I think that may be a plan.....I was thinking that the problem wasn't quite serious enough to go to her with, but I s'pose, looking at the big picture, there might just be lot's of people out there who have been more damaged than I have by whatever this stupid mistake is that the RBS are making......I surely can't be the only one it's happened to in recent years.
  2. Nicola Sturgeon.....she's MSP. Do you think it would be worth getting in touch with her? She has a really solid law/money advice background.....this may just hit the right note with her, I've been thinking about it.
  3. Yes...I think the best course of action is to wait until I have all the info. I know I'm going to have a battle on my hands trying to get them to untangle the mess, so I'll need to try and make some sense of it myself. Thanks Phil
  4. Thanks for that guys, I was beginning to think that the RBS were going to worm their way out of the whole Overdraft Loanguard Insurance debacle. I'm thinking... ..do you think it may be best to hang fire till I also have confirmation that the Overdraft Loanguard Policy would have paid out.. ...if they hadn't denied it's existence, and go after them for mishandling both policys' in court.... ...which is where I may end up if they don't agree to clean up my credit report. G p.s. my brain hurts.
  5. Hi lovely people, Recent developments on the Lombard Direct (RBS) loan. This is the policy I tried to claim on at the same time as my overdraft insurance and was told by Lombard at the time that I didn't have insurance to cover me for sickness. I had sent off a copy of the settlement letter that I found by chance (but never used) from Lombard in 2007. I got a response today from RBS PPI Customer Concerns saying how sorry they are that I'm unhappy (just a tad). ...also asking if I am subject to any fiduciary arrangements. Not knowing if that meant the unlawful CCJ they have against me, I called. Was told they didn't know but to call Lombard Direct. Lombard Direct said they didn't know, but as the letter came from RBS PPI Customer Concern Team, to call them (same old hamster wheel) While on to Lombard Direct, I asked the girl to check if there was a policy attached to that loan number... ..she gave me the policy number. I explained that I had tried to claim when I was sick, but told I didn't have insurance to cover me. It seems I had sent them a claim form (can't even remember doing this....all I recall is being told on the phone that I didn't have cover) she had all of my hospital report, which she read through, but then said she didn't understand.. ...all notes ect. were for sickness, but the actual refusal was for unemployment. I explained that I had been on a contract abroad, with a UK company, but had to come home because I was sick. She then explained that the reason my insurance would have been void was because I was working on contract. I explained that I was never claiming for unemployment, but for sickness and had I not been sick, I would have still been working. According to her, it's all the same......couldn't have used the policy for sickness. I've asked her to send me Terms and Conditions. I called FOS to ask what they thought and he recons what she is talking about is 'at point of sale' and if I was in full time employment in the UK at the time I took out the loan (I was) the policy was valid.   6. Hi, Just checking in with an update. Things are ticking along nicely behind the scenes with lots of great advice on the best way to approach RBS when SAR's are returned. My plan for tomorrow, is to chase up everything that was sent out last week and make a general nuisance of myself. Thank you all once again for all your help and support.   7. Thank you for your encouragement......you are kind. I've been so lucky to have found the forum. I do believe I was at a point where I was giving up the fight.....had no more to give. Last Monday I was still at square one with the whole issue after over three years. By this Monday? everything is posted out and now (I feel like a wee freight train) I'm just waiting to chase up SAR's and cross reference when the data starts arriving, that should make for interesting reading. It was suggested to me today that I could possibly write directly to the Sheriff Court, tell all and ask their advice......brilliant idea!!, flag it up....... never would have dreamed of doing that. I've been working on a letter to the court which I'll post on thread tomorrow. Cheers G
  8. Hi Phil, No, they won't put anything in writing......data protection apparently. I believe you may be right about about keeping my head down. I'm sure they must be saying "oh god, that crazy woman is back"!! Hopefully the SAR's will throw up something that will maybe make some sense of the thing that is RBS. G
  9. A wee update. I contacted Nat West RBS Insurance who have now given me a Customer ID Number attached to the Overdraft Loanguard (apparently they do not deal with 'Policy Numbers'. Insurance was taken out in the year 2000 and was cancelled 6.7.2009 - their system shows an Overdraft Loanguard payment of £22 for July 2009 and similar payments historically. Tthe reason my branch has given for cancelling the policy (which Nat West have on their system) is that 'I had stopped paying the premiums'. Confused? you will be........honestly!! you couldn't make it up. Now it's a waiting game for the SAR's to start kicking in.. ...and to think, last Monday I didn't know what a SAR was. G:roll:

  12. Hi, I’ve been working on a diary about RBS Loanguard which I have had a 3 year battle about and having trouble with the whole timeline thing. Everything seemed to happen so fast and take me over, but when I was looking at court papers etc last night from 2009 I was thinking why didn't i deal with that sooner? Maybe I was just not very well (in the head) ha. I went tearing through boxes etc this morning to try to jog my memory. I know I should be concentrating on the RBS stuff, but this jumped out at me and rather than put it aside I thought I'd run it past you, should I follow this up? It looks like I had insurance once again and they have denied it, but hey, what do I know. I have found paperwork relating to a loan from Lombard Direct which was one of my RBS Direct Debits. 1/ (21.11.2008)Letter from Lombard noting receipt of my claim form. (Unfortunately I don’t have anything from them actually disputing insurance cover)....but 2/ (14.09.2009)A letter from Eastwood & Co. Solicitors demanding payment of loan (I’m assuming they disputed insurance cover) 3/ While rifling through an old box of random papers I found a letter from Lombard Direct dated (02.10.2007) it looks like I requested a settlement figure on the loan (Loan Account Numbers match). ...maybe thinking of paying it off, but clearly changed my mind. It shows: Current balance on Account £1748.80 Less: Rebate on Loan 98.74 Rebate ofInsurance premium 83.87 182.81 Amount required to settle the loan 1566.19 They seem to be offering me a rebate on insurance, which they disputed existed when I tried to claim. Maybe I'm wrong, but hey, they seem to have RBS connections, and nothing would surprise me. The balance at the time I tried to claim was £159.30 and was paid off in instalments last one 01.09.2011.

  16. Hi, Many thanks to all for your help last week. I had no idea where to turn. Your direction and advice has been priceless, All SAR's are out now, hopefully they won't go dragging their feet for too long and I can cross referencing and make some sense of why there has been so much confusion over the last 3 years.   17. A wee update, well, it's all go go go. I honestly don't know what I was doing with my time before I found all of you. I've gone all technical and can now navigate my way around my scanner... ..I've only ever used it as a printer. I've spent lots of time on the blower tracking down those who may have documents relevant to my case lurking in their archives, but more importantly, sifting out those who don't. It's been a really worthwhile exercise and for the most part, the people I have contacted have been really approachable i.e. the Sheriff Court were very helpful and offered good advice. I've sent off SAR's to RBS. Nat West and Anderson Fyfe's will be mailed tomorrow. Hope the sun shines for you all tomorrow. Cheers G.

I actually feel like I've gone further with this issue in the last 24hrs.(since I found CAG) than I have for the last 3 years.   22. Ok gave up trying to locate my last reply dah!! Will quickly summarise There was some confusion with Money Matters who were supposed to be helping me with the RBS at the time i was served court papers.... ..Money Matters were trying to negotiate a payment plan for OD startted at £20pm in the end we offered £50pm and all went quiet, didn't hear anything from Money Matters. ...tried to call, left messages on machine etc. Money Matters proved to be difficult to get hold of in the week or so running up, they were never open, so I went alone, spoke to the judge and eventually it was agreed £65 pm I've been paying this since Sept 2009 pay to Anderson Fyfe.
