  1. Well, after a lengthy process I finally got my money back. I decided to take Streamline.net to the Small Claims Court and I won my case. My friend who is a lawyer suggested I update this post so that people who are in the same situation can see that there is hope of getting your money back.
  2. Hi All I have searched the internet trying to see if anyone else has been or is in the same situation but haven't found a similar situation. Basically, I have been a customer with streamline for a few years and they have charged me for another two years of hosting (don't you just love automatic renewal). I didn't want to continue and sent them a cancellation ticket the very next day. They replied saying that I can't cancel after the renewal date because it says this in their T&C's. I was rather disappointed and frusted with this response as they don't make it very easy to cancel. All I received was a renewal reminder letter 30 days in advance which states the following, Dear As an existing Streamline.net customer, you've had the security of knowing your website and email is safely hosted with Streamline.net. We are writing to let you know that your subscription is due for renewal within the next 30 days, and to confirm that we will renew your contract automatically to avoid any disruption to your hosting service. Renewal Information Package Type: package type Domain Name: domainname Contract Term: 24 Month, Pay 2 Yearly Renewal Date: 00/00/0000 Renewal Price: Please log in to your Streamline.net control panel (it states in their T&C's that if there is a change in pricing they will let you know in writing. There was a change in pricing and as you can see they didn't let me know in writing. this was also the first time they did this) Hosting package price stated excludes domain name renewals. Viewing Upcoming Renewals Upcoming renewals can be viewed in the "Manage domains and hosting" section of your Streamline.net control panel. From here you'll see all automatic hosting package and domain registration renewals due on your account, and the date these renewals will be processed. Once any payment has been processed you'll find it in the "View Invoices" section, where you can also download VAT invoices for completed transactions in PDF format. Payment Methods This renewal will be processed automatically and will be charged to the payment card held on your account. You can update your payment details in your Streamline.net control panel if you need to, however if these details are already up to date you won't need to do anything. You don't need to do anything to renew Your contract will be renewed automatically once the renewal date is reached. Of course, if you'd like to know more about the different hosting services available to you, or have any other questions, please contact us on 0844 941 1000 and we'll be more than happy to help. We would like to take this opportunity to thank you for your business, and look forward to continuing to provide you with premium hosting services. (notice no mention in the letter of how to cancel) When I received this email I just assumed that they didn't have my card details and when the time came for it to renew the account would just close as they wouldn't be able to take the money. Of course this wasn't the case, they did have my card details and they did charge me (lesson learnt... never assume!). So I did some research and came across the distance selling act. One point it makes is that a company must provide in writing to the customer details of how to cancel. I also contacted citizens advice and explained the situation and they confirmed that streamline should provide this info as they didn't. So I proceeded with writing the required letters to them and they have just replied saying that they haven't breached this because this is a renewal. I also told them that under the unfair contract terms I have only taken the contract out for two years and that they can't just continue renewing without my consent. They have just ignored that. I was told by Citizens Advice that after the obligatory three letters, I must call Citizens Advice back and they will let me know what I can do next. So I called them back and was told a completely different story. They said that the T&C's are available online and therefore have been provided (huh.. now I am confused). I didn't see this coming and explained that how can providing T&C's online be the same as supplying them to a customer. Anyway, the person said if I want I go ahead I can go to small claims court and try and argue the ditance selling act point. Does anyone on here have any advice as to whether I have any legal grounds to stand on with persuing a claim to get my money back? Many thanks in advance for your help!
