    Welshcakes, Thank you very much for this. I have just got in from work, haven't quite got my brain in gear so will read and start compiling tomorrow after a good breakfast. Is it better to suppy the documents as soon as possible rather than waiting until the specified time? Have a good evening, Tricey

    Hi Welshcakes Thank you for your reply. I am claiming for six years worth of charges and they amount to just over £4,000. The hearing is taking place at Bromley County Court and is being heard by District Judge Thomas. The letter says: 'the hearing of the claim will take place at 11:00 on the 21 September 2007 and should take no longer than 1 hour. Each party shall deliver to every other party and to the court office copies of all documents (including any experts' report) on which he intends to rely at the hearing no later than 14 days before the hearing. The original documents shall be brought to the hearing.'. There is a note at the end saying: 'This case may be released to another Judge, possibly at a different Court.'. I guess this is where the hard part starts but I am trying to stay positive. I must admit though that the story in the paper about the guy that lost his case has shaken my confidence. The one thing that is bolstering me is that I submitted a claim for my best friend and she accepted an offer, and got, her money. The amount she received was only £400.00 short of what we claimed for. Anyway I am rambling, sorry. Any help you can give would be very much appreciated. Tricey

    Hello, I have now received a court date, 21st September, to present my case against the Woolwich (really Barclays) for my charges. Can you give me some advice on how best to prepare so that I get the outcome I want. Any such advice would be very much appreciated. Tricey:confused:
  4. Hello, The Halifax have until 26th March to send me a copy of my charges. Do they normally wait until the last minute? Tricey

Hi Everyone, I sent a CCA letter to Capquest and they have replied to me saying that they are putting my account on hold for ANOTHER 28 days, can you believe this has been going on since last September . They also sent me another letter asking me for the same information, proof of payment and any correspondence. I keep sending them a copy of my Experian file showing that the balance has been satisfied - is it me or are they slightly dim???!!!! Anyway I am going to wait the 12 working days as stated in the CCA and then take the next step. Just out of interest does anyone know anyone who actually works for Capquest, can they give us some insight into their way of thinking? Thank you for your support. It is reassuring to know that you are there to help otherwise I would be tearing out, my already thinning, hair. Take care, Tricey

    Mortgage Fees

    Hi, I am just about to try and claim back my mortage exit fees, I re-mortgaged in September 2006. I had two mortgages against my property; the Woolwich charged me £275 for 'Final Repayment Charge' and GE Money charged me £200 for 'Repayment Administration & Discharge Fee'. Are these charges which I can claim part of back? Any advice would be very much appreciated.
  7. Hi, you may remember me, I am being chased by Capquest for £88.81 and I sent them a DCA. I received a letter from them saying that I had to provide proof of payment and obtain proof of payment showing a reference number by 3rd March. This is after my sending them a copy of my Experian file and telling them that I had settled this debt several years ago and no longer have the paperwork for it. I have been advised to send them a CCA letter but after having searched this site cannot find a template letter. Can anyone help? and very at Capqest. I feel like they are trying to intimidate me into paying something I don't owe. I thought the onus was on them to show that I owed this money?????????
  8. Hi, Does anyone know whether you can reclaim charges on council tax debt? I have been in the wrong band ever since I moved in 1990. I lodged my appeal to be rebanded last week and wondered whether any rebate I receive should include the charges I had to pay for late payments

  10. Hello, I am being chased by CapQuest for a debt of £88.81 which they say I owe to Littlewoods Finance Company. Several years ago [in the late 90's I think] I did have a debt with Littlewoods (for £247) but I settled it, this showed up on my Experian credit report. CapQuest started sending me letters in September of last year. I called them up but they said the amount was still outstanding. Following that telephone call I sent them a copy of my credit report showing that the debt I had with Littlewoods had been settled, but they continued to send me letters. In November I sent them a copy of the credit file again. Just after Christmas I received a letter form a DCA called Scotcall asking for the money and adding charges on top. I called them and spoke to a lady called Nicola who advised me write to CapQuest again as they had said that the Experian credit report was not sufficient to show that the debt had been settled because it did not show a reference number. I did as she had said and got a reply for CapQuest saying that they would hold the account over for 28 days while they made enquiries with Littlewood Finance Company. Yesterday I received another letter from them saying that they were still waiting for a reply from Littlewoods and would be holding the account over for a further 28 days. I was annoyed to say the least so sent them a dispute letter, template of which I got from moneyexpert.com website. I will let you know what the outcome is. Tricey
  11. Hi, I am new to posting, so please forgive me for any errors. Last week I sent my first reclaim letters to the Halifax and the Woolich. The Woolich replied within the same week, returning my £10 fee, saying that they are sorry to hear about my claim and aim to reply to me by 14th March. I have heard nothing from the Halifax yet, admittedly it is still very early days. This may seem like a silly question, but is the 40 days tallied as 40 working days or 40 calendar days? Tricey
