In the meantime here is a letter that I intend on sending them in reply to their offer; Dear Sirs, Thank you for your letter dated 4 September 2012 where you admit that you had not adequately assessed my suitability for the insurance polices as sold to me. I do not accept your offer. Your letter suggests that the loan is in arrears and that any money refunded to me would pay off the arrears in the first instance and then any left over would be payable to me by cheque. I question the legality of this as we made an agreement in July 2009 via your solicitors Drydens for full and final settlement of the account. The letter states that you accepted the payment then in full & final settlement and that no other attempt would be made to recover any further sums. It is quite clear that the mis-selling of polices and the settlement reached is not linked. There is no caveat or special terms in your letter or the agreement made. I therefore request that you confirm to me in writing that the monies to be refunded of £3780.32 (plus interest at 8%) are paid directly to me with no mention of arrears, as there are no arrears. The account is settled per the enclosed details. Additionally, I have requested the details that you asked for from my doctors surgery. I have no issue with this except they informed me that it is usually you who send a form to the surgery to request this information. I look forward to hearing from you. Yours sincerely
  3. fair enough. In their offer letter, they state what I am owed but waffle on about paying back arrears. They don't state what the arrears is, nor the split between arrears and repayment to me. So frankly the letter is quite useless I guess.
  4. thanks dx. Do you know of any template letters that I could use when confronting them with this to pad it out a bit more so that it looks more like I know what I am talking about? I really had thought that when it is 'settled' they can neither pursue me for the rest of the debt and in this case, could not claim any of the PPI award which totals just under £4k by the way.
  5. hello, I have complained to Nationwide about mis-sold PPI and they have agreed that it was mis-sold. In their offer letter they state that the account is in arrears and that any monies paid to me will pay off the debt first. It relates to a loan that I was unable to repay in full. At the time of negotiating a FFS, i paid £4500 on a balance of £10k. My credit file is marked settled and I have a letter from them to say that it is settled. So my question is a simple one; Taking into account that the account is now settled, surely they won't now try and pay themselves the PPI award? Any advice would be much appreciated! Thank you!
