  1. The point I'm trying to make is in the picture - the collision was face on with the door latch side of the door. This surely proves to a degree the door wasn't wide open. The door was still within the boundaries of the parking space. He therefore must of overshot the parking space entering my sister space. He had no damage at all on his car which i find amazing tbh. The insurance cover has not even tried fighting this and has just taken his word for the events of that evening. Zurich hasn't even tried defending her, its disgusting. What is legal cover for, will this be any use?...probably not!
  2. there is no cctv footage, which is a great shame. So the small claims route is possible then? Can you see what i mean in regards to the place of impact, if clearly shows the door wasnt swung open? and the pics shows the offending vehicle going over into her parking space (thats another pic)
  3. Hi, I'm posting on behalf of my sister. A few weeks ago she was parked in a supermarket carpark and was just about to open the door to exit. She had the door already ajar, while she gathered her handbag etc, before opening the door any further she looked over her shoulder and a car swung in wide into her space (at speed) and caught the side of her door (see picture attached). The chap at first admitted liability and apologised. Luckily my sister had the common sense to look otherwise she could of easily had her leg crushed. What we thought would be a open and shut case has now been going on for 3 months. My sisters insurance company are next to useless and keep saying she should claim on her policy and claim back later. My sister refused to do this. She said she wanted to claim direct from the third parties insurance. Today she receives an email stating the other party will not admit liability and she is liable for the full repair. We have supplied a number of pictures which clearly shows the point of impact, however the third party are now saying she swung her door open. I believe the pictures shows this is not the case as the damage would be on the inside of the door. We are now thinking about claiming via the small claims, would this be a route to follow?, perhaps this would persuade the other party to admit liability? She has legal cover, this hasn't been any use what so ever so far. Can anyone help with suggestions?
  4. Spoke to citizens advice on the phone, there transferring it to trading standards. Should have a callback in the next 5 days. Anyone had any experience with TS, just wondering what they can do?

Hi, really sorry about the blocked text, was typing hell for leather as I'm caring for my daughter. yes I paid the full asking price, £200 on credit card and the remaining was cash into his business bank account. I spoke to the dealer at the beginning of the week who said he will pay the £125 bill and replace the warranty with a lesser one. I gave him the deadline of today. I called him a few hours ago and you wouldn't believe what he is accusing me of. Apparently now I held the foreign delivery driver HOSTAGE, and he's trying to get a statement from him. I couldn't believe my ears. Luckily I have CCTV of the delivery driver merrily entering and leaving the house. I'm now worried I'm gonna have the police knocking at my door (I suffer badly from anxiety as it is). I'm unsure what to do. The rear brakes were so bad I had no choice but to replace them myself (I don't have the money to pay someone else atm) although a local garage seen the state of them and highlighted them as dangerous. Theres also a knocking from the from suspension which no doubt is more money. The electric mirrors don't work either (although I know this is not a new car, but was advertised with) plus I have no third party warranty what so ever. Confused, worried and anxious are just some of the feelings I have atm.
  6. Hi everyone. A little background first of all. .. we were looking for a replacement car to fit our 3 young daughters in one of which is disabled. Due to our limited budget of £4000 we did some research into which car would be most suitable. We decided on a Honda FRV petrol as we do a lot of short trips and the 6 seater configuration was very appealing. Our previous car had died on us so we required a car pretty quick. Despite this we looked through the various websites and for weeks failed to find a suitable one close to us. We decided we would need to travel to get the model we required. However our daughter requires quite intense care so travelling ourselves would be very difficult. We then thought about using a transporter service such as Shipley and buying from a dealer for added protection. We eventually found the car which we thought was right for us, it was from a dealer on auto trader. I explained the situation to the dealer and the he reassured me the car was in fantastic shape and drove smoothly with no mechanical defects. If was advertised with a 6 month Gold warranty for extra protection. After a couple of days speaking to the dealer I explained I would need the car MOT'd and he agree for an additional £50 he would do this. He then offered to drive the car down himself for £300 (quotes from shipley ranged from £200 - 400). He required an initial £200 (which i paid on credit card) and the remaining £3000 to be paid into his account the Friday before delivery. We agreed to this, but in hindsight should of only paid half and the other half on delivery. He reassured me that if we were not happy he would simply refund the full amount. Before paying anything into his account I did a few checks including looking for reviews, checking he was registered with company house and the bank account I was paying into was that of the business name (all confirmed). I wrote a short email asking him to conform there was no known mechanical faults and the car drives smoothly as described, he replied confirming this. Delivery was due for Sunday and Sunday came, at 12pm I receive a text from the 'driver saying he had just left, 30 minutes before arriving the driver called (8 hour drive), asking for directions. I could hardly understand the guy he barely spoke any english and was definitely not the guy I was dealing with. there was little I could do at this stage as it was dark, raining and I just wanted our 'new' car. The delivery driver eventually arrives and I ask him does he not work for the company I just bought the car from (he explains in his best way possible, he works for a recovery business and has been paid £75 to deliver our car). As you can imagine I wasn't very happy the dealer did not send himself or at least someone from his 'dealership'. The guy jumped in our new car to get it off the transporter, it starts up fine then dies (I simply thought he had stalled it),he starts up again and rolls it backwards off the ramps, it again cuts out. I look inside and the engine management light is on along with the fuel light - By this stage I am not happy and starting to worry. I tell the driver I am refusing delivery, he asks me to call the dealership. I call the dealership (its 9'ish by now so call a mobile number I have) and explain I am refusing to accept delivery as the car is not starting and the engine management light is on. The dealer explains it probably just out of fuel and tells me to stop worrying and put some petrol in it. I explain back this is not how a car should be delivered especially after I asked for the car to be road tested fully prior to leaving the business premises. He starts to get very high rate and rude. i eventually get some fuel from a local petrol station and place it in the car - it starts and sounds fine but the engine management light is still on. I decide to drive it around the block, its goes fine but is pulling to one side. I get back on the phone and explain the car has started but the light is still on and pulling to one side. He said not to worry as its all covered under warranty. I look at the warranty booklet which has been filled out and signed by the dealer, it states I have a 4 star warranty. I go and check the terms inside the book and see it only covers vehicles upto 100k (this one has 113k, which is also written at the front of the book) I explain to the very rude dealer the warranty is worthless as it dose not cover the vehicle. I then says take it to the local garage tomorrow and he will pick up the bill. I am not happy with this. I now have the foreign delivery driver wanting me to speak to his boss, his boss is english speaking and states if I refuse delivery I will be charged £600. By this stage I am a bag of nerves. I end up accepting the delivery however do not sign delivery note, instead I write " car not as described, engine management light on, transport company asking £600 to return vehicle, seller states he will pay local garage to fix problem" I then get a separate statement from the transporter driver stating the car arrived with engine management light on. I also take a copy of the transporters driving license. next day comes along the car goes on diagnostic machine and a sensor is at fault due to low fuel -cost £125. I inform the dealership who said he will send a cheque and replace my warranty with a lesser one that will be valid for my car. Did I forget to mention I paid Sticker price for the car and not £1 was taken off it. I drive the car a little further and find out the wheels are vibrating and theres a rubbing noise from the back. Come to find out the wheels are out of balance (easy fix), the rear brakes are down to the metal backing plates (god knows how it passed the MOT) and the suspension has a knock likely to be a balljoint. I called the dealer today who said he will pay for the £125 when he get round to it, I explained he has until the end of the week until I take this further. The dealer is in London and I am in Cornwall. I was thinking about a section 79 on the credit card or pursue down the small claims court. Any suggestions or help would be appreciated.
