  1. Just to let everyone know. Sent a CPR request as per one of Andy's and received a notice of dis-continuance.

Thanks Andy,Looks like any defence based on no signal might be a little tricky, particular with no proof of having sent the phone back etc.I am really stuck here and I know I need to Aos really soon. Dont know what to do. Dont know whether to defend or not. Could someone help please. considering just paying as I am not sure if its a legitimate debt or not.any help really appreciated
  3. Thanks Ford. Will ask them for a copy of signed contract/terms etc. If they dont have one do I have a case based on that I wonder? They have provided me with a last statement but I am unsure if its the mobile contract that gave virtually zero coverage (which I then returned and asked to cancel). I really need to see the original signed contract and terms, date it was taken etc .Primarily unsure whether to Aos as defending, then CPR. If they dont have anything, then thats my defence. If they do then I could defend based on the no coverage argument or if it wasnt that contract then just agree an repayment plan with them. Is that feasible? Would I still get a ccj etc on credit file . Can I actually Aos as defending and then change my mind and pay if it turns out I do owe them without getting a ccj?
  4. Hi,I wonder if any of you good people would be able to help me. I have a thread named SIGMA-HL-Claim-Form-Issued-Help-Please. Should my defense be simply putting them to proof or do I need to do something before that(A CPR etc) and then if they havent replied then my defense is putting them to proof. If they provide documents after I have entered a defense and it appers genuine, can I withdraw my defense and pay in full or enter into a repayment plan without it being entered onto my credit file. Am I correct that when you acknoweldge the claim you have to state if you will be defending. Really appreciate any help given as am a little confused of the order of things.
  5. Problem is, I dont have any paperwork at all and am only guessing at what it might be for.I am unsure of what docs to send and if I can rely on a defence saying that I neither admit or deny based on the fact that I have not been provided with any evidence of debt.
  6. Hi All,I am new to these forums so hope this is the correct procedure. Have received the following claim form. The issue date is 20th May 2013, and the Particulars state: Part of the balance outstanding under a contract made between Everything Everywhere Limited (T Mobile) and the Defendant for the supply of telecommunications services by Everything Everywhere Limited (T Mobile) to the Defendant account number XXXXXXXXXXX, the benefit of which was assigned to the Claimant on XX/XX/2012. The terms of the contract were breached upon the Defendants failure to make payments due under the contract. The Claimant seeks interest pursuant to section 69 of the county court Act 1984 at the rate of 8% per annum from the date of issue continuing at the daily rate of 0.07 I am unsure what this claim relates to but have a hunch that it is an old phone contract that I entered into. When I received the phone the reception/signal was useless so I sent the phone back and asked to cancel the contract. I think this was approx 2008. I think I paid a few months of the contract out of goodwill before cancelling the DD. I have absolutely no documentary envidence at all. Prior to the claim form I had received letters from HL and I contacted them to ask for evidence/signed contract etc. They were evasive and asked me to put it in writing which I think I may have forgotten to do. I note that it says Part of a claim? I do want to avoid any judgement as my credit file is in the process of repair but if they have no evidence then I dont want to pay something that I dont actually owe. If I need to pay then I would prefer to pay monthly as simply dont have these type of funds available. I note from other threads that people refer to CPR letters etc. I am unsure where to find these. Any help much appreciated. Could anyone help with this please? Many thanks
