled me back towards the first class carriages. had a look in one and said there were seats there, so he would put me into 1st class. I said I only had a standard ticket but he said 'no problem' and that he would speak with the conductor on the train. Hence I ended up sitting in First Class. we set off and eventually the conductor came along. I showed him my ticket and disabled railcard a nd said I hoped the chap who had boarded me had spoken to him about me. He said no one had spoken to him about me. I then explained what had happened however he said there were 'loads of empty seats in standard class'. He asked me if I had any money or a credit card but I said no (I only had enough cash for my taxi fare home from York station and I needed that for the taxi). He never actually asked me to move, just I said I thought I would be unsafe to move on my crutches on a rocking at rolling train travelling at 125mph. he asked me for my name, address, date of birth etc and took details of my ticket and disabled railcard which he wrote into a book. I thought he was going to trace who it was that had boarded me on the train to find out why he hadn't spoken to him and that was why he asked for my details. once I arrived at York, after some delay the 1st class steward chap managed to find me some assistance to get off the train. I heard nothing since and thought no more of it. However last week I have received a Notice of Intended Prosecution stating I may have committed an offence under Regulation 19 of Section 219 of the Transport Act 2000 in not holding a ticket for the class of accommodation I used. I have to reply to them stating my reasons for doing what I did which I will. I still have my tickets, seat reservation card and the assistance print off. However I didn’t get the names of anyone such as the station staff or the train conductor etc – was that a mistake on my part although I didn’t at the time think about it? Also would the train company be able to show for me that the train I had a ticket and seat reservation for was cancelled, hence why I was put on another train? Would just explaining what happened (as above) be enough to avoid going to court? Sorry so many questions but I have never been in trouble in my life and I am worried I am going to be prosecuted and end up in jail. Any assistance would be appreciated. Ian
