Absolute beginner in need of advice re: forcing sale of a property
sewsew replied to sewsew's topic in Home Repossessions
Thanks for getting back to me. It is a jointly owned property (as joint tenants), owned by myself and my ex-partner. There is approximately £30000 of equity in the house. He is refusing to buy me out, basically saying that, as I moved out 4 years ago, I 'deserve' nothing apart from £2000. I know this is not legal and have suggested ways to avoid a court order to no avail. I am pretty certain the court order is the only way forward but am very worried about the legal expenses. Since I first posted, I have spoken to the local court who are sending me a form out. It will cost £175 to file the order. That's okay, but my concern is that he (my former partner) will claim that, as he has been solely paying the mortgage for the last four years (despite me asking him to buy me out), I am not entitled to anything. Is there any other way out of this??! Many thanks. -
