  1. So do I go ahead now and contact the office of fair trading regarding this? As the ICO have advised?

There has still been no response to my CCA request from JD Williams, although I am still getting the usual Reliable Collections letters threatening this that and the other :/ I mentioned in an earlier thread that I had opened a line of complaint with the ICO regarding the delay etc. I got a response the other day, which although helps me not one iota, but may be of interest for future dealings or whatever.
  3. Ok, I finally got a reply from Nationwide today. From my asking them to repay £240ish, they have said they will repay £30. Is there any follow up to this, or just accept the £30 and move on?
  4. Hi, Post has been and gone today, and still no CCA from JD Williams. I have been searching through the forums, and came across a letter template that may be applicable to this: http://www.consumeractiongroup.co.uk/forum/content.php?436-Failiure-to-provide-a-copy-of-the-agreement-within-the-prescribed-timescale Would now, being 12+2+5 days from the date they received my request be a good time to send that letter out, or is there something else I should do? I have registered a complaint with ICO, and will update them on the fact I still have received no CCA from them as well.

  7. I've received a form from Nationwide, asking for details of my Income and Outgoings, including debts and the length of them etc. I know that with most companies, the line is we are not obliged to give them these details, but as this claim refers to hardship, should I send them the details?
  8. Yes, I am lucky enough for them not to have my new mobile number, and I don't use my home phone. So haven't had the calls others have had. No chance I'm going to call them, letters only for evidence I agree it's unlikely they will actually send someone to my home address, however, should this happen as they say in that letter, what actions should I take when they arrive?
  9. Ok, Latest development. They received the letter I sent to them regarding the CCA (above) on the 19th of April. Today, I received a letter from Reliable Collections, attached, telling me that they intend to visit me at my home address this Wednesday between 6pm-8pm. In the letter I sent, I specified specifically: So, I need some advise please. I have a mobile that will record video, so I was thinking that I answer the door and record the fact that they turned up at my door etc. What should I say, and what letter should I give them to go off on their merry way etc? I can't believe that after JD Williams received my letter on the 19th, that they would then get Reliable to issue a letter dated 24th to say they were making a doorstep visit!

  11. Hi all, I have a flex account with Nationwide, that I had used between June 2011 - Dec 2012. I was using the account mainly as a bill paying account, and just transferred money from my main account to pay for bills etc. In Dec 2012 I stopped using the account, as my housemate took over the responsibility for paying the bills etc. In March, out of interest (was desperate for money and hoped to find a bit left), I checked the account, and found it was £15 overdrawn. I called them to ask where the charge came from, as I hadn't used the account in months. They told me that a standing order was returned in December 2012, and that a charge of £15 was added to my account at the end of Jan. Now, I have to admit that I opted for an online statement, and rarely bothered to check it. However, after this charge, I decided to check the account properly, and luckily they had all the statements available online for me to go through them. I found that between June 2011-Dec 2012 they had in fact charged me a total of £235.41! This included 13x Unpaid direct debit and standing order fees of £15 each. 2x Unauthorised overdraft fees of £20 each and 6x Interest charges of £0.41. I just can't believe that within 18 months of use they put £235.41 of charges on my account. A Flex account that shouldn't have an option of going overdrawn. As I am already using this fabulous site for help with an issue for JD Williams, I had a quick look around to see if there was any help available to re-claim bank charges. I was lucky enough to take Lloyds TSB to county court and win over £1500 back from them in bank charges some years ago, but since then I have totally forgotten the actions I took, and reading here rules seem to of changed etc. So, because I have been on long term benefits during the period I used this account, and from reading other peoples comments, I decided to use their secure messaging system to raise the complaint. (I would of entered the exact quote, but online banking is not available at this time ) I said that I was in severe financial difficulties, and under the BCOB rule regarding hardship, regulated by the FSA, I was requesting the charges be credited back to my account, to avoid court action. I received a reply today to say that they were sorry I was in financial difficulties, but that my account is being managed by their collections department, and that I would have to ring them directly, to discuss the issue. I have no intention of calling anywhere, especially as I can not record calls, and need thinking time on how to respond to things, so I have composed a letter to send into their complaints department: Basically, I want to know if I am taking the right approach to re-claim these charges, and whether the wording I am using is correct, before I send the letter above? Any help on this would be grately appreciated.

Hi dx100uk, I have just copied and pasted the letter you posted above, with my details included, and issued a covering letter (attached) and re-sending the letter accompanied with the original SAR request. I won't be able to send it until Thursday, but just wanted to upload it here, to keep everything in order
  13. In my original letter I wrote: I assumed that this was sufficient enough to act as the CCA as well?
  14. Update: I have now received the SAR information from JD Williams. It's about 60 pages of very confusing stuff! I noticed that in the section for the credit agreement, they have a page which just says no information held. Previous addresses, no information held (the catalogue would of been registered at my previous address). What I have been able to work out, is that I have had the catalogue since June 2011. During which time I have ordered goods that total: £1409.19. To date, I have repaid £621.52. They have added £120.00 of charges to my account. Today I got another letter from 'Reliable Collections'. They have demanded that I pay them a minimum of £364.52. They also say the outstanding debt owed is: £1509.77. Also, if I don't pay them within 7 days, they will pass my information to a doorstep collection agency. The reason they give for this, is I have failed to contact them to make any proposals. Despite my initial 2 letters to them, one requesting the SAR and the other asking that the stop charges are added etc. All they have done is action the SAR, but no response to the other letter to date. What is the best thing for me to do now?
  15. Hi dx100uk, I have blacked out the barcodes now, and re-submitted the attachment under 'scan0001'. I guess Im just gonna have to wait for JD Williams to send the SAR then, although Im, secretly hoping ICO gives them a kick to hurry up, but we'll see.   16. Hi all, A huge thanks to all the previous posters, and help that I have managed to get from the website so far. I just want a second opinion on the actions I have taken so far,m and further advice on what to do next. Summary: I have had a catalogue with Premier Man/JD Williams for a few years. At the start of this year, I was fed up with receiving admin charges etc for not being able to pay £150+, cos I missed my usual payment of £75. I decided to act immediately, before further charges occured, and I get in deeper than I would like. I wrote to them recorded delivery, enclosing a 'please halt charges, experiencing financial difficulties' letter, and also enclosed a 'SAR' letter (save on the postage). They replied I needed to prove my address, so I replied they know its me, because they are still demanding money at my address, sent recorded as always. Anyway, 2 days after the 40 day deadline (23rd of March 2013) I received a letter to say they were processing my request. I decided they were just stalling me, so have just composed a 'Final letter before action' letter, which I will send on Tuesday now, after Easter hols. I have also tonight emailed the ICO about the 40 days passing, and believed they were stalling, filled out the complaint form and scanned all correspondence to date. I will (attempt) to attach the correspondence, all of which I garnished from earlier posts to this fabulous forum, and just want to ensure that everything I have done is correct really. Also, as I suspect they won't reply within the 7 days, after I send the letter, I just want to keep a note here, for further help in dealing with courts or their reply etc. Your expert opinion, as well as extra help if needed is greatly appreciated Millinx
