Hi please would someone give me some advice regarding an old loan with welcome finance. i recently received a letter from marlin dca regarding the above .i believed the debt to be statute barred so sent a SAR but unfortunately it is not. i am going to reclaim the charges but can I do this under the BCOBS? If I can please can you tell me where I can find the template for reclaiming as I can't seem to find it many thanks in advance martf

  3. many thanks for your help,I have googled chargeback and she will be contacting her card provider about the payment! She is going to send a SAR off asap but have you any idea where she can find the address to send it to pls as the original local welcome finance office has gone?
  4. Hi havinastella thks for yr reply.i think the threat of court action got her worried! She paid by debit card and future payments by direct debit.marlin financial ( who she paid)were very aggressive to her,please could you tell me what a charge back entails? The debt was originally an unsecured personal loan of £3000.no she hasn't sent a cca request.she is not sure when the last payment was made or whether 6 years or more have passed but did make the payment mentioned above roughly 2 weeks ago.
  5. hi I am hoping if someone could give me some advice pls.my daughter had a loan with welcome and after financial difficulty ceased making repayments about six years ago.she recently received a letter from Cabot threatening court action.she phoned them and has been bullied into making an immediate payment of £200 with further monthly direct debit payments of £450.this seems excessive on an outstanding amount of £2150 ? Please can anyone kindly advise if any course if action many thanks in advance martf
  6. hi i wonder if someone would be kind enough to give me some advice regarding the above.i fell into debt with marshall ward catalogue and received letters from lowell requesting payment.i sent off asking for the original credit agreement which they requested from MW.i have received an agreement which was about a month outside the 12+2 days allowed.also the agreement they have sent isnt the original catalogue agreement but an agreement that turned the catalogue debt into a fixed loan debt which was signed by me after falling into arrears with MW.please could someone advise me the best way to proceed,many many thanks in advance

  8. thank you locutus.my credit file is already trashed through previous debts so im not worried about that at all.please can i ask you what you would advise? should i contact orange with an offer of payment for line rental charges only or ignore it and hope it goes away?
  9. many thanks for your help.do you think i should write to orange concerning the unfair charges as i agree i owe them some money or wait to see if they take court action.its a bit worrying waiting for court action
  10. hi i wonder if someone could offer me some advice please regarding an orange phone default and subsequent debtcollector/solicitors letters.i defaulted on my orange phone acct with about 5 months remaining @ £80 per month.i received numerous letters from buchanan clark and wells debt company stating that i owe £742.76 made up of 417.13 contract charge,296.03 time charge and 29.60 admin fee.i asked them by letter to explain the difference between time and contract charges which they are unable to do.i wrote to orange and they wont explain either they just referred me back to bcw.i have now received a letter from gpb solicitors with the above charges written on it by way of an explanation asking for proposals for payment by 26/10/12.please could someone advise if i have to pay charges over and above the remaining contract charges.any advice will be extremely appreciated
