  1. Hello Rowan, I am trawling through all the Citi/Opus/Threads and came across yours. I went through the Ombudsman to lodge my PPI claim with “Citi”. They passed it onto Opus and I have a letter from Opus stating if anything is sent to Citi it will not be dealt with and I need to deal with them. Please read my thread to see the situation with mine as I do not wish to hijack your post. I have read another thread where a person was not getting anywhere with Opus and went to Citi and was told that they had the information they wanted. So I am wondering if in your situation and taking the belt and braces approach, to go to both of them and state you want the information. Try and be assertive with them do not accept a NO for an answer. In your situation, I appreciate that you are not strong enough to go through the court route and can relate to that to an extent. I used to attend County Courts on a daily basis to help others but the thought of having of to deal with my own issues at Court; even I am finding it daunting. The advice I would give you is that the District Judges mainly sit in “Chambers”, an office with a desk and everyone sits around that. Most of the Judges will try and unravel the issues if they are not clear and will ask questions to try and understand your grievance. I personally would file and serve witness statements with your claim or a simpler way if you do not want to do a witness statement is to do a chronology of the events and list them down, the dates that things were sent, the events and what happened. I would also provide proofs of things, letters sent proofs of posting and other things relevant to your claim, and this will be your evidence. I would lodge this with your application and this should minimise the number of questions that the Judge might have so you will have to speak less in the Court/Chambers. I see your issues have been going on for sometime, I would try and take the bull by the horns and deal with them now rather than leaving them any longer. I have decided to take that stance and want to deal with my claims. I think someone else has already stated to you before, FOCUS and PREPARE and READ, PREP, PREPARE AND PREPARE. I am sure there are others on here more qualified to give you advice on here and apologise if I have overstepped the mark but hope that my post helps you in someway. I used to dread the post coming in but now I am waiting for it and hoping it’s a response to a SAR or something!! Anyway . . . . Good Luck!
  2. Hello All, Just a quick update and a couple of quick questions I hope. I sent off a letter with my signature and utility bill as suggested but I received a further letter yesterday pre-dated to when I sent the information but the envelope was date post marked later than my reply. Do I reply again? Has anyone had any luck in getting any information/statements past the 6 years that Opus claim that they hold the records for? I am wondering if I am going to have to instigate court proceedings on this for the disclosure of the earlier statements from when my account was opened in 2003 . . . .
  3. Hey Slick, Laughs. I was kidding! I would not want to be known as the person who tried to defraud the banks out of £16! After all, it would jeopardise my legitimate claim(s) . . . . and you are right, be better than them . . . . that is a very achievable target . . . .
  4. Hello Slick, When the 'main' card from 1999 was in default, BC offered me another one in 2003, which I took, both accounts had over limit fees and other penalties were levied. The latter was then suspended when they realised about the first one. I might err slip the £16 in somewhere. He who dares . . .
  5. Hello Martin/All, I had CPP "policies" from 2007 to 2011. I have the letters and booklets for 2007 (attached), 2008, 2010 and 2011, unfortunately I cannot lay my hands on the 2009 documents. Some of the letters are signed by Diane Cheesebrough of CPP and some by Diane Cheesebrough of Barclays! Either two totally different people or there is a big conflict there somewhere! (The signatures look the same though) If you still need any of the ones I have, let me know and I will gladly scan and post. PG
  6. Hello Dx, I have heard about the CPP and had that as well from 2005 to 2011!!! ( I am now feeling that I had MUG written on my forehead before I found this site!). The CPP payments were shown as such, maybe this one was as well but is not shown as such. Thank you again Dx
  7. Hello All, Just a quick catch up on this. I sent the letter off today, signed for and recorded, as suggested. I do have some statements and was looking at them today and have noticed a debit "Barclaycard, Card Protecti" of £16 on a statement dated September 2003. Would anyone have an inkling of what that might be? It only appears on this one statement so far, so it is not PPI ??? I do not recall signing up for anything . . . . . . .
  8. Hello All, I have recently started "clearing up" all my financial arrangements and am slowly receiving my CCA and SAR requests that I had sent after reading the threads on here. I have received a CCA today from The Capital Bank after duly sending them my £1 fee. The response is clearly marked "No PPI", so I presume that they were able to "find" my agreement, I wonder if they would have if it did have PPI on there!!! The agreement is dated April 1999 and shows an "Administration Fee" of £55. I have long since paid the loan off but is this something that was legimately and legally charged?
  9. Hello Pete, I was in the same position as you and thought there would be no help out there until I found this Group. I think you need to look around at a lot of threads on here. My advice would be to send off SAR's to the organisations that you had the loans with, a local branch would just fob you off. There is a £10 charge for requesting information this way. I am sure someone more experienced will be along to advice you properly. I have only just started the ball rolling with my claims. It is likely to be an uphill struggle but my view is I won't give up lightly. Good luck and hang in there!
  10. Hello All, I have now received the attached reply in response to my SAR request. I originally thought I would send them a signed request to expedite the SAR request but considering I was "given" the card without having to sign a CCA I now feel that they might "lift" my signature. My reaction at the moment is to send them a letter stating that they have been corresponding with me at the address stated for quite a few years so do not understand why they need my signature, as advised on some of the other threads on this forum. Any comments or suggestions please?

