  1. I have just been informed that the status quo clause will not apply to me and my employment will terminate on 30th June even though my grievance was lodged before I was given my termination date. Is this classed as breach of contract or what can I do about this? Please help its getting to close for comfort now .
  2. Thanks for your quick reply squaddie. Believe it or not this information was given to my union rep from the full time officer from my union. You've cleared my concerns up thanks for your time.
  3. Hi,Can someone please help me? I have recently been having issues at work with a verbal contract argument which i have posted a thread about on here,i am now at the 1st formal stage of the greivance procedure but the extension date i have been given to sort out said issue is approaching 30th June.When my grievance was envoked 3 weeks ago there was a status quo clause in it which means everything involved stays as it is until the grievance is exhausted but i have been told today by my union rep that my employer NHS is trying remove the status quo element of this procedure.So my question is will they have follow through the status quo clause with me as my grievance has already been in place before any changes have been or will be made?My union rep seems to think they can do this but this seems unfair as i'm only at stage 1 and my dismissal date is 30th June and nothing has been dealt with yet this could go on for a while.cheers

They are trying to finish me up to bring in bank porters to save money,on holiday pay and sickness i guess!I was given a 3 month extension so this can be dealt with So this is my concern as far as i'm concerned i have a permanent contract of employment as i was told this on January 9th by my manager.My supervisor is witness as he asked for my written statement on 2 occassions over a 2 month period and was told it was getting sorted.Not once did my manager hint there were any issues so ive had no reason to doubt anything was up as 2 months had past since i was told my contract was now permanent,I just want to know if i have a good case for Tribuneral if it comes to it.My extension ends 30 june but again i have never had nothing in writting over any of my concerns or even when my fixed term contract has been renewed 5 times i might add.thanks for your time.
  5. Hi can anyone help me out? I've been on a fixed term contract since 1.12.11 the end date was 30.6.12 but I have continued to work in the same roll for almost a year past this on 3 month extensions but I have never been given anything in writing! As I have had no written provision what so ever on any of my renewals am I now classed as permanent?i have been told that this is the case but would like a bit more proof this is the definitely the case.thanks
  6. Ok,thats great thanks for your time.I'll await your reply.Just another quick question! what do i do if HR say i knew my fixed term contract was being renewed from the start and tell me my contract is still fixed term?
  7. Yes that's correct my last contract end date was 30/6/12. I am still working and being paid in the same position i started in and have had no break in my service since I started! They have never provided me with another contract just told me it was being renewed each time it ended which was every three months. I am currently on another extension till my situation is sorted out. Is there anywhere I can go to print the facts out on the situation you have mentioned above I need as much evidence as possible to hit them with on my next meeting, thanks for your help.
  8. Thanks for all your help! You've given me some hope my union rep has filled in the grievance form and put it forward it didn't go into to much detail as he said when we get to the meeting stage he will then hit them with all the facts. I just needed it confirmed from an outside view as the union don't give much away and i needed my mind putting at rest that a verbal contract is binding and you have cleared that up for me. Thanks again hopefully I have a strong case and they have to honour the contract.
  9. I have had a meeting two weeks ago with HR and told them this but they said as I have nothing in writing I didn't have a case to answer to. Is there any more solid advice you can give me to take to my next meeting. I have put a greivence in so don't know what's gunna happen now.
  10. Yes I can prove it as my supervisor was told on three occasions that my permanent contract paper work was being drawn up. So I think this would surfice as proof enough.
  11. Would getting rid of me because I'm on a fixed term contract class as unfair? I just wanted to know if I've have worked past the end date of my fixed term contract and not had any provison for the the three times they have renewed my fixed term contract am I now classed as permanent by default? I just need as much info as possible to take to my meeting with HR as I love my job and don't want to leave if I can help it.

I don't see how they can use redundancy as a reason as my job is still there and me Along with all 15 other porters are doing between 4-7 days a month overtime each so if they get rid of me this will cause more overtime as i am on the rota as a full time porter which does not make any business sense at all. I was also told they are bringing in bank porters to cover said overtime and I think that this is the reason they want me out so they save on holiday and sick pay if bank do my job. But am I right in saying if redundancy is the reason they cannot bring in other people as it is the post that is redundant not the person. Thanks for your help I appriciate your time.
  13. Yes I am still working but the said they have only extended my fixed term contract while they investigate this situation! The only contract I have ever been given was my first fixed term one which end on 30th June 2012. My employers have been rolling my contract for 17 months now but I have never been given anything in writing what so ever. HR are telling me what my manager has done is a mistake and as there's nothing in writing I don't really have a case. Could you give me some solid advice I can take into my meeting so I can sort this out.i can give you more info if you need it but just to be clear when I started on a fixed term contract I was not covering anyone and was not brought in to form a specific task,I am in a rota along with 15 other porters and work full time so dismissing me doesn't make any sense at all to me. Thanks for your help.

As I was employed before the 6th April 2012 it states that after a year I am entitled to be treated as a permanent member of staff in the same roll! on or after 6 April 2012 - the qualifying period is normally 2 years before 6 April 2012 - the qualifying period is normally one year I've read on the web that if I work past my fixed term end date and do not receive any provision for this then I become permanent by default is this correct?
