  2. I am having the same problem with Nuneaton & Bedworth Council. I owe them £50 (initialy it was £136 (my fault) reduced this down to £50 and have now been sent a nice letter saying that I am being taken to court and Liability Order will be issued for £70. By the time they issue the LO the debt of £50 will have been paid. Absolute scandal
  3. Hi Having a problem over council tax arrears. I initially owed £136 (missed a payment last year) but have now reduced this to £50. I received a summons yesterday informing me that my LA will be issuing a LO and the debt has now increased to £120 - £50 debt plus £70 summons meaning the debt has increased by about 120%. Are they allowed to do this and is there any way of challenging the summons
  4. Hi A few of our clients are being contacted by EOS on behalf of Pay Pal. The amounts that they are saying our clients (3) owe is under the £100 figure. It would seem the debts relate to ebay and EOS has been instructed to collect the debts. All of the clients dispute the debts, 1 of our clients is aged 70 and has never heard of ebay or Pay Pal come to that. We have stated that EOS should prove the debt is owed all very basic details etc. We have informed EOS that if they cannot prove the debt is owed then the debt is unenforceable. To be honest we may just as well talk to a brick wall. One of our clients is getting somewhat upset over the letters/phone calls and we have now made a complaint to the FOS any other suggestions from anyone
  5. Hi My daughter has a debt to council for missing 2 months council tax last year, about £220. There has been a liability order issued. She accepts she owes the debt and is trying to pay it back. Council have passed the debt to Bristow & Sutor for collection who have increased the debt to about £500 (their charges are being challenged) I loaned my daughter the money to clear the principle debt ie £220. The council are now saying that they cannot accept it and all payments have to go to the bailiffs. Surely this is wrong I thought that the council have to accept the money - are they correct
  6. Hi I have the same sort of problem with Paragon Finance. 20 years ago I took a loan out for £7k, got into difficulty got took to court with the debt at £4700. This was cleared by an attachement of earnings last year. Now they are trying to say that I still owe £16k in interest and they are allowed to do this as the original finance agreement says they can. I have responded by saying that any debt below £5k is statute barred from interest and for them to claim interest they would have to return to court to request interest. They have said they do not have to and have quoted a court case OFT v First National. HELP what is my next step
  7. I have been reading somewhere on CAG that the same principle applies for charges made regarding mortgages, you know the score you "You have missed a payment and we are writing to tell you something you already know and we will add £25 to your account" As the £25 charge goes on to your balance and you might have 20 years to run on the mortgage its a nice little earner Any suggestions on what tactic to use
  8. How about this for a rip off. On the 2/2/06 I was sent a paper free letter from Halifax saying they have refused to pay a DD, they charged me £39, thus taking me over my agreed o/d. I was then charged another £28 on 8/2/06 due to unauthorised o/d that they created. Another £30 charged on 16/02/06 for paying a cheque of £4.70, another £30 charged on 15/02/06 for a cheque of £1.99, in 13 days £118 in charges. I have written a standard letter to the Halifax last Thursday to date I have had no contact. Shall I send them a reminder or just go direct to court? I am going to take this all the way and I could not care a toss if they close my account
