  1. Hallowitch - I'd like to tell you more, but as I have alleged there to be fraud involved, I dont want to put the whole story up on this public forum?!?!
  2. Right, I've now received an electronic copy of the relevant Bailiffs Certificate and it all looks to be in order. However, I still have an issue with regards to charges and general behaviour, in addition to the fraud allegations.As well as the fact a Form 7 was issued, which included an inventory, by the bailiff looking through the window and at no point having access to my property.
  3. Well, I sent the email over a week ago!!!! Well, I've asked Equita to provide proof and the council want to see proof of his certificate too! I suppose on that basis, Equita have to supply a copy (if he has one)?!?!?
  4. I emailed the TEC and Edmonton County Court. Not heard anything from Edmonton CC yet, just from the TEC. Can the TEC get it wrong?

  6. In my Letter of Claim I have requested a copy of Mr X's bailiff certificate. In addition, the Director of Transport at the Council are now also demaning sight of Mr X's certificate too. The bailiff told me his certificate was from Edmonton County Court, but, its appears not to be the case?! The council appear to be as interested as I am now!

  8. So, the question is... if he isn't on the online register and the Traffic Enforcement Centre have confirmed in writing that hey have no record of him being certificated, is there any way he is, but just not showing up? Or is that unlikely and he is probably uncertificated?Thanks.
  9. Hi Guys,Update for you - one of the Bailiffs I have complained about does not show up on the Bailiff Register. As such, I emailed the Bailiff Register team at the Traffic Enforcement Centre - who have confirmed that they have no record of the person in question being Certificated.Strange?!?!
  10. Yep, I've done it before. It's often hard to get the bank to agree. Be firm and persist.
  11. That would be great - could you email me please? One problem, I can't PM you as I haven't sent 30 messages!!!! What are your thoughts about a bailiff collecting their fees using a warrant the council say is satisfied?
  12. It's shameful!!! I'm sorry that Switchedon had to endure this behaviour today!!! She really needs to get that chargeback sorted. If the bank say no, just keep going. They eventually agree!!!!!
  13. Agreed - I will not be disclosing any of the material fact in relation to my Letter of Claim. My interest here is their actions with regards to attempting to collect fees in the abscence of a warrant but under the pretence of having one.
  14. No worries - the chargeback was for fraud. However, I can't go into more detail at the moment given that I have issued a Letter of Claim. Once sorted (one way or another) I'll happily explain the full details of the fraud.
  15. Well, I suppose its a waiting game now. By the way, I probably should have mentioned that I spoke to the bailiff yesterday. He called the office and called me back to apologise for calling. He admitted he shouldn't have done and that the case is with head office and therefore, all action is on hold. I'd be interested to know the thoughts of anyone else on the matter!
  16. Not quite right, as I didn't chargeback the full amount. Just the unlawful portion of Equita's fees. As such, the amount was paid in full to Equita Ltd and all monies were paid by Equita to the Council. Hence the Warrant was withdrawn by the Council.
  17. Hi Guys, First time post for me here! I am currently involved in a lengthy battle against Equita Ltd, which has resulted in me issuing a Letter of Claim for various reasons. Currently in the process of awaiting a response from Equita / Capita, so I am unable to offer detail in the matter at this point. It's in respect of a PCN, which has been paid. Equita Ltd have previously confirmed that the matter is closed and the warrant returned to the Council. The Council have confirmed that the warrant has been returned and the PCN has been closed as paid. However, despite this, Equita Ltd sent a letter saying that a bailiff was due to visit. I alerted the Council and Equita Ltd / Capita. The Council contacted Equita Ltd and instructed them to stop. However, despite this, yesterday, a bailiff visited my property and put through a Removal Notice, which states he is in possession of a Warrant. He doesnt have one, and the Council are backing me up. I know that Equita Ltd are looking to recover their fees, after I requested a chargeback from my bank, in respect of alleged fraud, which forms the basis of my letter of claim. Equita Ltd have put in writing the fact that they have a warrant, when they dont. The Council told them they dont, the day before the bailiff arrived and are using an invalid warrant to collect their fees! !Now waiting to hear what happens next, as I have provided proof of this to the Council, Equita and Capita. Wonder what happens next?!
