  1. Back in 2021 I had a bailiff working for Marston, at my door.. he attended my home and clamped my van which was on HP finance. The bailiff was aware during his time at my address that this vehicle was on HP but threatened to have the van towed away. The bailiff then leaves my address with the van still clamped. He returns the next day to remove the clamp. I filled out a complaints form to the courts and had a court date. In the hearing the judge ruled that clamping a HP vehicle is unlawful and also the facts that Mr bailiffs statement was floored with inaccurate facts... also Mr bailiffs bodycam video shows him threatening to tow the vehicle knowing it was on finance. Also in the hearing Mr bailiff said when he was Aware that vehicle was on HP he chose not to return to the vehicle and remove the clamp. The judge in his ruling said that Mr bailiff has acted against the rules set out as a bailiff and ordered him to pay £500 from his bond and to show fresh security to the sum of £10000. This was to be done within 28days from the 13 June 2022 The issue is this.... the 28 days has gone and the bailiff has made no effort to send payment. I want to know how to check if the bailiff has refreshed his security bond ? I want to know how to deal with this further, so far I have requested the information from dartford Court where Mr bailiff has his certificate. The court has not yet replied with a answer. I sent another complaint form to the court about Mr bailiff failure to comply to the judges ruling and refusing to pay. Whats the best action

The issue is where the white pajero is on that map there should be a sign there and if you walk past it the next sign on the same side shows 1pm-2pm again and it's got to be 120 metres between the 1st post. Someone from thurrock council sent me the screen shot of where all the sign are and where should be..... All the black squares are the Mark's for the yellow lines time restrictions
  3. Are they allowed to take a photo of a sign that is not on the same side as where the car is parked......
  4. Just looked 6 tickets that now have been issued and 2 of them are have been put down as the car parked in a different road to where the car was parked..... Just shows you how little the traffic warden has paid attention to his job!!
  5. I found a letter a few years ago from thurrock council Can anyone tell me if they are telling the truth about the sign posts allowed to be spaced out at local authorities discretion...... Please see the letter The posts they have photographed are not on the same side of the road as to where the car is parked...... I also have a street map supplied by the council that shows where all the sign posts are mounted and they are not where the map shows....
  6. I have a issue with Thurrock council and it been going on for years and the story goes like this ... I live with a single yellow line outside my house that had a 1pm-2pm restriction that was to stop the train commuters parking. About 2 or 3 years ago Thurrock council decided to change the time from 1pm-2pm to 8am-11am and when I asked the parking department they said its because the bin lorrys can get into the road.... I explained that the bin lorrys come around at 6am! and not 8am Over the years I have received tickets for parking on the yellow line and have appealed to thurrock council under the grounds that the signs are incorrect. Ive told them that the road traffic regulations states that the signs should be 30 meters apart. They said they would send a street sign maintenance department to check this but over the 10 years or more they have never rectified the problem. The signs are confusing too. One sign shows to time limits to the left 8am-11am to the right it says 1pm-2pm if you walk 120 meters the next sign it says 1pm-2pm and not 8am-11am. Can someone give me the paragraph section in the road traffic regulations that states the correct distance..... Can someone advise how to deal with this as I'm getting fed up having to spend wasted hours sending corresponding letters and appeals...… and before someone says just dont park outside your house.... I already know that!! Thurrock council has a habit of not ticketing cars for a nearly a year then turn up and ticket them day after day.....
  7. we had a visit from a bailiff the other day and he clamped the car outside. the warrant was for driving in a bus lane! The offence was not committed by me. I would like to know the new laws and the new powers that the bailiff have. The bailiff had clamped the car and put a levy letter through the letter box. my partner sat in the car and said she was not getting out of the car as she said she had written to the council to appeal. The bailiff called the police and they turned up. The bailiff showed them a piece of paper with this 68 (1) A person is guilty of an offence if he intentionally obstructs a person lawfully acting as an enforcement agent. (2) A person is guilty of an offence if he intentionally interferes with controlled goods without lawful excuse. (3) A person guilty of an offence under this paragraph is liable on summary conviction to— (a) imprisonment for a term not exceeding 51 weeks, or (b) a fine not exceeding level 4 on the standard scale, or © both. (4) In relation to an offence committed before the commencement of section 281(5) of the Criminal Justice Act 2003 (c. 44), the reference in sub-paragraph (3)(a) to 51 weeks is to be read as a reference to 6 months. Does this power above apply to both county court and magistrate court? as this is only a county court warrant. would someone get arrested for refusing to get out of the car when the state that this was a peaceful action. The bailiff refused to take part payment of half and half later. but I know that this bailiff had a hidden agenda as his brother had been to our house many years ago and was forceful and charging fees that were incorrect and lost out on all his fees when we complained to TFL. We know this because after we sorted out the payments to the bailiff he then asked what happened with his bother all them years ago! as if he didn't know!
