  1. Hello, I don;t know if anyone happens to have any new bank details for GE Money. I have been paying my mortgage with them for months online and this morning it was rejected. As I am in arrears I took money from bank and went into Lloyds Bank to pay it into their account, only to be told it's the wrong number. I've tried to call them this morning but have just been lost in the phone system. Thank you
  2. Also, can the receivers just change the locks, or as with anyone else issuing a Section 21, if the tenant is not out by that date they will have to apply to the courts for possession? thanks
  3. Thank you Lea.I have written 2 further complaints (sent 2 weeks ago today) and a further complaint to the Compliance Manager. None of these have even been acknowledged. I have written today asking them for a response within 7 days or I will apply to the county court for help. Lea, do you know if anyone is entitled to any free time/advice at the courts to see what steps I can take?
  4. Lea would you mind if I ask another question from you? Would you know if the mortgage company can suddenly state the rental income is not sufficient to service the mortgage? I have just been re-reading my emails. I have one from the receivers just last week stating rooftop maintain my 'default balance' (assume that is the fees) must be paid before they stand down Fridays' email states rooftop instructed them to vacate the tenant and pass the house back with vacant possession? Can they really change their mind that quickly without giving me the opportunity of a pp with the fees or increasing the rent? I will copy these emails to the Compliance Manage tomorrow Thank you
  5. Thanks for your reply. When I asked for any further advice, I thought there may have been someone else on this forum who may have already dealt with a circumstance like this. I have no other T&C's apart from those stated in the contract I mentioned. Of course, thats not to say Rooftop never sent any later. The mortgage broker was struck off by the FSA for not paying monies due to them, unsure if my T&C's may have been sent to the broker although they were not struck off until 2009. I have asked Rooftop to provide my original contract etc, all they have responded with so far is that they need more time to deal with my complaint. I will see what response I get from the Compliance Manager after I send my letter tomorrow. I will ask them if the fees were to be paid can the house be returned to my control. I will let you all know
  6. I am going through some old paperwork I have. All documentation ie (mortgage offer/acceptance/conditions etc)were sent out by Classic Home Loans (letterhead) but at the bottom from The Mortgage Times in association with Rooftop Mortgages?? I originally took this mortgage out via Harrison Mortgage Strategies of Swansea, who are no longer trading. In the conditions section it just states basic things like the property must be let and not occupied by myself etc etc, it says nothing about receivers. Rooftop are so dodgy I am wondering if they will try and doctor something. I have emailed the receivers earlier informing them it is my intention to apply to the court to request rooftop remove them, but I told them I would be writing to the compliance officer in the morning. I will ask the compliance officer to look at the 3 current complaints I have in, and also ask him what can be done to ensure the property comes back in my name, can anyone else offer any further advice please? Thank you
  7. Thank you Ell-enn. As it's BTL i'm unsure if there are different rules. Thank you for asking someone else to take a look, I feel physically sick at the moment and am normally very strong willed etc, but they seem to be doing all they can to take this house
  8. Hi, can someone help me or offer some advice with Rooftop Mortgages please. I have a buy to let with them that I took out in 2006. Over the course of the loan i've had problems with tenants, got into arrears, cleared them etc, but as most people know with BTL properties this can happen frequently. In April I was around £1271 behind (current mortgage payment around £290) they then appointed receivers. I sent proposals to clear the arrears via email to the receivers and in post to Rooftop. They never responded. I have since paid all the arrears in full, now Rooftop have stated they want around £4000 worth of arrears paid immediately. The receivers told me that if I paid the fees, they would stand down, however, since that email they have sent an eviction notice to my tenant (my sister) I have 3 complaints ongoing with rooftop at present. One, where I have asked for a copy of my original mortgage, the use of receivers and their practice and I have disputed the charges. They have stated they need more time to respond. I sent another formal complaint Thursday, regarding their continued use of receivers and the fact they do not appear to be working alongside each other. I have sent another one today complaining of the fact they are instructing the receivers to vacate my tenant and return the house with vacant possession, yet not concluding my complaint, and resolving the charges dispute in order for me to clear them anyway. They have told my tenant to be out by the 17th October or they will change the locks. I've always been relatively good with finance but I must admit this is starting to wear me down. How can I pay any fees when the amount is is dispute? I've also been told fees cannot be classed as arrears yet rooftop are still continuing to pursue it? They are also stating the current rental income (£80 pw) is not sufficient to service the mortgage (£290 pm) but as i've said in a letter today I can increase the rent as and when would be necessary. They are trying to take the house from under me. I thinkg they will delay dealing with my complaint in 8 weeks, so that during this time they can vacate my tenant and get the house back. Does anyone have any advice they could offer please? Am I able to take this to a court myself? Thank you
