  1. Hello, Before I jump in accusing the other solicitors I wonder if any of you had any advise on what act or code this would come under? I'll keep it brief. Ongoing personal injury claim, my own solicitor is excellent. Defendants solicitor has just taken 4 statements from managers at my ex employers. Which is fine however my concern is all 4 use very similar language but most worryingly they all include 3 facts about my personal life they were never told about, while you say this can't be proved. Several facts weren't know about till months after I parted company with these managers, never to have spoken to them again. A partner's redundancy didn't happen till 5 months after I left the company - so for all 4 do include the same personal info that simply couldn't be predicted when I knew them (they all claim I told them) I was unaware as these were future events. This to me shows that the defendants solicitors must've leaked several parts of my personal life personal data for their statements or have all 4 could've seen into the future at the time yeah right I left that job in the Feb of that year so was unaware of a future redundancy and relocation for my partner and I, they have a letter to prove this was later on in the year. I'm not happy at several parts of my personal life has been leaked - what can be done? Surely it's a breach under some act? The personal life info above and other personal stuff mentioned is not relevant to the ex-colleges.

    Atos HCP

    Hello, Had a home visit for DLA. First letter was postmarked a Friday with a 2nd class stamp for an appointment on the following Tuesday so only got the letter a few hours prior to the appointment. therefore rearranged it as no notice given, have kept envelope and letter Atos said they do not need to give any notice and they posted in plenty of time! Can anyone advise a link to guidelines were ATOS state the notice period that they have to or should give? Dr that turned up introduced himself as a current GP. However he is not on the GP or specialist register. When confronted with this at a later date - he has now said he didn't say this. However an audio recording was in place for personal use. Dr ignored aids I use and what he was told, stating I need no help - basically he has written a false report to say no care help required despite various reports from experts being ignored. Despite not being a current GP he carried out a physical examination and an eye test - GMC complaint maybe? Dr then went on to diagnose that I had a severe mental condition and suggested I should start treatment - news to myself and medical team. Something made up from a line I said about feeling a bit low at times. Have done an initial complaint via ATOS but it's they're stating the DR didn't do any of that and he is right and I'm wrong attitude - they haven't stated where to go now - what's the next level of complaint I can take? Any advise folks?! Thanks!
  3. In the letter i've to send before sending the court summons - states i've to include items/docs I will use as evidence. I'm just trying to find out a template of a letter of claim. He has failed to tell me who he is insured with. Solicitor has also not responded to this request. Plan of action is to type up a letter once I find out how to set it out - once the deadline passes for that - fill in the small claim docs and sent them back to the court. I've got several quotes and all have came in pretty near each other. I just want the damage paid for. His dishonesty is unbelievable.
  4. They were just general letters stating it's time for communication to sort this out. As they haven't responded to those or my request for his insurance details. Should I now do a LBA - is this a set template. I'll have a nose around online to see what they're set out like. Thanks

Well I told his solicitor that along with the witness I have - the incident was caught fully on video - I've contacted his solicitor twice now without any response and him once without any response. Yes the police have a copy of the video too. Complete silence from the other side then guess that leaves me no other choice but to start action to take the case to court. A solicitor that won't even communicate with me seems to be a waste of time.
  6. I phoned the officer who dealt with the case and they've stated that his case hasn't been completed yet it's still pending. He was denying the driving charges too. Going back to the original post - if the driver is denying his actions and now has a solicitor involved - who hasn't responded to me other than to confirm he is denying it. Is it worth saying I've got CCTV prior to starting a small claims case?
  7. Again the court case for the driving offences are separate. I've sent a letter to the driver stating we need to discuss this. If he denies or fails to answer then I will begin a small claims action against him. Solicitor at an esate agent sent vague letter to state driver is denying it. Letter signed by company name not an actual person. This is my case I'm starting so should CCTV evidence be revealed to the driver or leave it to court? Solicitor has not replied to me, I wish this started ASAP so surely summons should be now.
  8. Thanks for the response. Not having much luck finding out if the case has been or not. I could try emailing the court with the details I have. I've viewed the video and it shows his car colliding with mine. His solicitor wants me to deal with them and not to write to the driver directly. I thought I had to send the court papers to the actual person though?
  9. For the police side of things I've not been told when his case will be. He was charged in Feb this year with careless driving, failing to stop & report. I think local courts have their lists of up and coming cases online so I'll search this. Thanks
  10. Hello, My car was parked on a residential street when the incident occurred. All cars were facing front to rear. I had a car parked behind me and a small space in front of me - to park it's easier for drivers to reverse bay park onto the side of the road on the left. As I had seen a car struggle with parking up the road I watched out the flat to see the driver come to the space in front of my car. He again struggled to get in - he was witnessed hitting my car on the first reverse. He went back and forwards a few times then hit my car again on the last reverse. The first thing his passenger and the driver did when they stopped the car was look at the front of my car......got his bag out of the boot and left the scene. You know if you've touched another car! Time I got down to have a look at my car he had left the scene. There was a long scrape on the front paintwork of my bonnet - the same mark as on the rear of his car. Now as I had a witness he was charged by the police. He is denying it all. I'm taking him to the small claims court to recover the cost of the repair. Approx £560 My insurance notified but not going through them. Now he has a solicitor involved stating he is denying damage. Do I need a solicitor? Or with the witness and I along with photo's should be enough to win the case via the small claims court. I've also learned that there is CCTV footage now that has picked this incident up. Should I tell the other party that I have footage of them of just spring it on them in court? Cheers
  11. Hello, Ordered a Canon 550D SLR from Littlewoods 2 weeks ago before it became faulty. A small part from within the camera came loose (focussing screen) rendering the camera useless. The inside area hasn't been touched, the loose part was noticed when changing the lens - a feature this camera has. Using the lens supplied with the camera. Told Littlewoods of the fault via online email form - not getting my query answered. Just getting a set template response that I need to deal with the manufacturers. Been on the phone to them too and just getting told I need to ring Canon up otherwise nothing can be progressed. If you ring up Canon they must confirm it's a manufacturers fault and give you a reference number to give to Littlewoods to allow the return of the goods. Like having your hands tied. A fault is a fault. A quick search online shows quite a few Canon users have had this issue with the focussing screen becoming loose. Littlewoods suggest if it's not a manufacturers fault then they would have to see what could be done! I've already quoted the sale of goods act and they're the ones as the seller that should put things right. Littlewoods take on things to date - they won't take my faulty goods back and have actually advised if I did return this item. I would be charged postage and an admin fee for this "service" as they would have to send it back to me - due to the returns department not having a reference for this return. They haven't offered anything else apart from contacting Canon directly for a repair - I've told them the camera isn't fit for the purpose, it's become faulty within a couple of weeks and I would like a refund. Bit hard if they won't accept the goods back. Item bought through the my online credit account. I've tried the help at Littlewoods email too but getting the same story from them. Best action to take next? Thanks