  8. I don't know much about this as its my partner debt. does this mean its not a CCJ any more? Who's dealing with it if its not a CCJ? thanks
  9. Hi Today my partner had a visit from Marston to collect on a warrant for a water bill. The bailiff has hand written the attendance letter listing fees but was not able to access the house nor did he speak to my partner. judgement debt £710.68 judgement cost £0.00 Execution costs £111.75 interest to £0.00 officers fees £351.10 TOTAL LEVY £1173.53 I have had a look but cannot find out if the fees are correct or if the officers fees are too high. My partner doesn't know if this is a county court warrant. no other paperwork was left Can the officers fees be almost half the judgement debt?
  10. the company I have been working has just taken on a general manager to carry out day to day running of the company. the story goes like this. before working at the present company I applied to a company but was rejected the job. the guy that I met for a job interview is the new general manager that's just started at my company I am at now. I didn't recognize him but he told me he remembered me. he told me that he had read my file and the disciplinary that I had. he then told me he told my boss he remembered me for the interview at his old company and then showed my boss a Email that he sent to his old company head office stating that I wasn't up for the job that I had applied for and to send a rejection letter. I sat and had a chat and he was giving out that he's going to change the company. he said that its only been a week but he's had 4 or so ex engineers from his old company asking for employment at this company. I had 5 days off for sick and when I was back I was told to come to the office and have a meeting with the new manager. the meeting was about having sick time off and was also saying that I was a problem due to the fact that I got a parking ticket and that the insurance had gone up on the van even though I wasn't the only person to have a accident. he moaned that I had a claim for the windscreen crack. speeding in the van via tracker. moaned about the overtime not been summited to the office but it had. I feel this guy never wanted me to work for his old company and hinted and moaned that he's not wanting me to work at the company im at now. im sure he's just waiting for me to make a mistake and be on me with a disciplinary...
  11. just to add to this my sister was out with her husband in their vw camper and was pulled over. my sister was asked to get out the car and when out the car the officer said she was getting booked for chatting on a mobile phone. when she said to the officer that the vw camper van is a left hand drive. he was very sorry and let her go. if it was a case of his word against her then he would have charged her but the fact she was able to prove by fact that the camper is a left hand drive made him have no chance of pushing a mistake and charge her.
  12. yes the fine would be just £60 and 3 points but why should I bend to this sort of action from the police. The police do make mistakes and I shouldn't have to pay for it. you say that both officers stick together how is it they didn't get the statement correct from the start. how comes they don't read their own statements before signing them and correct them. I believe the other officer had no way of seeing and wrote down what he thought he saw and that's why its not the same. I know if I was to write a statement I would read it and sign it after going over it and stand by it 100%
  13. I need help.... The other month I was driving around a roundabout in Essex and went past 2 police officers on motorbikes. I was followed by one officer and he pulled me over and the officer said I was on the mobile phone. I explained that the van has hands free kit fitted as standard by mecsedes (2012 Mercedes vito). the officer still charged me with the offence by the road side, I said I wanted to go to court to defend that I was not holding the phone. as a mobile engineer I spend a lot of time driving from site to site contacting customers and the office, and was chatting hands free at the time of being stopped. after a few week the police witness statement was sent to my address, and the statement says that both officers was about 15 meters from the road side. they said the both was able to view me drive by for about 2 seconds and had a clear view. but one officer says he saw me with my right arm holding the phone to my left ear!!!!. the other officer says he saw me hold the phone with my right arm to my right ear. I have been back to the site where the police officers was parked up and measured the distance from the road and if they was 15 meters from the road would have been set back behind a gate and a mud bank. their view would have been of a side view as passed them. they would not have seen a clear view up the road. I have checked the tracker on the van and shows that I travelled from stationery start and covered 200 meters and the average speed was 28mph . I would say that I must have passed the officers at over 30mph. I have to attend court at the end of this month and both officers are to attend and give evidence of what they both see. CAN the officer change his statement in court after he has signed his first statement saying he saw something different to his colleague. a minor note: when the officer at the side of the road said he sew me on the phone I said I wasn't and when I said the van had hands free the officer had a 2 second pause for thought before saying "your still getting done for it"
