  1. I will see if we can get a solicitor but as you say expensive. If she only gets around £250-£300 a month what would be a reasonable repayment offer, or just make an offer and see if they accept? I don't think there is anything worth 7k plus in the house. we have car worth about 5k but I am thinking off putting that in my name. I understand that they can put a charge on the house and take the money when it's sold? Is that an offer we can make. My wife and I are not together at this moment so the money she gets is important to her for food and clothes etc.
  2. Many Thanks When my wife got the CCJ she gave it to me where I paid £80 to have it set aside, in those forms we put down her income, around £250-£300 per month. Capquest then provided loads of letters which they claim to have sent her making various offers to pay the debt (we never never seen them at all until copies provided). That's when we got the CCJ. The debt is 6 years old in June does that help her in any way? What type of enforcement action could they take?
  3. How much and how do we appeal? Is there a means test to say how much my wife can pay, if not successful?
  4. Yes we did the extended time and took it to court, can we appeal the court judgment from today?
  5. Hi Cag's I will try to keep this brief but could do with a little crumb of comfort in our house tonight. My wife applied for one of these driver instructor courses which was RED Driving School. Below is a brief timeline. Went to find about a driving instructor course in 2007, filled out some forms. I then didn't take the course due medical reasons, the course was cancelled with Red in Wimbledon One year later £179.00 was taken from my account, got in touch with RED and they agreed to take no more money I heard no more untill 2011 when Capquest contacted me requestiing £7000 for a driving course not even taken Capquest had taken a CCJ agaisnt me, so wrote to Capquest explaining the situation & received more threatning letters from Capquest Applied to the court to have CCJ removed and case to heard at court Went to Croydon County Court in November and judge was sympathetic towards my case and questioned Capquests conduct and advised to me to put in my own witness statement Another date was set for 11th March 2013 This judge gave me 3 minutes of his time, did not listen to my point of view & told me it was my signature on the credit agreement and I was liable to pay all court cost's and interest over 5 years Red Driving School have received this money, I did not not knowingly sign & credit agreement or receive any money or do the course So what are our options now? Can't afford to pay this debt, don't think we should bearing mind we have not even had the course, not like we have had a car or something. Think we have been very let down by the judge today. Any help would be of a great help to us.
  6. Hi This is a quick one guys and gals, my wife got a 6 month ban for totting up more than 12 points. The case was heard in her absence and we asked for the case be reheard, appealing the length more than anything else. This was back on the 25th April. The case is due to be reheard on the 7th September. After the 25th we kept getting letters from the DVLA asking for the license to be returned which we have and she has not driven to this day. The letter from the court for a rehearing does not state that she could drive or not. We had the license returned this week with no disqualification added to the counterpart. My questions are is how do we play this with the magistrate on Friday? It would be really harsh if she gets another six months after almost doing 5 months of a 6 month ban? Any ideas? Hi All I have been browsing and so far looks an excellent community to be involved in My wife has had a vist to day from the court saying she will be arrested if she don't pay a fine for failing to give information when stopped or caught by camera. She has been told she must pay in full, some £600. What are our options? Don't have the money to pay in one go, don't remember any paperwork relating to this, date etc, where. Is there a way I can get the information, take it back to court? File for statutory declaration? Thanks in advance Slates