  13. I totally agree Dx and will do. As regards the Sar that I have received, should I write and state that I do not believe that they have complied with my request? I have seen on the other threads that BC do have information going back and they have not provided that to me.
  14. Oh my God! I never realised that. I went through a horrendous time in my life and wanted to get it in order, thought paying them was the only way to move forward and clear my liabilities. I thought trying to reclaim some of the charges, paying people off and starting afresh might help.
  15. I felt that I owed them the money and continue to pay them, I now only owe a few hundred pounds from the thousands. Call me stupid . . . . . The balance in 2007 was never £5,800 odd that they have stated on the statement. I read the statements in conjuction with their letter and took the implication that the balance was all their charges. I see what you mean that the charges are not listed as they have said on their letter. I have just checked the statements to see if they were double sided but they are not . . . . . The account number they have quoted is also not the same account number that I have on some of the statements I have . . . . . .
  16. Sorry, I should add that since 2001 when the debt was transferred/sold to Link I have not had any contact from Barclaycard regarding this account, so I am very surprised that the statement dates are 2007!
  17. Hello again Dx, I am paying Link on the original Barclaycard debt I had and defaulted on in 2001. Feel like I have been paying them for a lifetime! Not sure if that answers your question? Upped the right Docs . . . there were 4 pieces of paper in the "SAR bundle" that I received today - that is the all the paperwork I received that I have uploaded - their letter subject title is in response to my request for the SAR and the enclosed statements, nothing else was received. No proper statements, no credit agreement, nothing else. Their letter as you can see does make the right assumption that I want to find out what penalty charges were levied and that is what I presume the balance is implying on the statements? Maybe I am not with it today and not reading your questions properly - sorry if my reply does not answer the questions you are asking . . . . .
  18. Hello All, I have received the attached "SAR" reply from Barclaycard and would like some help please? I better give a brief history of the problems. I went through personal and financial difficulties in 2001, I had "unmanageable" debts and basically stopped paying everyone. I had, or rather still have debts with Barclaycard and other organisations who walloped me for charges, left, right and centre. I am still paying these off on a monthly basis to Link and trying to cope on a limited budget. I then found this forum recently and have been intently reading as many threads as possible. I have SAR'd every single financial institution that I had debts with. Back to Barclaycard, I have received the attached response to the SAR request that I sent to them. 1) I can view the letter and THREE statements as, the balance shown is "purely" Default charges as their letter implies, go back six years and try and claim them all, bearing in mind, these were actually in 2001 and not 2007 as their statements imply. I am not sure if I view this as Barclaycard trying to help me by suggesting I claim these but forget about going back to 2001 as their statements are dated February, March and April 2007, just within the last 6 years!! 2) Write back and say I am not happy with their response, as I actually had two Barclaycards with them at various different periods, the other one being approximately 2003 to 2007, that I was also hit with charges on. Any thoughts or comments please?

  20. The strange thing is that the 'collection charges' shown on some of the notices scanned above were BEFORE the doorstepping started! Are they charges that can be claimed back?

  22. Hello Dx, Sorry, I better clarify, I presume they sold the debt so I was getting letters from a third party and I am paying them. Hence my surprise when I received the January statement after their acknowledgment that they were dealing with my SAR. The statement shows a'credit adjustment' of over £500. The third party account balance is less than the welcome statement. After looking at all my documents, I noticed all the 'collection charges' which I had not noticed before. This was before the third party was involved. Thank you for looking at the documents for me
